Section 104 of Administrative Order No. 7, Seties of 2011 is hereby amended to read as follows: Section 104, Public Works for the Use of the Community. ~ Existing improvements that ate not property of public dominion which may be used by the community and the public, such as, but not limited to, roads, firebreaks, bridges, and irrigation canals, and those that are not yet existing but is included in the subdivision plan, such as road and canal lots, shall remain titled under the name of the Republic of the Philippines. As such, and considering that ownership thereof will not be transferred to them, the ARBs need not pay the State for such portions and shall be excluded from the amortization payments. Section 2. A new Section is hereby added after Section 104 of Administrative Order No. 7, Series of 2011 to read as follows: Section 104-A. Common Service Facilities. - Fixedprivate common agricultural service facilities, such as, but not limited to, warehouses and dryers, which are for common use and benefit as may be defined by DAR, shall be transferred to all of the ARBs in the landholding through a Farmers’ Association or Cooperative, or in the absence thereof, through co-ownership, and equally shared payments covered under cither individual or collective land amortizations, as the case may be. Section 3. A.O. No. 7, Series of 2011, and all other orders, circulars, nules and regulations, and issuances or portions thereof that are inconsistent herewith are hereby repealed or amended accordingly. Section 4. Any judicial pronouncement declaring as unconstitutional any provision of these Rules shall have no effect on the validity of the other provisions not affected thereby. Section 5. These Rules shall take effect ten (10) days after its publication in two (2) newspapers of general circulation.
