Dear Chief Secretaries,
Please refer to my DO letter af even no, dated 16 April 2021, wherety a supply
plan of medical oxygen, prepared by the Empowered Group (EG)-11, which is mandated
for coordinating medical logistics including oxygen, and required to be followed ty all
States/ UTs and concemed agencies, was shared.
2 Keeping in view the rapid rise in COVID cases and resultant rapid demand for
medical Oxygen, particularly in high-burden States of Maharashtra, Madhya Pradesh,
Gujarat, Delhi, Uttar Pradesh, Chhattlegarh, Karnataka, Kerala, Tamil Nadu, Haryana,
Punjab, Rajasthan, cic, EG-Il has reviewed the supply of oxygen for industrial use in
order to divert the same to meet the rising demand for medical oxygen in the country
and save precious lives.Accordingly, EG II hes recommended to prohibit the supply of
Oxygen for industrial purposes by manufacturers end suppliers forthwith from
22.04.2021 till further orders, with tho exception of nine specified industries, The
recommendation of the EG-II has been accepted by the Government and the said
decision, alongwith the list of nine exempted industries, have been conveyed by
Secretary, Ministry of Health & Family Welfare, vide his DO letter dated 16 April 2021

3. 1, therefore, urge you {0 issue necessary Instructions to all the authorities
concemed in your State to ensure compliance to the decision of EG-U and take
necessary measures to prohibit supply of Oxygen for industrial purposes, except those
exempted nine industries. It will help in augmenting supply for medical oxygen in the
county ard in saving precious lives,

No. GP/15/FDC/102021/SFS-07/2- : Whereas the State Government is satisfied
that the State of Gujarat is threatened with the spread of Covid-19 epidemic,
already declared as pandemic by World Health Organization
Whereas Medical Oxygen Supply is a very crucial to the management of patients
infected with COVID-19. With increasing cases of COVID-19 the consumption of
oxygen is going up exponentially.
Whereas now with Mission Begin again and unlock process the Industries are
also starting up. This may adversely affect the supply of Medical Oxygen to
hospitals. With rising number of cases, it is expected that the need of Medical
Oxygen will increase many folds in coming days in Gujarat.
And whereas lack of Medical oxygen may critically affect the patient
management and also adversely affect the final outcome of the COVID-19 patient.
Hence considering this, Now Government of Gujarat has decided to regularize
the circulation and supply of Oxygen from production units located within State of
Gujarat
Therefore, in exercise of the powers conferred as per enabling provisions of the
above referred Acts, to address the patient management in terms of Oxygen supply
and increasing demand of Medical Oxygen, Oxygen production units in Gujarat are
hereby directed that;
1. They shall ensure that production of Oxygen is uninterrupted and as per their
maximum production capacity.
2. 60% of production to be used only for medical Oxygen and to be supplied to
the hospitals
Production units can divert only up to 40 % of Oxygen to industrial use
Priority shall be given to supply to hospitals vis a vis industries in case need
arises even if the proportion of Medical Oxygen goes beyond 60%Therefore, for implementation of the above provisions, the competent
authority at the state level shail be Commissioner, Health Department and
Commissioner, Food and Drugs Control Administration. At field level Assistant
Commissioners shall be the competent authority,
This notification shall come in to effect immediately and would remain
in operation up to 31/08/2021 of its publication.
