FACTS

Petitioner AAA and respondent BBB tied a knot on August 1, 2006 at Quezon City,
resulting in the birth of two children. BBB began working in Singapore as a chef in May 2007
and obtained permanent resident status in September 2008.
AAA claimed that BBB was providing insufficient and erratic financial assistance,
which forced her to work extra hours as a flight attendant. He was accused of virtual
abandonment, mistreatment of her and their children, as well as physical and sexual violence.
AAA also stated that BBB had an extra marital affair with a Singaporean woman, Lisel Mok,
whom he allegedly shared home in Singapore.
On April 19, 2011, a violent altercation occurred in Singapore during her visit with
their kids. Despite abuse claims, the prosecutor indicted BBB on a basis of AAA’s mental and
emotional anguish through his alleged marital infidelity. A warrant was issued but BBB evaded
arrest, leading to the case being archived. On November 6, 2013, a motion to revive the case
was filed on behalf of BBB. The motion to quash was granted on ground of lack of jurisdiction
which resulted in dismissal of the lawsuit.
