I. COURSE DESCRIPTION:
This is a four-unit course which aims to study the laws on Wills and Succession, as
contained in the New Civil Code of the Philippines. The entire course includes Article 744 until
Article 1105 of the New Civil Code and includes the following topics: General Provisions,
Testamentary Succession, Wills, Revocation of Wills and Testamentary Dispositions, Allowance
and Disallowance of Wills, Institution of Heirs, Substitution of Heirs, Conditional Testamentary
Dispositions and Testamentary Dispositions With a Term, Legitimes, Disinheritance, Legacies
and Devises, Legal or Intestate Succession, Provisions Common to Testate and Intestate
Successions, Acceptance and Repudiation of the Inheritance. The course also takes up rules of
procedure on the settlement, Partition and Distribution of the Estate of deceased persons.
Students shall be expected to know the legal principles behind Wills and Succession, its
history, theory and context of inheritance in modern family property law. They will be able to
gain knowledge about both testamentary and intestate succession, including institution of heirs,
legitimes, disinheritance, and other topics. Students shall be able to learn the general nature and
characteristics of wills, capacity to make wills, the formalities required by the law for its validity
as well as the effect of undue influence, suspicious circumstances, fraud and mistake in will-
making. They will likewise learn how to calculate legitime, distribute the estate among the heirs
and properly analyze problems and how to solve them, based on the basic principles of
succession.
The course outline shall be discussed based on the codal provisions. At the same time,
students shall be required to recite what they have learned from the law and jurisprudence. This
way, they will have the opportunity to properly analyze the law and apply them, think critically
depending on the problems and cases provided to them.

The course content shall both be taught synchronously and asynchronously, using Zoom
for live classes and Google Classroom as the learning management system.

FINAL EXAMINATION
Poor (1-4) – Evidence of some preparation but no or very little contribution to small
group or larger class discussion; poor quality of contribution displaying little
understanding of the issues and demonstrating poor oral communication and legal skills.

II. Every student is expected to read all assigned codal articles, special laws, and cases as
provided in the Course Outline.
III. Read the assigned cases in their full text. Relying on case digests is highly
discouraged.
IV. Recitation is conducted and graded every session. Coaching is strictly prohibited.
V. Students are required to take the prelim, mid-term and final examinations as
scheduled. Failure to take an examination without valid cause shall result to a failing
grade for that particular examination. Special examinations are only granted in cases
of extreme danger of death or disability.
VI. Any form of cheating shall result in a failing grade in the subject. Other forms of
misdemeanor shall be punished severely.
VII. Attendance may not be checked always. However, when a student is called for
recitation and he is absent, a grade of zero (0) will automatically be given for
recitation.
VIII. Examination may be conducted via ulearning or google forms.
