SCENARIO

Jason Wong (“JW”) is a 45 year old man resides at Taman Bukit Indah, Ampang, Selangor. Kenny Ong
(“KO”) is a 58 year old man resides at Taman Melawati, Kuala Lumpur. On 15.12.2021 at about 7.30
pm, JW was riding his motorcycle a Yamaha 250 cc model and bearing registration no. WC 5735D along
the MRR2 Highway, with his 10 year old son, Anthony Wong (“AW”) from the direction of Gombak
towards Ampang. KO was driving an Audi S4 motorcar of registration no. WYS 8823 (the motorcar) at
the material time. The motorcar was moving in the same direction as the JW’s motorcycle. It was dusk.

JW claimed that he was riding on a low gear on the left lane of the highway. KO who was driving at a
great speed, suddenly switched lanes from the middle lane to the left lane, and in doing so, grazed JW’s
motorcycle who was travelling on the left lane. This impact caused JW’s motorcycle to skid, causing him
and his son to fall. The accident happened in front of KL East Mall, Taman Melati, Kuala Lumpur.

JW and his son AW were admitted into Hospital Ampang Selangor, on the same day; i.e on 15th of
December 2021. JW was treated as an in-patient until the 21st of January 2022. On admission JW’s
condition and injuries were described as follows:–

1. Patient was unconscious.

2. Bleeding from mouth and right ear.

3. Lacerated wound over the right side of scalp.

4. Fracture of the jaw.

In the meanwhile his son, was admitted from 15th of December 2021 and treated as an in-patient until
the 22nd of March 2022. On admission he was found to be suffering from the following injuries:–

1. Multiple lacerated wounds of the right chin and face.

2. Lacerated wound 1′ long just lateral to the left eye.

3. Haematoma on the ventral surface of the left forearm.

4. Fracture of right femur.

5. Fracture of the left femur.

6. Fracture of the left clavicle.

7. Fracture of right ulna.

8. Fracture of left radius, lower end.

JW approached your firm, Messrs Hilmi & Partners, to bring the case in court claiming
compensation against KO.

1) Discuss the meaning of cause of action and the possible cause of action for the case.
