Thiru. Ramesh @ Mint Ramesh, male aged 51, S/o. Mani, No.129/130, 11 th
Block, Mogappair East, Chennai – 600 037, is a Goonda and has come to adverse
notice in the following cases:-

the date of entering into an agreement by the
complainant, the accused Thiru. Mint Ramesh
and his henchmen were threatening the
complainant to hand over the above land to the
accused. From the month of March this year,
the accused Thiru. Mint Ramesh and his
henchmen were threatening the complainant in
person with dire consequences threatening him
to handover the above land. Subsequently, on
11.04.2023 at about 1800 hours when the
complainant went to the above land, the
accused Thiru. Mint Ramesh and Thiru. Mahesh
@ Nagercoil Magesh scolded him in filthy
language and threatened him. When the
complainant attempted to leave the spot,
both the above accused wrongfully restrained

dire consequences and beaten the complainant
with their hands over his face, hands and legs
indiscriminately. When the complainant raised
hue and cry, the nearby public went near them.
Noticing them, both the above accused
threatened the complainant with dire
consequences if he fails to handover the above
property to them. Based on the complaint from
Thiru. Anbarasu, a case was registered. At the
time of his arrest in T-3 Korattur P.S. Cr.
No.332/2023, the accused Thiru. Ramesh @
Mint Ramesh admitted that he was involved in
the above offence along with his associates.
This case is under investigation. He was
formally arrested and remanded to judicial
custody under P.T. Warrant in this case.

2 T-3 Korattur 294(b), The complainant Thiru. Prakashraj’s friend Selvi


P.S.Cr. 504, Narayani approached the complainant to
No.366/2023 506(ii) prepare documents for her land at Korattur and
IPC assist her to sell the same. While the
complainant and his friend Thiru. Sathish were
preparing the documents for selling the above
property, the accused Thiru. Mint Ramesh who
is a H.S. rowdy and Thiru. Nagercoil Magesh
threatened them for selling them the property
without their knowledge and demanded them to
give 2 grounds of land or commission to the
accused. Hence, the complainant convinced
Selvi Narayani to pay them the commission and
the complainant had sold the above property.
But, the accused did not receive the commission
amount and pushed down Selvi Narayani and
snatched away the whole amount in the box,
threatened Selvi Narayani with dire
consequences and the accused escaped from
the spot. Hence, Selvi Narayani lodged a
complaint in this regard and the investigation
was pending over the above complaint.
Subsequently, on 18.05.2023 at about 1000
hours in the forenoon while the complainant and
Thiru. Sathish were present in their lawyer’s
office at No.09, near Thathankuppam Signal,

accused Thiru. Mint Ramesh and Thiru.
Nagercoil Magesh went there in an Innova
Crysta car, scolded them in filthy language and
the accused Thiru. Nagercoil Magesh threatened
them that he would commit murder of both
them if the approach the police. Further, both
the above accused threatened them at the point
of their knives and the accused Thiru. Mint
Ramesh threatened them with dire
consequences. Further, both the above accused
contacted the complainant and Thiru. Sathish
over phone through several cell phone numbers
and threatened them with dire consequences if
they go to the police. Hence, the families of the
complainant and Thiru. Sathish were afraid that
they lives were in danger. Based on the
complaint from Thiru. Prakashraj, a case was
registered. At the time of is arrest in T-3
Korattur P.S. Cr.No.332/2023, the accused
Thiru. Magesh @ Nagercoil Magesh admitted
that he was involved in the above offence along
with his association. This case is under
investigation. He was arrested and remanded
to judicial custody in this case.

3 T-2 Ambattur 147, During the year 2020, the complainant Thiru.
Police Station Cr. 148, Srinivasan sold his plot admeasuring 1025 sq. ft.
No.556/2023 341, at Indira Nagar Service Road, Menambedu, to
294(b), the accused Thiru. Mint Ramesh’s wife Tmt.
324, Lalitha for Rs.18 Lakhs and the accused did not
392, pay the money. When the complainant

in return. But, he did not give another plot and
did not pay the money. Subsequently, on
14.05.2023 at about 1000 hours in the forenoon
while the complainant was standing near

