RESPONDENT’S POSITION PAPER

NOW COME the Respondent, by himself, and unto the Honorable Summary Hearing
Officer, PCPT CENON CARLOS MANGUBA, JR. most respectfully submit this Position
Paper, and states categorically as follows:

STATEMENT OF THE CASE

This is an administrative case for Less Grave Misconduct initiated by the Private
Complainant, the Honorable PCPT ALEX C PEDLING against herein Respondent, Pat Julius
Rapisura Bustique, assigned at Conner Municipal Police Station, Apayao situated in Caglayan,
Conner, Apayao1 for the alleged violation of the NATIONAL POLICE COMMISSION
(NAPOLCOM) Memorandum Circular No. 2016-002, under Part III, Rule 21, Section 2, Letter
B, Number 3 par. “c” which reads, “be drunk and disorderly while on or off duty and in
recognizable police uniforms.”

STATEMENT OF FACTS

The mendacity of the instant complaint is readily noticeable from the complaint as the
same is purely surmises, uncorroborated propositions and conjectures designed purely to divert
from the true facts of the case. Ergo, the instant Complaint must be dismissed in limine as it
seeks a relief not maintainable by law and the entire complaint is founded upon a wrong
premise.

Without prejudiced to the above preliminary objections as to the very maintainability
of the Complaint, Respondent wish to place the correct facts relating to the issue of the
complaint. The truth of the matter is narrated in the following chronology of relevant facts and
events, to wit:

That on July 31, 2023, respondent together with Pat Julius


Bustique (“Pat Bustique” for brevity), Pat Leif Bag-ayan (“Pat
Bag-ayan” for brevity) decided to have a lunch together in our
office kitchen as an advance celebration to the up-coming
marriage and/or wedding of Pat Bustique.

That we had an awesome conversation and laughter’s while


respondent and Pat Bag-ayan were teasing and welcoming Pat
Bustique to a lifetime of commitment of a married life.

That at around 2:00 PM, Darwin James Corpuz Bagyao


(Bagyao), a detainee who was charged then with a crime of
theft, went to the kitchen. That we were surprised and asked
him who let him out since he was detained at that time and he
is not allowed to go out.

That due to our laughter’s and loud voices, PEMS Abad


approach us and told us to minimize the same.

That at around 4:00 p.m., respondent felt sleepy, so, he went


ahead of his two companions, Pat Bag-ayan and Pat Bustique,
who were left in the kitchen and still having a conversation.

That after a little while, respondent heard some sort of


arguments in the kitchen. That respondent went to verify and
while respondent was on his way, he saw PEMS Miguel Abad
(PEMS Abad) walking out from there.

That respondent asked PEMS Abad what’s going on. That there
and then, he was shocked when PEMS Abad punched him three
times in his stomach. That when respondent asked him as to
what was the reason why he punched him, PEMS Abad gave
him no answer at all.

Thereafter, respondent saw Pat Bustique rushing back to the


kitchen and stand in the middle of the respondent and PEMS
Abad to pacify the latter. That since the tension did not subside
from Pat Bustique’s requests for PEMS Abad to desist from what
he was doing, and out of his disappointment, Pat Bustique was
able to punched the kitchen door.

Then, the Complainant came and advice Pat Bustique to went


upstairs to which Pat Bustique oblige voluntarily. Likewise,
respondent saw Pat Bag-ayan enters his room and while he
was there, respondent heard him talking to his wife through his
cellphone. Thereafter, respondent left the kitchen and went to
his room to pacify himself from the tension.

ISSUE/S

The issue presented for resolution before the Honorable Summary Hearing Officer is:

Whether or not, Respondent PCpl Rodolfo Cauilan Malana, Jr.


is administratively liable for Less Grave Misconduct.

DISCUSSIONS / ARGUMENTS

Respondent humbly submits that he should be exonerated from the administrative


charge of Less Grave Misconduct. All the elements of Less Grave Misconduct are wanting in
the case at bar, and has no factual and legal basis. Hence, it cannot be corroborated in all its
material points.

