INFORMATION ON EMPLOYMENT AND DOCUMENTS: The documents which the employee must ‘submit before starting work must date back to 2 months at most. and shall be in effect for a) Residence Information b) Police Clearance Certificate ©) Extract of Civil Registry Record 4) Chest X-ray, Hearing test, PFT (respiratory function tests), Hemogram and Fasting blood glucose test, HBSAG, HCV, HIV, VDRL analyses. 7. PROBATION PERIOD: The probation period is three months, The parties may terminate the employment contract without notice and compensation within this period; however, if the employee decides to leave within the probation period, visa, work permit, health expenses and ticket costs are collected from the employee. 8. WORKING HOURS: a) Weekly working hours is applied as 6 days a week as working days and 1 day of weekly leave. b) However, if deemed necessary by the employer, the normal weekly working hours, starting and ending hours, may be arranged in different ways for the employees and be changed when necessary, depending on the nature and conditions of the work. ©) Break times are determined by the employer. COMPENSATORY WORK: _In cases where the work ceases due to compulsory reasons, the workplace is suspended before or after national holidays and general holidays, or the work is performed for significantly below the normal working hours for similar reasons or the work is completely halted or the employee is given leave upon request, the employer, within two months, may make the employee do compensatory work in return for these periods of no work activity. Compensatory work is not considered overtime and no overtime pay is paid in return. SALARY: The monthly salary of the employee is ............... USD. a. Asatule, the salary of the employee is paid to them against signature or through their bank account. Social Security and Health Insurance costs are borne by the employee. b. The income tax of the employee shall be paid by the company to the Federal Republic of Somalia. c. The employer undertakes to pay the salary of the employee arising from this contract. The salary of the employee is paid once a month. Unless there is a force majeure, the salary of each month is paid on the third day of the following month. ©. 50% of the first 2 salaries of newly employed employees are retained by the company. Employees who have completed 1 year receive their retained salaries back with the following salary payment. f. Advance requests may be requested on the 15" of each month at a rate not exceeding 1/3 of the salary. LEAVE AND TICKET RIGHTS: a) After having completed 180 days, the employee is entitled to 15 days of leave and 1 day of travelling leave. b) After completing every 180 days, ticketing is arranged to be ......... as the destination. ©) The employee agrees to use the paid leave, which they will be entitled to at the end of the 180-day working period, at the time to be determined by the employer according to the working conditions. d) Round-trip tickets are covered by the company during employment and regular leave periods. €) In case of quitting work, the return ticket is provided by the company if the employee notifies in time. f)_ Incase of untimely and inappropriate departure, the employee provides the ticket themselves. g) If the nature of the employee's business travel is a DECALE AIRPORT HOTEL affair, the employee's business travel is determined and paid by the per diem amount determined by countries. PRIVACY and CONFIDENTIALITY: a) If, through this employment, the employee gains access to business information, employees, partners, customers, subcontractors, government agencies and personal information of DECALE AIRPORT HOTEL, such information may not be disclosed. b) The employee undertakes not to disclose any kinds of business secrets belonging to the employer and the company, and not to act in a way that may harm the employer. 7 Deamente ——[oensosi03 Oo INTERNATIONAL PERSONNEL —_[evsonone | v.20 paca CONTRACT pevaene fn 13. LEGAL CONFORMITY: a) The employee may not engage in any illegal activity during the working period. b) The employee undertakes not to work in another job, even if itis private, as long as the employment contract is in effect. c) The employee undertakes not to come to the workplace under the influence of alcohol or drugs, not to use these substances in the workplace, not to bring goods and substances not related to their work, and substances prohibited to be transported or used to the workplace. 14. USE OF COMPANY TOOLS AND MATERIAL a) The employee undertakes to use the machinery, tools, and equipment in the workplace duly and diligently, not to engage in works not related to their job, not to use machinery, tools and equipment. that are not delivered to them. b) The employee undertakes not to take the materials, tools and equipment delivered to them to be used in their work out of the workplace and not to use them for any other purpose. ©) If the employee is involved in the loss or damage of any vehicle, equipment, or uniform, particularly through the negligence or wilful misconduct of the employee, the cost shall be deducted from the employee's pay. 15. RETURN OF COMPANY GOODS: _At the termination of the employment contract, the employee undertakes to deliver in full the identity cards, uniforms, radio, and all other company goods delivered to them and to compensate for any damages caused by their own intent or fault, if any 16. IMPLEMENTATION OF THIS CONTRACT and OF COMPANY BYLAW: a) This contract enters into force upon the signing of this contract by the employee and the employer. Employees and employers are obliged to enforce this contract, and a copy of the contract must be given to the employee and employer after signing. b) The employee accepts and undertakes to comply with the working conditions, work discipline, occupational health and safety rules determined by the employer, and regulations such as guidelines, notices, circulars, and instructions issued or to be issued by the employer in the workplace 17. OTHER CONDITIONS a) Non-continuous in-cash and in-kind payments made by the employer for incentive purposes, without contracting to some or all of the employees, do not constitute a vested right for the employees and do not mean that such payments will be repeated. b) The employee agrees in advance to work on national holidays and general holidays if the employer deems it appropriate. No pay is paid for such working days. ©) The employee agrees in advance to work overtime if the employer so requests. Examination and medicine expenses for eye and dental treatments shall be covered and other applications shall be exempted. ‘The employees shall be provided with accommodation and 3 meals a day. In the event of the death of a first-degree family member (parent, spouse, sibling and children) of the employee, the employee is given five days of paid leave, including travel, with the approval of the Senior Management. Round-trip ticket fee is borne by the employee. Female and male employees are entitled to five days of paid marriage leave. Ticket costs are borne by the employee. If the date of marriage is on the employee's temporary leave, the employee is given 5 days of paid leave in addition to the temporary leave. Even if it is proven with a doctor's report obtained outside of Somalia, the days of absence of the ‘employee and the cost of ticket change shall be deducted from the monthly salary of the employee. Ifthe employee fails to show up for work for 3 days without an excuse or leave, the contract shall be terminated. If the employee wishes to quit, they must inform the employer in writing 2 months prior to the date they wish to quit. In case the employee resigns during their employment, all figures paid on behalf of the employee such as visa, work permit, fight ticket, blood test etc. shall be requested from them. There shall be no right to demand leave days for the employee. If the employer wishes to terminate the employment contract of the employee, the employer must give a written notice 15 days in advance. This indefinite-term employment contract, consisting of two pages, is drawn up and signed by the parties in two copies on 13/09/2023, and the employer hereby agrees, declares and undertakes to give the employee a job and salary, and the employee hereby agrees, declares and undertakes to work under the conditions specified herein, EMPLOYER OR PROXY'S.