Ramesh, Thiru. Justin and Thiru. Ragul and
others came there,

formed themselves into an unlawful assembly
armed with deadly weapons, wrongfully
restrained the complainant, scolded him in filthy
language, threatened him and assaulted him
with wooden logs and knife indiscriminately
causing grievous injuries over his head and left
hand. When the complainant raised hue and
cry, the nearby public rushed to his rescue.
Noticing them, the above accused threatened
them at the point of deadly weapons with dire
consequences and the accused escped from the
spot. The complainant took treatment in a
private hospital. Since the complainant feared
danger to his life, he did not lodge a complaint
against the above accused. Later, the
complainant came to know through newspapers
that the above accused were arrested. Hence,
based on the complaint from Thiru. Srinivasan
on 05.06.2023, a case was registered. At the
time of his arrest in T-3 Korattur P.S. Cr.
No.332/2023, the accused Thiru. Ramesh @
Mint Ramesh admitted that he was involved in
the above offence along with his associates.
This case is under investigation. He was
formally arrested and remanded to judicial
custody under P.T. Warrant in this case.

4 T-1 Ambattur 147, The complainant Thiru. Balu’s friend Thiru.


Police Station Cr. 148, Anantharaman entered into an agreement with
No.557/2023 341, Thiru. Mohan to sell his land admeasuring 4062
294(b), sq. ft. at Balaji Nagar East, Kallikuppam. At that
324, time, the complainant approached Thiru. Mohan
307, to buy and sell the above land. After some
420, days, Thiru. Mohan went to prison in a case. At
506(ii) that time, the accused Thiru. Kutty approached
IPC the complainant and assured that the rowdy
accused Thiru. Mint Ramesh would get him the
above property for which the complainant and
Thiru. Siva paid Rs.45 Lakhs in several
instalments to the accused Thiru. Kutty and

the above property and they did not pay the
above Rs.45 Lakhs to Thiru. Anantharaman.
When the complainant

demanded his money back, on 02.05.2023 at
about 1100 hours beneath the Kallikuppam
flyover, the rowdy accused Thiru. Mint Ramesh,
Thiru. Kutty, Thiru. Nagarcoil Magesh, Thiru.
Justin & Thiru. Ragul who came in a Innova
Crysta vehicle bearing Reg.No.TN-13-AA-9
formed themselves into an unlawful assembly
armed with deadly weapons wrongfully
restrained the complainant scolded him in a
filthy language, threatened him and assaulted
him with wooden logs and knife indiscriminately
causing grievous injuries over his left shoulder,
left forearm and head. When the complainant
raised hue and cry, the nearby public rushed to
his rescue. Noticing them, the above accused
threatened them at the point of deadly weapons
with dire consequences and the accused
escaped from the spot. The complainant took
treatment in a private hospital. Since the
complainant feared danger to his life, he did not
lodge a complaint against the above accused.
Later, the complainant came to know through
newspapers that the above accused were
arrested. Hence, based on the complaint from
Thiru. Balu on 05.06.2023, a case was
registered. At the time of his arrest in T-3
Korattur P.S.Cr.No.332/2023, the accused Thiru.
Ramesh @ Mint Ramesh admitted that he was
involved in the above offence along with his
association. This case is under investigation. He
was formally arrested and remanded to judicial
custody under P.T. Warrant in this case.

2. A Detention Order under Section 3(1) of the Tamil Nadu Prevention


of Dangerous Activities of Bootleggers, Cyber Law Offenders, Drug Offenders,
Forest Offenders, Goondas, Immoral Traffic Offenders, Sand Offenders, Sexual

Offenders, slum Grabbers and Video Pirates Act, 1982 (Tamil Nadu Act 14 of
1982 has been made against Thiru. Ramesh @ Mint Ramesh vide Order No.
143 /2023 dated : 09-06-2023.

3. The ground on which the said detention has been made is as


follows:-

The Complainant Tmt. Narayani, D/o. Mariyappan, is residing at No.101,


9th Street, Villivakkam, Chennai – 49. The Complainant Tmt. Narayani’s mother
Tmt. Kumudha had expired. The complainant and her sister were spinsters and
were residing along with their grandmother Tmt. Kamalammal. During the year
2020, the complainant’s grandmother gave her 78 cents land at Korattur Village
to the complainant and her elder step mother Tmt. Maheswari by way of
Settlement Deed considering their future. At this stage, the complainant had
decided to sell the above land and she had approached his friend Thiru. Sathish
regarding the same. Hence, Thiru. Sathish approached his friend Thiru.
Prakashraj to assist them to sell the above property. At this stage, while Thiru.
Prakashraj was discussing with his senior advocate regarding the above property,
Thiru. Mohamed Hanifa offer to buy the same. Hence, through Thiru. Mohamed
Hanifa, his relatives Thiru. Gowthamaraj and Thiru. Rahman agreed to buy the
above property for Rs.4.2 Crores and they have paid totally Rs.8 Lakhs as
advance amount and they have registered a General Power of Attorney for the
above property on 14.02.2020. Since they have not paid the remaining amount,
the complainant contacted Thiru. Mohamed Hanifa regarding the same and he
did not give proper reply for several days. Hence, the complainant after giving
information to Thiru. Mohamed Hanifa cancelled the above General Power of
Attorney on 30.06.2021. Later, the complainant had fixed a rate of Rs.5.6
Crores to Tmt. Bhanu, through Thiru. Mohan and gave a General Power of