Respondent had perused the Affidavit filed by the Complainant in support of the
administrative charge for Less Grave Misconduct and the respondent categorically denies the
allegations stated therein for being an amalgam of fabrication, prevarication, exaggeration of
twisted stories.

Hence, the instant Complaint must be dismissed from the very outset as it seeks a relief
not founded on facts and law but anchored on an erroneous and fallacious premise.

It is well to point out that the present administrative charge of Less Grave Misconduct
was pursuant to NATIONAL POLICE COMMISSION (NAPOLCOM) Memorandum
Circular No. 2016-002, under Part III, Rule 21, Section 2, Letter B, Number 3 par. “c” which
reads, “be drunk and disorderly while on or off duty and in recognizable police uniforms.”

“Misconduct” generally means wrongful, improper or unlawful conduct motivated by


a premeditated, obstinate or intentional purpose2. It is intentional wrongdoing or deliberate
violation of a rule of law or standard of behavior and to constitute an administrative offense,
the misconduct should relate to or be connected with the performance of the official functions
and duties of a public officer3. It is a transgression of some established and definite rule of
action, more particularly, unlawful behavior or gross negligence by a public officer4.

Further, in Office of the Deputy Ombudsman for Luzon v. Dionisio5, the Court defined
misconduct as "a transgression of some established and definite rule of action, more
particularly, unlawful behavior or gross negligence by the public officer. To warrant dismissal
from the service, the misconduct must be grave, serious, important, weighty, momentous, and
not trifling. The misconduct must imply wrongful intention and not a mere error of judgment
and must also have a direct relation to and be connected with the performance of the public
officer's official duties amounting either to maladministration or willful, intentional neglect, or
failure to discharge the duties of the office. In order to differentiate gross misconduct from
simple misconduct, the elements of corruption, clear intent to violate the law, or flagrant
disregard of established rule, must be manifest in the former."6

Simple misconduct is a transgression of some established rule of action, an unlawful


behavior, or negligence committed by a public officer7. To constitute misconduct, the act or
acts must have a direct relation to, and be connected with, the performance of her official
duties8.

Clearly from the elements presented above, nowhere in the complaint-affidavit reveals
that respondent was motivated by a premeditated, obstinate or deliberate intent of violating the
law, or disregarding any established rule, or that he wrongfully used his position to procure
some benefit for himself or for another person, contrary to duty and the rights of others to
warrant an administrative charge of Less Grave Misconduct. Therefore, respondent in this case
cannot be held liable for Less Grave Misconduct or Simple Misconduct as charge. The
Honorable Supreme Court clearly enunciated in one case as follows:

“Neither can Espina's acts be considered misconduct, grave or


simple. The records are bereft of any proof that Espina was
motivated by a premeditated, obstinate or deliberate intent of
violating the law, or disregarding any established rule, or that
he wrongfully used his position to procure some benefit for
himself or for another person, contrary to duty and the rights
of others9.”

In the case of Jerlinda M. Miranda v. The Civil Service Commission and


the Department of Health10, the Honorable Supreme Court enunciated as follows:

Under the circumstances, we cannot see the element of willful
intent to violate the law or disregard of established rules on
the part of Miranda, that were observed by the DOH and the
CSC. As in fact, we give credence to the performance rating
given to Miranda covering those periods. If the allegations on
her were true, she should not have been given a very
satisfactory rating by her immediate superior during those
periods.

Even assuming ex gratia argumenti that there was a misconduct, like an altercation or
a heated arguments with respondent’s co-police officers, this is not the misconduct
contemplated by the law and the same has no direct relation to, and not connected with, the
performance of our official duties. To reiterate, the misunderstanding which occurred on July
31, 2023 has no direct relation to and be connected with the performance of the public officer's
official duties amounting either to maladministration or willful, intentional neglect, or failure
to discharge the duties of the office.

