As per the witnesses and proof would like to highlight the facts that make the
intention of the accused be proved of commiting the riot:
Whatsapp chats: As per Exhibit-VII a group existed before the enactment of the
Kosovo Border Act as the date mentioned is Friday, 20th October
The same chats are stating that DW-2 himself is stating that there were some
elements in a state of mind do an unlawful act
On the day of rally:
Childrens of minority community were vacated from the schools
Police personnels were attacked and there was use of unlawful objects
As per the invesatgation report:
There were a lot of groups operating in clandestine the part of this conspiracy
As per the list of above mentioned, when the accused joined hands with
clandestine associations followed by been warned by the fellow core committee
member they executed the rally as they had an intent and if not, they were aware
about the circumstances that could take place but they did not stopped hence as
per the Sec 149 of the KPC they are liable for such an offence
