1. Learned advocate Mr. Dipak R. Dave states that he has

an instructions to appear for the respondent No.1. He is permitted

to file his appearance. Rest of the respondents are served.

2. This is an application for condonation of delay of 149

days in filing appeal. Heard learned counsel for the parties.

2. Considering the contents of the application, it cannot

be said that the delay caused in filing the appeal has remained

totally unexplained. Therefore, we are of the view that the delay