Under the above-mentioned circumstances, the charged of Less Grave Misconduct has
no leg to stand and must crumble as a sand fortress. Willful intent to violate the law or disregard
of established rules on the part of the respondent that were observed by the Philippine National
Police, which is an element of Less Grave Misconduct, is wanting in the instant case.

Further, credence must be given equally to the performance rating received by the
respondent for the entire duration of his service wherein he was a recipient of numerous medals
and commendations, to wit:

Selling of Dangerous Drugs) and Section 11 (Possession of Dangerous Drugs)
Article II of R.A. 9165 (Comprehensive Dangerous Drugs Act of 2002). The

The Medalya ng Paglilingkod sa Luzon or the Luzon Campaign Medal is


awarded to members of the Philippines National Police for participation in the
campaign criminality or insurgency in Luzon from January 1, 2023 to June 30,
2023.

The Medalya ng Kasanayan or PNP Efficiency Medal is awarded to members


of Philippine National Police for eminently meritorious and invaluable service
to merit recognition by the service as exceptional15.

The Medalya ng Papuri or PNP Commendation Medal is an award given to
members of the PNP for demonstrating exemplary efficiency, devotion, and
loyalty to their duty assignments, and taking part in the PNP's Internal
Cleansing Reward and Punishment System, according to the government
website, the Official Gazette16.

The Medalya ng Paglaban sa Manliligalig or the PNP Anti-Dissidence Medal


is awarded to members of the Philippine National Police for active service for
any period of six (6) months while undertaking an operation, campaign or
movement against the dissidence between January 1991 and a terminal due date
to be designated later.

The Medalya ng Pagtulong sa Nasalanta or the PNP Disaster Relief and


Rehabilitation Medal is awarded to members of the Philippine National Police
for active participation in an undertaking involving rescue/relief and
rehabilitation operations connected with typhoons, floods, earthquakes,
conflagration, and other disasters / calamities for any period during and after
disasters / calamities.

The Medalya ng Kagalingan of the PNP Medal of Merit is awarded to members


of the PNP for a single act of heroism or a series of heroic acts in a duty
responsibility.

The Medalya ng Kadakilaan or the PNP Heroism Medal is awarded to members


of the PNP for heroism not involving actual conflict with an armed enemy.

The Medalya ng Paglilingkod laban sa Kriminalidad or the Anti-Criminality


Campaign Medal, pursuant to NAPOLCOM Resolution No. 2016-249, is
awarded by the PNP to Police Commissioned Officers (PCOs) and Police Non-
Commissioned Officers (PNCOs) of the Philippine National Police who are
assigned in Police Regional Offices (PROs)
Provincial/Districts/Cities/Municipalities/PCPs that registered significant
improvement in the peace and order situation and have contributed to the
successful implementation of Anti-Criminality Campaign for a tleast six (6)
months upon determination and recommendation of the Unit (PRO) Special
Promotion Awards and Decorations Board and approved by the Regional
Director.

It cannot be denied that Respondent’s active participation to the PNP’s program and
perseverance in the performance of his sworn duties, and his wholehearted display of
cooperation in carrying out such an outstanding performance speaks well of his dedication and
commitment to excel which is worthy of emulation and have greatly contributed to the success
of the PNP’s movement against criminality and every nemesis of our society.

Finally, it is noteworthy of emphasis that herein respondent received a “Very
Satisfactory” rating for his Performance Evaluation Rating (Please see Annex “1” and series
– PDS of the respondent), as follows:

In view of the foregoing and in light of the circumstances presented above, respondent
respectfully urge and pray for the indulgence of this Honorable Office, to carry out a more
relaxed and less rigid application/imposition of administrative penalty and resolve to dismiss
the instant complaint for Less Grave Misconduct against the respondent.

PRAYER

WHEREFORE, premises considered, respondent most respectfully prayed unto the


Summary Hearing Officer for that the instant administrative case for Less Grave Misconduct
against him be dismissed.

Other relief, just and equitable, are likewise prayed for.
