Affidavit of Desistance

I. Pia M, Smiths, Filipino, single, with residence of P-1 Parang Jose Panganiban under oath
allege:

1. That I am the complainant in Criminal Case No.194234 for alleged "RAPE" against
accused Manuel Marino which case is pending before the Regional Trial Court of Deat,
Camarines Norte, Philippines;

2. That I signed the aforesaid complaint against accused Manuel Mareno against my will, my
signature in the complaint having been obtained through force, violence, and intimidation
done to me by my parents;

3. There is no truth to the allegations contained in my sworn statement executed by me

against my will in case of repe, against by the accused Manuel Mareno. There was no force,
violence, or intimidation done against me by Manuel said the accused. I was not forced by
him to submit to his desires. It was all in accordance with my own will, volition, and consent
that I went personally to him because we love each other and I agree and consent to live
with him as my husband;

4. I therefore respectfully request that the above-mentioned case filed against Manuel
Mareno be dismissed as I now withdraw my complaint against him and I further manifest
under oath that I am now desisting from testifying against him in Court or any other
government entity or agency in connection with the said criminal case.

I, Dan kavin responde, 20, single, resident of VI, Plaridel, Jose panganiban cam Norte, after
having sworn in accordance with the law, do hereby depose and state THAT:

I was present and personally saw that the accused, Manuel Mareno committed the crime of
Rape against the victim Pia M, Smiths

On 15 April 2023 at around 6:00 o’clock in the morning, appellant Manuel and Pia met each
other in Hotel so a similar sexual assault happened on that day, Pia was only fifteen (20)
years old at that time.

It happened while Pia was with Manuel, the accused forces Pia to come along in one room
with her and one night stand with Manuel.

The appellant was treating her, the accused to Pia If you did not come to me I would kill you
so Have no choice so he came along with Manuel. on her left side. Suddenly, the appellant
lifted her skirt, removed her underwear, and inserted his finger inside her vagina.

After accomplishing the atrocious act, the appellant threatened to kill her if she [would]
disclose to anyone what happened to her.

Manuel Mareno being the stepfather Ashley employs force and intimidation

Manuel commits sexual assault and/or is subject to sexual abuse the latter by inserting his
finger into the genital or private part.

the acts done by a witness are only concerned

I executed this affidavit to attest the truthfulness of the foregoing facts and to support the
filing of Criminal Cases against Manuel Mareno for violations of Rape

I, Pia M, Smiths, Filipino, of legal age, single, and with residence at Purok -I, Parang Jose
Panganiban, after having been duly sworn in accordance with law, hereby depose and state
that:

A. On 15 April 2023 at around 6:00 o’clock in the morning, appellant Manuel and Pia met
each other in Hotel so a similar sexual assault happened on that day, Pia was only twenty
(20) years old at that time.

B. Many girls Complain that they suffered the same horrible fate.

C. On 15 April 2023 at around 6:00 o’clock in the morning, appellant Manuel made a similar
sexual assault on me who was on legal ages at that time.

D. It happened while I'm with Manuel, the Manuel forces me to come with him in one
room with her and one night stand with her

E. Suddenly, the appellant lifted her skirt, removed her underwear, and inserted his finger
inside her vagina.

F. After accomplishing the atrocious act, the appellant threatened to kill her if she would
disclose to anyone what happened to her.

WITNESS: at the hotel sir

FISCAL: where are you on that day?

WITNESS: I'm in outside.of the hotel waiting for my friends sir

FISCAL: Do you know a letter dated April 15, 2023, Mr. Witness,?

WITNESS: on April 15 I was in out side of the hotel waiting for my friends where going to
hangout but I saw Manuel and Pia on the hotel but manual forcing Pia to get inside in the
hotel.

FISCAL: what did you see Manuel and Pia?

WITNESS: around 6:00 o' clock sir

FISCAL: Is it not, Mr. Witness, that you said awhile ago, you testified a few minutes ago that
Manuel and Pia are girlfriend and boyfriend ?

WITNESS: Yes, sir

FISCAL: The said letter, is dated April 15, 2023 Pia, and Manuel said [AAA] was his girlfriend
at the time?

WITNESS: Yes, sir

FISCAL: I am confused. You are giving us the truth of the crime why?

WITNESS: " because I'm concerned citizens

FISCAL: Meantime I have no more questions to ask from you, do you have more to say or
add to this judicial affidavit?

WITNESS: No more sir.

FISCAL: Are you willing to sign this judicial affidavit and subscribe to it under oath?
