Dear Madam,

This refers to your letter requesting for Certified True Copies of CDA
Certificate and List of Officials/Members of Pistton Development Multi-Purpose and
Transport Service Coop.

We are not prepared to grant your request due to the following reasons:

1.) While you posit that the City Prosecutor’s Office is requesting
abovementioned data as supplemental requirements, we cannot rely on this
assertion without any indication of proof. The Data Privacy Act and its
Implementing Rules and Regulations explicitly provide for the particular
exceptions (a to g) to the application of the privacy act. Being that the
requesting authority is a private entity, this Office is not convinced that the
request is ripe for action;

2.) Additionally, the Memorandum from the Executive Secretary of the Office of
the President of the Philippines, dated November 24, 2016 with the subject:
INVENTORY OF EXCEPTIONS TO EXECUTIVE ORDER NO.2, provides for
exceptions to the Right of Access to Information, among others, to wit: (5)
Information, documents or records known by reason of official capacity and
are deemed as confidential, including those submitted …. In relation to the
performance of their function, or to inquiries or investigation conducted by
them in the exercise of their administrative, regulatory or quasi-judicial
powers;

Premises considered, the CDA Regional Extension Office V is clearly barred

from disclosing requested information as it would be a violation of the
abovementioned laws and issuances.

On the basis of the facts presented and on record, we hope to have clarified
the matter. Our position is based upon all of the facts and representations in your
letter, any different facts or representations may result to a different resolution.
