Who is Consumer?

A consumers is: ( In regards to goods)


(1) Any person who buys any goods for a consideration
(a) which has been paid or promised to be paid, or
(b) partly paid and partly promised to be paid, or
(c) under any system of deferred payment.
A consumer also includes any user of such goods other than the person who
buys goods for consideration paid or promised to pay or under any other
system of deferred payment when such use is made with the approval of
such person, but does not include a person who obtains such goods for
resale or for any commercial purposes
or
(In regards to Services)
(2) It means any person who hires or avails of any services for a
consideration:
CLASSE
(a) which has been paid or promised to be
paid, or
(b) partly paid and partly promised to be paid or
(c) under any system of deferred payment.
A consumer also includes any beneficiary of such services other
than the person who hires or avails of the services for
consideration. When such services are availed of with the approval
of the first mentioned person but does not include a person who
avails of such services for any commercial purpose.

What is CONSUMER PROTECTION?


It means protecting the consumer from unfair and restrictive trade related practices adopted by
the seller of goods and services.
Restrictive trade related practices-? Gas connection restriction until you buy the cooking burner
from the gas connection service provider.
Unfair Trade Practices-? Claimed mileage of Car 25Kmpl but actual mileage received by the
consumer only 15kmpl.

Received President’s Assent on 24th Dec 1986 and Came into force on 15th April 1987

COPRA2019 changed COPRA1986 Wholly.
COPRA 2019 received president’s assent on 9th Aug 2019 and came into force on 20th July and
24th July 2020

1. It covers Ecommerce transactions and Teleshoppingg
2. Jurisdiction of Complaint can be the place where Complainant resides,works or
carries on his/her business.
3. E-filling of complaints is included, Hearing of cases by video conferencing is
made available.
4. District Forum’s Pecuniary Jurisdiction was made upto the 1crore value of
consideration of goods and services
5. State Commission’s Pecuniary Jurisdiction was made from 1crore value upto
10crores of consideration of goods and services
6. National Commission’s Jurisdiction was made for value above 10crore of
consideration of goods and services
7. Under the provisions of the Consumer Protection Act, 2019, a Central Consumer
Protection Authority (CCPA) has been established w.e.f 24.07.2020 to regulate
matters, inter alia, relating to false or misleading advertisements which are
prejudicial to the interests of public and consumers as a class.

(b) Recall the product or withdrawl of services
(c) Can file cases at different forums and commission

services from the seller
9. Mediation centres have be established for dispute resolution with all forums, sso
tht court can refer settlement through mediation