Attorney to her. Later. Thiru. Mohan sent to prison due to his circumstances. At
this stage, Thiru. Mohamed Hanifa, Thiru. Gowthamaraj and Thiru. Rahman were
threatening the complainant and were attempted to grab the complainant’s
property. Hence, the complainant’s friend Thiru. Sathish and his friend Thiru.
Prakashraj have approached the accused Thiru. Ramesh @ Mint Ramesh and
Thiru. Magesh @ Nagercoil Ramesh to settle the above matter. Both the above
accused told Thiru. Prakashraj that they would settle the matter amicably for
which they should pay the commission after giving the amount to the owner of
the property. Later, all of them removed the locks which were put by Thiru.
Mohamed Hanifa and replaced the same with their own locks. After some days,
the complainant got introduced to Thiru. Bright through Thiru. Prakashraj. Thiru.
Bright assured them that he would sell the property and he fixed the rate for the
above property with his Church Pastor and the sale deed was registered on
06.04.2023 at the Office of the Sub Registrar. But, due to some reasons the
above Sale deed was kept pending. Later, they have received the above Sale
Deed on 10.04.2023 and while they were proceeding to handing over the above
Sale deed and collect the money from the Church Pastor, the accused Thiru.
Ramesh @ Mint Ramesh and Thiru. Magesh @ Nagercoil Ramesh threatened
them to come and pay the money there. When they told them not to create
problem there, the accused left the spot. Later, the complainant received Rs.45
Lakhs on 10.04.2023 at about 1600 hours and reached her spot near
Thathankuppam fish market at about 1630 hours. At that time, Tmt.
Annapoorani, Tmt. Maheswari and her lawyers Thiru. Sathish and Thiru. Prakash
were present there along with the complainant. The accused Thiru. Ramesh @
Mint Ramesh and Thiru. Magesh @ Nagercoil Ramesh who came to know about
the presence of the complainant at the above spot and came there in a car along
with their associates armed with deadly weapons. Noticing the above gang, the

complainant was frightened. At that time, the accused Thiru. Ramesh @ Mint
Ramesh scolded the complainant in filthy language and threatened her by
uttering, “Xj;jh njtoah Kz;l vdJ g’;if gpupj;J bfhLf;fhky; up$p!;l;nu&d; Koj;J tpl;L
bkhj;j gzj;ija[k; xj;JD nghyhD ghf;fupah. vd;Dila g’;F v’;nf” . At that time, the
accused Thiru. Magesh @ Nagercoil Magesh threatened her by uttering, “Xj;jh
njtoah Kz;l nfl;lh bfhLf;f khl;oah” and attempted to snatch away the complainant’s

bag from her. When the complainant refused to give the bag, the accused
pushed her down. At the same time, the rowdy accused Thiru. Ramesh @ Mint
Ramesh took away the bag containing cash. When the complainant, Tmt.
Annapoorani, Tmt. Maheswari and others raised hue and cry, the accused Thiru.
Ramesh @ Mint Ramesh and Thiru. Magesh @ Nagercoil Magesh threatened the
complainant by uttering, “Xj;jh njtoah Kz;l vd;d ahUd;D bjupahjh. eh’;f ,uz;L ngUk;
ut[o gr’;f/ v’;f nky vt;tst[ nfR ,Uf;F bjupa[kh. vd; ngu brhd;dh jkpH;ehl;oYs;s vy;y ut[o
gr’;fisa[k; bjupa[k;/ c’;fs nghl;Lj; js;spl;L ,e;j ,lj;ija[k; ehnd vLj;Jg;ngd;” Since there

was Rs.45 Lakhs cash in the above bag, the complainant told the accused that
she would pay their fair share. But, the accused Thiru. Ramesh @ Mint Ramesh
and Thiru. Magesh @ Nagercoil Magesh did not mind her words and the accused
and their associates threatened the complainant by uttering, “nghyPRf;nfh ntW
v’;fhtJ nghdp’;fdh c’;fisa[k;. c’;fs; FLk;gj;ija[k; fhyp gz;zpLntd; “ and the accused left

the spot along with the above cash bag. Based on the complaint from Tmt.
Narayani in this regard, the Inspector of Police has registered a case in T-3
Korattur Police Station Crime No.332/2023 u/s 294(b), 341, 506(ii), 392 r/w 397
IPC and taken up for investigation.

