LEASE AGREEMENT
This lease agreement is made this _________ day of ___________ 20______ between PETER NG’NG’A
KIIRU ID No. ………………… of Tel: ............................... in the Republic of Kenya (herein referred toas the
“LANDLORD” which expressions shall where the context so admits include her successor, heirs and assigns in
title) of the one part and ____________________________________________ ID No.
_____________________Of Tel: ___________________, in the aforesaid republic (herein
referred toas the “TENANT” which expressions shall where the context so admits include her successor, heirs
and assigns in title) of the other part. Whereas the LANDLORD is the registered owner of the plot. The
residential house located at TEACHERS ‘A’ and is desirous of leasing at a monthly fee of ksh.
_________________ with effect from, _________________day of __________________ 20______________.

NOW THIS LEASE AGREEMENT WITNESSETH AS FOLLOWS:


1. The Landlord shall lease the premise for a period of (as agreed between the Landlord and Tenant).
2. The Tenant shall pay rent covering 1 (one) month in advance totaling to ksh _______________ a sum of
which the Landlord acknowledges receipt by signing hereof.
3. The Tenant shall be paying rent in advance on or before the 5th day of every succeeding month with
effect from agreement date.
4. The Tenant shall be paying 10% of the total monthly rent if the payment is made after the 5th day of
every month as penalty for late payment.
5. The Tenant shall be paying water and electricity bills to the authorities concerned and any other bills
that may accrue to avoid disconnection without any further notice. Should the supply be disconnected in
addition to settling the outstanding amounts the Tenant therefore will be required to pay applicable
reconnection fee.
6. The Tenant shall bear the cost of maintenance and repairs arising out of the normal day to day usage of
the premise.
7. The Tenant shall not transfer, part with possession or sublet the premise or any part thereof without the
Landlord’s consent.
8. The Tenant shall keep the fixtures and fittings in good and tenable repair.
9. The Tenant shall handover the premise to the Landlord or his authorized agent on or before the 1st day of
the month she wants to vacate.
10. The Tenant shall be at liberty to employ the security of his own choice at their own cost.
11. The Landlord or his estates agent has aright to evict without notice and irrespective of the lease
agreement if the Tenant dishonors one of the clauses herein.
12. The Tenant shall have a quiet enjoyment of the premise provided that he complies with express or
implied covenants.
13. In case of breach of Tenancy by the Tenant after paying the full rent amount, and therefore demanding a
refund, a 20% shall be deducted as liquidated damages and expenditure incurred due to such an incident.
