Mr. Roth informed me that his team had discovered an incident of a prohibited person, a collegiate athlete, possibly made several sports wagers. This was the official notification to the Division of the violation as required by gaming regulation. It should be noted ‘that under gaming law (27:608 B.(1)) and gaming regulation (LAC 42:III:1 133) a sports wagering operator shell not take a sports wager from a prohibited player. I began my administrative investigation into a possible violation of Gaming Regulation and leamed the below facis indicating the possibility of criminal activity. On Wednesday, June 7, 2023 the FanDuel Compliance team identified an account opened in Massachusetts by Kayshon Boutte (B/M, DOB 5/7/2002, LA DL / sqgansiag, SSN GGQ8BGB) who was a LSU Football Wide Receiver from 2020 to 2022 and was drafted in 2023 by the New England Patriots. Based on the account and deposit information provided by FanDuel, this account was fimded by Case Number: 23-112149 Warrant Number: LSP-2024-018428 Approved ou; Jan, 18, 2024 at 11:39 ANa Regions Bank Visa card with the last four number of 4052 with a payer name listed as “Tanisha Boutte”. The user name listed for this account was “kayshonboutte?, This account was opened on June 7, 2023 ‘The FanDuel Compliance then identified a second account opened in the name of Kayla Fortenberry (B/F DOB 11/30/2000, GA DL /:Sa88849) opened on April 5, 2022. FanDuel provided the account and deposit information for this account. On January 1, 2023, the “Fortenberry” account began to receive several deposits fiom the same Regions Bank Visa card with the last four numbers of 4052 with a payer name listed as “Tanisha C. Boutte” and “Tanisha Contrelle Boutte”. The username for the account was listed as “KayshonboutteO1”. This account received approximately 287 deposits that were completed and 29 that were either declined or failed between April 6, 2022 and October 15, 2022 from a Regions Bank ‘Visa card with the last four number of 9121. The payer name listed was “Kayshon Boutte”. Kayshon Boutte tured twenty-one on May 7, 2023, therefore making any wager placed by him prior to that date illegal. ‘twas later confirmed through investigative means that Tanisha Contrelle Boutte is Kayshon Boutte birth mother. ‘The “Fortenberry” account made approximately 17 wagers on NCAA Football, which included wagers on LSU Football between the dates of August 28, 2022 to October 9, 2023. These wagers are what tiggered FanDuel to report to the Division. The “Kayshon Boutte” Regions bank card with the last four numbers of 9121 was the only finding method from April 6 2022 through October 15, 2022. FanDuel provided a complete wagering history of the “Fortenberry” account's approximately 8927 ‘wagers starting on April 6, 2022 to May 17, 2023. This included the seventeen wagers on NCAA Football that triggered the uotification to the division, Six of these wagers included LSU Football, two of which directly were affected by Kayshon Boutte. September 4, 2022 Florida State at LSU, Kayshon Boutte anytime touchdown scorer and September 4, 2022 Florida State at LSU, Kayshon Boutte over 82.5 receiving yards. Both wagers were part of an eight-leg parlay wager. The above two wagers were placed via the FanDuel mobile application on September 3, 2022 at 17:06:52 UTC according to the information provided by FanDuel, Every time a player uses a sports wagering application his physical location must be verified in order to comply with federal and state gaming law and regulation. Virtual Private Networks (VPN) ate not allowed and will not allow a player to access the application, GeoComply Solutions Inc. is the geofencing and geolocation provider for FanDuel sportsbook. GeoComply does not have any of the player's personal information and therefore identifies each player by theiz FanDuel account information. GeoComply assigns excl mobile device used to complete a transaction a unique UUID. This number identifies each mobile device without GeoComply having identifying information such as a serial number for any mobile device. The FanDuel account number for the “Fortenberry” account is 20030514. GeoComply provided all of the geolocation data for that account number. According to the information provided FanDuel account number 20030514 recorded a series of six GeoComply transactions on September 3, 2022 beginning