INDEMNITY BOND
(For Transfer on basis of Sale/Gift/Transfer and/ or For Mortgage of Flat)
This Indemnity Bond is made at Mumbai on this ___ day of ___________, 20__.
I/We, Shri/Shrimati ____________________ (hereinafter shall be referred to as the
“Executant(s)”), resident of ___________________ Indian Inhabitant state as under.
WHEREAS the above said executants(s) has/have entered into an Agreement for
Sale/Sale Deed/Gift/Transfer Deed for the said Flat being Flat No. ______ in the __ Wing
(“said flat”) of the Orchid Enclave Co-operative Housing Society Ltd. (hereinafter referred to
as the “Society”) situated at Bellasis Road, Mumbai Central, Mumbai – 400 008.
AND WHEREAS the Executant(s) is /are desirous of getting the above property
transferred in his/her/their name on the basis of Sale/Gift/Transfer Deed and the Society has
demanded the Executant(s) to Indemnify the Society by the way of this Indemnity Bond.
(or)
AND WHEREAS the Executant(s) is /are desirous of obtaining a loan against mortgage
of the said flat with the _________ Bank at __________ Branch and the Society has demanded
the Executant(s) to Indemnify the Society by the way of this Indemnity Bond.

NOW THIS INDEMNITY BOND WITNESSETH AS UNDER:

1. That in case the Society or any of its members/ employees would suffer any loss on
account of transfer/ mortgage, the executants(s) he/ she/ them shall be liable to make
good the loss which may be sustained by the Society and/or its members or its employees

on account of this transfer. The Executant(s) shall remain liable to indemnify and keep
indemnified the Society and/or its members/ employees for all such losses, damages and
claims.

2. That if any persons will make any claim regarding the said flat, then the litigation of the
same shall be defended by the Executant(s) and the loss suffered by the Society shall also
be made good by the Executant(s) and his/her/their properties.

3. That the said flat is free from all sorts of encumbrances and it is not charged, mortgaged
or alienated in any manner and no underhanded sale is involved in respect of the said flat.

4. In consideration of application made by the Executant(s) to transfer the said flat and the
Society having agreed to permit the transfer of the said flat in the name of the
Executant(s), I /my heir, executors, administrators shall at all times hereinafter remain
liable for and shall fully and effectually indemnify and keep indemnified the said Society,
its successors and assignees against all losses and damages , costs and expenses, claims,
penalties or any other action whatsoever may be incurred or suffered initiated by third
parties.

5. That any NOC issued by the Society shall be used for limited purpose of transfer/
obtaining Loan and the same shall not be used as a title document

IN WITNESS WHEREOF, the Executant(s) has/have set his/ her/ their hands, on this bond
in presence of the following witnesses, this Indemnity Bond is signed at Mumbai.