The Inspector of Police enquired complainant Tmt. Narayani and recorded


her statement. Then, the Inspector of Police rushed to the spot, prepared rough

sketch and observation mahazar in the presence of witnesses, examined the


witnesses and recorded their statements.

After due investigation, the Inspector of Police has arrested the accused
Thiru. Ramesh @ Mint Ramesh on 30.05.2023 at about 0430 hours in the early
morning at No.129/130, 11th Block, Mogappair East and enquired. On enquiry,
the accused Thiru. Ramesh @ Mint Ramesh admitted that he was involved in the
above said offence apart from involving in Cr.Nos.528/2023, 556/2023 and
557/2023 and T-3 Korattur P.S. Cr. No.366/2023. The confessional statement of
the accused was recorded in the presence of the witnesses. Based on the
confession statement of the accused, the Inspector of Police seized an Innova
Crysta car bearing Reg. No.TN-13-AA-9 from the above spot concerned in T-3
Korattur P.S. Cr. No.332/2023 from the accused Thiru. Ramesh @ Mint Ramesh
on 30.05.2023 at 0615 hours under cover the of mahazar in the presence of the
witnesses.

Based on the confession statement of the accused Thiru. Ramesh @ Mint


Ramesh, the Inspector of Police has arrested the accused Thiru. Magesh @
Nagarcoil Magesh on 30.05.2023 at about 1400 hours near Thirumangalam
Signal and enquired. On enquiry, the accused Thiru. Magesh @ Nagarcoil
Magesh admitted that he was involved in the above said offence apart from
involving in Cr. Nos.528/2023, 556/2023 and 557/2023 and T-3 Korattur P.S.
Cr.No.366/2023. The confessional statement of the accused was recorded in the
presence of the witnesses. Based on the confession statement of the accused,
the Inspector of Police seized cash Rs.3 Lakhs on 30.05.2023 at 1515 hours and
a knife on 30.05.2023 at 1525 hours concerned in T-3 Korattur P.S. Cr.

No.332/2023 from the accused Thiru. Magesh @ Nagercoil Magesh at the above
spot under the cover of mahazars in the presence of the witnesses.

Further, the arrest intimation of the accused Thiru. Ramesh @ Mint


Ramesh was given to his wife Tmt. Lalitha on the same day. Later, the
Inspector of Police produced accused Thiru. Ramesh @ Mint Ramesh and Thiru.
Magesh @ Nagercoil Magesh before the Court of Judicial Magistrate, Ambattur,
Chennai, on 30.05.2023 who ordered the accused to be remanded till
13.06.20203 and lodged them at Central Prison, Puzhal, Chennai, as remand
prisoners. The investigation of the case is not yet over. The offences under
Sections 294(b), 341, 392, 297 and 506(ii) IPC relate to scolding in filthy
language, wrongful restraint, committing robbery and criminal intimidation as
such punishable under chapters XIV, XVI and XXII of the Code. Hence, I am
satisfied that Thiru. Ramesh @ Mint Ramesh who is committing crimes has
already come to adverse notice in four cases and in the ground case he has
acted in a manner prejudicial to the maintenance of public order and as such he
is a Goonda as contemplated under Section 2(f) of the Tamil Nadu Act 14 of
1982. By committing the above described grave crime, in the public, in a busy
road cum residential and business area, in the busy evening time, he has created
alarm and a feeling of insecurity in the minds of the people of the area and
thereby acted in a manner prejudicial to the maintenance of public order.

