Provided further that the order of the Commission or.the Court shall be effective from the time of passing thereof or proclamation thereof in a newspaper, widely circulated and dispatch at the last known address ofthe accused. 28. 29% 30, (4) If the property ordered to be frozen consists of livestock or is of'a perishable nature, the ‘Commission, or the Court may, if it deems proper and expedient, order the iramediate sale thereof and the proceeds of the sale may be deposited with the Commission ot the Court, co as either may direct as appropriate. (8) The powers, duties, and liabilities of a receiver, if any, appointed under ths section shall be the same as those of receiver appointed under Order-XL of the Code of Civil Procedure, 1908 (Act'V of 1908). (©, The onder of freezing mentioned above in sub-sections (1) to (5) shall, as the case may bes remain operative unil final disposal by the Court or the Appellate Forum, notwithstanding filing of or pendency of an appeal under this Act, Claim or objection against freezing (1) Notwithstanding the provisions of any law forthe time being in force, the Court shall have ‘exclusive jurisdiction to entertain and adjudicate upon all claims or objections against the freezing of any property under section 27 above. Such claims or objections shall be made before the Court within thirty days from the date ofthe order freezing such property. @) The Court may for sufficient cause extend the time for filing such claims or objections for aperiod not sxceeding additional fifteen days, {@)_ No appeal siw il lie against an order made under Section 27 of this Act or against any interlocutory order except that an appeal shall lie against a final order which may be passed by the Couit as hereafter provided, Transfer of property void (1) Notwithstanding anything contained in any other law for the time being in force, after the ‘Commission has initiated investigation into the offences under this Act, alleged to have ‘been committed by an accused person, such person of any relative or associate of such person of any other person on his behalf, shall not transfer by any means whatsoever, create a charge on any movable or immovable property owned by him’ or in his possession, which is the subject matter of inquiry or investigation, while the inquiry, + investigation or proceedings are pending before the Commission or the Court; and any transfer of any right, title or interest or creation ofa charge on such property shall be void. @) Any person who transfers, o creates a charge on property in contravention of sub-section. (1) shall be punishable with rigorous imprisonment for a term, which may extend to three ‘years or with fine which may extend to five hundred thousand rupees or with both. ‘Power to seek assistance The-Commission shall have the power to seek full and complete assistance and call for any document and information relevant to or in connection with any matter or proceeding pending before the Commission, from any department of the Federal Govemment, Provincial Goverament, local authority, bank, financial institution, person or any authority and institution or. department in the ‘public sector or the private sector, as he may deem fit and proper to demand or require: Provided that in any case in which a question of secrecy is involved ois raised at any time, the Commission decision shall be final.