at UTC 16:59:37 and ending at UTC 19:51:05 using the Louisiana State University wireless internet, IP address 167.96.110.240. These transactions were geoloctated between Latitude 30.410, Longitude -91.188 and Latitude 30.410 and Longitude -91.189. According to Google maps it places these transaction as taking place at the LSU Football Operations Center. These wagers were placed on an IPhone 13 Pro Max. iOS v15.6.1, UUID WS eeRHBIQS-E75E-48B3-89B6-5246060CE 704, (Case Number: 23-112149 Warrant Nummber: LSP-2024-018428 Approved on: Jan, 18,2024 at 11:39 AMIt should be noted that on September 28, 2023 I was granted a cowt order for alist of personnel (Players, Coaches, Trainers and Student Workers) that has access to the LSU Football operations center during the 2022 -2023 football season. At the time the wagers were placed, Saturday, September 3, 2022, the building is not accessible to the public. A dining area is open to the public between L1 am to2 pm on ‘Weekdays. According to the list provided by Louisiana State University, Kayla Fortenbemry did not have access to the LSU Football Operations Center sensitive access controlled areas during the 2022 ~ 2023 football season, Kayshon Boutte as an active player was the only person who made deposits to the “Fostenberry” account that would have had access to the LSU Football Operations Center on Saturday, September 3, 2022, one day before the game between Louisiana State University and Florida State University that took place in the Caesar's Superdome in New Orleans. The same IPhone 13 Pro Max, with the same account and UUD numbers also completed epprocimately 1,484 GeoComply transactions using Cox Communications witeless intemetIP address 68,11.246,140 from March 16, 2023 to May 9, 2023. All of these transactions took place at GPS coordinates Latitude 30.327, Longitude -91.125 (approximately 97648 Knoll Place Baton Rouge, LA 70810 according to Google Maps) in East Baton Rouge Parish. Ou November 9, 2023, a court order was granted and sent to Cox Communications requesting the Cox Communication subscriber and or user information for IP address 68.11.246.140 between the dates of March 16, 2023 and May 9, 2023 and all billing information for &ggigg Knoll Place, Baton Rouge, LA. 70810 between the dates of March 16, 2023 to Present. Cox Communications repliéd on November 28, 2023. It show that from March 2, 2023 to June 14, 2023 Kayshon Boutte was listed as the subscriber for IP address 68.11.246,140. It also lists Mr. Boutte’s address as ¥s@@akgKnoll Place, Baton Rouge, LA 70810, and his phone number as (225)933- gpg (the same phone number used to sign up for the FanDuel account). On November 7, 2023, a court order was issued to AT&T requesting all AT&T customer / subscriber information between the dates of January 1, 2022 and September 30, 2023 for phone number (225) 933- ID On November 18, 2023, AT&T responded. In their report it shows that from January 23, 2021 to May 31, 2023, Kayshon Boutte was the subscriber and financial responsible person assigned to phone nuunber So 933-8720. It should also be noted that the two emails listed on the account are UT T6@LSU.EDU and K AYLAFORTENBERIM @)WBGS COM. Information provided by FanDuel Sportsbook shows that in 2022, $100,939.00 was deposited in to the “Fortenberry” #20030514 account. In 2022, $450,969.44 was wagered from that account, with $385,597.71 won. The total number of bets from the “Fortenberry” was 1,520, The total amount of money withdrawn fiom the “Fortenberry” account was $35,235.80. The account balance at the end of 2022 was $331.47. FanDuel Sportsbook shows that in 2023 $31,208.53 was deposited in to the “Fortenbeny” account. $186,568.64 was wagered from that account, with $170,675.87 won. The total number of bets from the “Fortenberry” was 1,459. The total amount of money withdrawn from the “Fortenbenry” account was $15,046.56. The account balance at the end of 2023 was $0.67, Based on the above facts and circumstances it is this affiant’s firm belief that Kayshon Einbrick Boutte (B/M, DOB 5/7/2002, LA DL / SiGGNQ2, SSN 6049056329) used FanDuel account number 20030514 ortenberry Account) to actively place wagers from April 6, 2022 to May 30, 2023, from his mobile Case Number: 23-112149 Warrant Number: LSP-2024-018428 Approved on: Jn, 18, 2024 at 1139 AMphone using Kayla Fortenberry's personal information.