4. I am aware that Thiru. Ramesh @ Mint Ramesh is in remand in T-1


Ambattur Police Station Cr. Nos.528/2023, 556/2023 and 557/2023 and T-3
Korattur Police Station Crime Nos.332/2023 and 366/2023. He has moved a bail
applications for T-1 Ambattur Police Station Cr. No.528/2023 and T-3 Korattur
Police Station Crime No.366/2023 before the Court of Judicial Magistrate,

Ambattur, Chennai, in Crl. M.P. Nos.2110/2023 and 3038/2023 and the same are
pending. He has moved a bail application for T-3 Korattur Police Station Crime
No.332/2023 before the Court of Principal District Sessions Judge, Thiruvallur, in
Crl. M.P. No.2307/2022 and the same is pending. He has not moved any bail
applications for T-1 Ambattur Police Station Crime Nos.556/2023 and 557/2023.
The sponsoring authority has stated that it is learnt that the relatives of Thiru.
Ramesh @ Mint Ramesh are taking action to take him out on bair in T-1
Ambattur Police Station Crime Nos.556/2023 and 557/2023 by filing bail
application before the appropriate court. In a similar case registered at under
Section 294(b), 341, 323, 397, 336, 427 and 506(ii) IPC, in J-4 Kotturpuram
Police Station Crime No.43/2018, the bail was granted by the Court of Principal
Session Judge at Chennai in Crl. M.P. No.1759/2018. Hence, I infer that is very
likely of his coming out on bail in T-1 Ambattur Police Station Cr. No.528/2023
and T-3 Korattur Police Station Cr. Nos.332/2023 and 366/2023 and there is real
possibility of his coming out on bail in T-1 Ambattur Police Station Crime
Nos.556/2023 and 557/2023, since in similar case bail is granted by the court
after a lapse of time. If he comes out on bail, he will indulge in further activities,
which will be prejudicial to the maintenance of public order. Further the
recourse to normal criminal law would not have the desired effect of effectively
preventing him from indulging in such activities, which are prejudicial to the
maintenance of public order. On the materials placed before me, I am fully
satisfied that the said Thiru. Ramesh @ Mint Ramesh is also a Goonda and that
there is a compelling necessity to detain him in order to prevent him from
indulging in such further activities in future which are prejudicial to the
maintenance of public order under the provisions of the Tamil Nadu Act 14 of
1982.

5. Thiru. Ramesh @ Mint Ramesh is informed that this detention order


shall not remain in force for more than 12 days after making thereof unless in
the meantime it has been approved by the State Government. Thiru. Ramesh @
Mint Ramesh is also informed that he has a right to make representation in
writing against the said detention order to the detaining authority and if any such
representation is received by the detaining authority before the approval, the
said representation will be duly considered by the detaining authority. If Thiru.
Ramesh @ Mint Ramesh wishes to make any written representation to the
detaining authority, he should address it to

The envelope/cover may be marked as Confidential/representation under Tamil


Nadu Act 14/1982 (Goondas Act) and forward it through the Superintendent of
Prison in which he is confined as expeditiously as possible. If any representation
is received by me before the date of approval, the same will be duly considered.
He is informed that he has further right to send representations to the State
Government and Advisory Board. If he wishes to make such written
representation to the Government, he should address it to the Additional Chief
Secretary to Government, Home, Prohibition and Excise Department, Secretariat,
Chennai – 600 009 and forward it through the Superintendent of Prison in which
he is confined as expeditiously as possible. If he wishes to make any written
representation to the Advisory Board, he should address it to the Chairman,
Advisory Board, No.32, Rajaji Salai, Singaravelar Maaligai, Ground Floor,

(Backside entrance), Chennai Collectorate, Chennai – 600 001 and forward it


through the Superintendent of Prison, in which he is confined as expeditiously as
possible. Any representation that is made by him will be duly considered by the
Government and will also be placed before the Advisory Board for consideration
of his case and representations under Section 10 of the Tamil Nadu Prevention of
Dangerous Activities of Bootleggers, Cyber Law Offenders, Drug Offenders,
Forest Offenders, Goondas, Immoral Traffic Offenders, Sand Offenders, Sexual
Offenders, Slum Grabbers and Video Pirate Act, 1982 (Tamil Nadu Act 14 of
1982). He is informed that he is entitled to be heard in person by the Board. He
is requested to intimate to the Additional Chief Secretary to Government, Home,
Prohibition and Excise Department, Secretariat, Chennai – 600 009, specifically in
writing as expeditiously as possible whether or not he desires to be heard in
person by the Board.

6. He is also informed that he is permitted to have the assistance of a


friend / relative if he so desires at the time of personal hearing by the Advisory
Board, provided that his friend/relative is not an Advocate and that he has to
make his own arrangements to get the said friend/relative to be present at the
time of personal hearing by the Advisory Board.
