ORIGINATING SUMMON
(Under Article 43(1)(b) & 40, Order 5 and order 40 of the Civil Procedure Rules 2010)
TAKE NOTICE THAT an action has been commenced against you in the High Court of Kenya
in Nairobi by one Mwakazi, claiming the following reliefs:

1) A declaration that the defendants have no right or authority to demolish the Plaintiff’s
houses in the Westlands area of Nairobi.
2) An injunction restraining the Defendants from demolishing the Plaintiffs’ houses.
3) Damages for the anxiety and emotional distress caused to the Plaintiffs’ by the
Defendants’ threats of demolition.
4) Cost of this application be provided for.

YOU ARE HEREBY REQUIRED to appear in the High Court of Kenya in Nairobi within 21
days after the service of this Summon, inclusive of the day of service, to file and serve the
Plaintiffs a defense to the plaintiff’s claims.

If the defendant fails to enter an appearance within the time mentioned above such order may be
made and proceedings taken as the court may think just and expedient.

THIS SUMMONS is supported by the affidavit of Mwakazi and on other grounds to be adduced
at the hearing thereof.
