AMENDMENT NO. 1 TOTHE HEAD COACH CONTRACT BETWEEN NORTH DAKOTA STATE UNIVERSITY AND MATTHEW ENTZ This Amendment No. 1 is dated as of June 1, 2020 (“Amendment”) and amends the Head Coach Contract by and between North Dakota State University ("NDSU” or “University”) and Matthew Entz (“Coach”), dated as of January 6, 2019 (the “Agreement”) WHEREAS, NDSU and Coach entered into the Agreement; and WHEREAS, the parties desire to extend the term of the Agreement; NOW THEREFORE, the Agreement is hereby amended as follows: 1, The annual salary identified in Section 2.1 of the Agreement shall be $315,000, effective July 1, 2020. 2. References to “January 15, 2024” in Section 2.3 and Section 2.4 shall be amended to “January 15, 2025.” 3. Section 3.1 of the Agreement shall be amended as follows: The term of this Agreement shall extend to January 15, 2025. 4, Section 3.2 of the Agreement shall be amended to read Extension, If the employment at NDSU of both Dean Bresciani and Matt Larsen end within 12 months of each other and the employment end date of the 2" person is prior to January 15, 2025, then this Agreement shall automatically be extended until January 15, 2026 with no additional action necessary by either party. 5, By signing this Amendment, Coach and NDSU acknowledge that, as of the date of this Amendment, they are not aware of any claims or causes of action, orpotential claims or causes of action, of any type, under any local, state, or federal law(s) arising from Coach's employment with the University. 6. WHEREAS, NDSU and Coach entered into the Agreement; and WHEREAS, the parties desire to amend the terms of the Agreement; NOW THEREFORE, the Agreement is hereby amended as follows: 1. References to “January 15, 2025” in Section 2.3 and Section 2.4 shall be amended to “January 15, 2026.” 2, Section 3.1 of the Agreement shall be amended to read: Coaching Term. Unless otherwise terminated pursuant to the terms and conditions contained in the Agreement, the term of this Agreement shall extend to January 15, 2026, and shall include any subsequent extensions described in section 3 below, and any other extensions entered into by the Parties. The employment granted by this Agreement in no way grants a coach a claim to tenure in employment or any years attributable to tenure. Coach's contracts at NDSU are exempt from NDSU Policy 183, Nonrenewal and Dismissal of Nonclassified, Nonacademic Staff. Because this contract extends beyond the current biennium, it is subject to sufficient legislative appropriations and funding. In the event there is not sufficient legislative appropriations or funding, Coach shall be permitted to terminate this Agreement upon written notice (and without any obligation to pay the University the liquidated damages described below, or any other damages)3. Section 3.2 of the Agreement shall be amended to read: National Championship Game.
