1. Through the instant Petition the Petitioner


[Sana Riasat] seeks direction to the Respondent
Nos. 1 and 2 [Inspector General of Police,
Islamabad and Station House Officer, Police
Station, Kohsar] to trace out the whereabouts of
the detenues/minors [Arshan Ali aged about 2
years and Dilawar Malik aged about 4 months]
and to produce them before the Court. The
Petitioner further seeks handing over of the
detenues/minors to the Petitioner being real
mother.
2. The learned counsel for the Petitioner
submits that by way of the Order dated 8.12.2023
the learned Guardian Judge has simply disposed
of the Petitioner’s petition under Section 491 of
the Criminal Procedure Code, 1898 by observing
that the Respondent No. 3/father [Azhar Hussain]
has not been traced and that the Petitioner may
file a fresh petition as and when she comes to
know about the whereabouts of the Respondent
No. 3.
3. In view of the above, office is directed to
issue notice to the Respondents. The Respondent
Nos. 1 and 2 are directed to ensure production of
the detenues/minors on the next date of hearing.
4. Relist on 12.1.2024
C.M. NO. 1/2023:
Exemption sought for is allowed subject to
all just and legal exceptions from the other side.
