1.1. The purpose of this rule is to regulate relations connected to commissioning building
facilities built in the territory of Mongolia in accordance with the Law on Construction.
1.2. This rule and Article 48 of the Law on Construction shall be followed when organizing
commissioning activities of building facilities.
1.3. This rule does not apply to the commissioning of building facilities specified in Article
10.1.1 of the Law on Construction, and this rule can be followed as a standard if the Client of
construction activities (hereinafter referred to as "Client") deems it necessary.
2.1. The Client shall make inspection in accordance with Article 48.5.3, and 48.5.4 of the Law
on Construction before its submit request for commissioning building facilities, and shall take
corrective measures to eliminate violations specified on the conclusion.
2.2. Depending on the type of complexity of the building facilities, the request for
commissioning building shall be submitted to the following organization:
2.2.1. Requests for commissioning of building facilities specified in Section 32.1.5 of the Law on
Construction shall be submitted to the state central administrative body in charge of construction;
2.2.2. Requests for the commissioning of building facilities other than those specified in Section
2.2.1 of this rule shall be submitted to the governor of the province and capital.
2.3. The documents specified in Article 48.5 of the Law on Construction shall be prepared and
attached to the request for commissioning the building facilities.
3.1. Requests for commissioning of building facilities shall be resolved by the organization
specified in Article 2.2 of this rule.
3.2. State central administrative body in charge of construction affairs shall resolve requests for
commissioning building facilities specified in Article 10.1.5 of the Law on Construction based

on the request by governor of province and capital city in accordance with Article 10.1.2 of the
General Administrative Law.
4.1. The organization specified in Article 2.2 of this rule shall review the documents specified in
Article 48.5 of the Construction Law, and shall establish a commission, if the legal requirements
are complied upon, depending on the complexity category of the building.
4.2. The commission shall be established by the governor of the respective province or capital
city or the state central administrative body in charge of construction with the following
structure:
4.2.1. The commission for commissioning building facilities (build new, expand, upgrade)
belongs to the complexity category specified in Article 10.1.2, 10.1.3, 10.1.4, and 10.1.5 of the
Law on Construction shall have a structure as specified in clause 1 of the Appendix No.1 of this
rule;
4.2.2. The commission for commissioning outdoor landscaping of the building facilities shall
have a structure as specified in clause 2 of the Appendix No.1 of this rule;
4.2.3. The commission for commissioning building facilities specified in Article 32.1.5 of the
Law on Construction at the decision specified in Article 3.2 of this rule shall have a structure as
specified in clause 3 of the Appendix No.1 of this rule;
4.2.4. State central administrative body in charge of construction affairs or state central
administrative body in charge of related affairs shall establish a technical commission with
following structure before it commences commissioning activities on building facilities specified
in Article 32.1.5 of the Law on Construction at the decision specified in Article 3.2 of this rule;
4.2.5. Technical commission to work on building facilities specified in Article 32.1.5 of the
Law on Construction shall have a structure as specified in clause 4 of the Appendix No.1 of this
rule;
4.2.6. Technical commission to work on building facilities, that was established at the
decision as specified in Article 3.2 of this rule, shall have a structure as specified in clause 5 of
the Appendix No.1 of this rule.
5.1.1. to conclude whether construction operation principles specified in Article 11 of the Law
on Construction are followed;

5.1.2. to conclude whether requirements specified in Article 14.1, and 14.2 of the Law on
Construction are complied upon;
5.1.3. to conclude whether construction activities are performed in compliance with technical
specifications and requirements specified in its design drawings, project, norms and normative
documents;
5.1.4. to conclude and inspect based on documents specified in Article 40.1.11, and 40.1.12 of
the Law on Construction, conclusion of the laboratory tests, and verification of the Client;
5.1.5. to carry out inspection on the status of testing, adjustment, and improvement on lifting
equipments installed on the building facilities, technological procedures, engineering lines and
networks, and to conclude whether or not to use;
5.1.6. to conclude whether corrective measures have been taken against violations and failures
detected by the state technical supervision organization during the process of the construction
activities;
5.1.7. to conclude whether corrective measures have been taken against violations and failures in
the event that technical commission worked as specified in Article 6.1. of this rule, and to inspect
performance of duties and responsibilities of the commission members.
5.2. The commission may require additional documents as specified in Appendix No.5 of this
rule in relation with normal operation of the building facilities if required.
6.1. The technical commission, which is responsible for providing preliminary conclusion and
support for the commissioning of building facilities specified in Article 32.1.5 of the Law on
Construction and the decision specified in Article 3.2 of this rule, shall exercise following duties
and responsbilities:
6.1.1. to conclude status of testing, improvements and adjustments made on the engineering
supply lines and networks required for normal operation of the building facilities;
6.1.2. to conclude reliability of origin of the engineering supply, its subsidiary network, and
auxiliary buildings;
6.2. Technical commission shall carry out the activities specified in Article 5.1 and 5.2 of this
rule when exercising inspection and making conclusions in accordance with its duties and
responsibilites.

7.1. Commission for commissioning building facilities into operation (hereinafter referred to as
"Commission") shall discuss and make conclusions by meeting.
7.2. Before draw conclusion, the commission will carry out inspections on the building facilities
and if any failures are detected, the commission will give tasks to client and contractor to
eliminate them.
7.3. The secretary of the commission shall be responsible for the preparation of the commission's
meeting, the attendance of the members, the organization of the meeting, the verification of the
minutes of the meeting and its conclusions, review the documents specified in Article 48.5 of the
Construction Law, and, if the requirements are complied, distribute notifications to members of
the commission to let the commission start working.
7.4. Meeting of the commission shall be held with the attendance rate of at least 90 percent of
members. A member, who is unable to attend the commission meeting due to respectful reasons,
shall notify the secretary of the commission one day before the meeting, and that member will
not be able to re-work.
7.5. The activities of the commission shall be organized in the following order:
7.5.1. Before the commission commences work, the secretary of the commission shall present
the decision on the appointment of the members of the commission and the attendance of the
commission and notify the members whether the attendance rate specified in Article 7.3 of this
rule has been satisfied;
7.5.2. The chairman of the commission shall ask the members of the commission to fill
declaration form that declares no conflict of interest, and shall take measures to prevent the
conflict of interest;
7.5.3. The members of the commission shall review the documents and technical status of
building facilities, pay physical visit to the building facilities, and if necessary, demand to see
non-visible works, and obtain additional information from those who involve in the construction
activities;
7.5.4. The members of the commission shall personally read and present their additional
informations, recommendations, opinions on actions necessary to be taken for each issue he/she
in charge of, and shall clearly state their opinion on whether or not the building facility is
acceptable for operation;
7.5.5. The chairman of the commission shall organize the closing of the meeting by giving tasks
with deadline based on the opinion of the majority of the commission members.

7.6. After the work of the commission, the members of the commission shall review the
fulfillment of the recommendations and tasks, and if they are fulfilled, they shall sign the
verification form specified in Appendix No.4 of this rule.
7.7. In the event that the commission has concluded that requirements specified in the technical
inspection report of the Client have not been complied, or detected violations specified in Article
48.7 of the Law on Construction by its meeting, the commission may reject the request of the
Client to accept the building facilities into operation.
8.1. The Client and Contractor shall take corrective measures to eliminate the failures and
violations within 14 working days, enforce the fulfillment of the duties and tasks given by the
commission meeting, and prepare the necessary documents.
8.2. Based on the fulfillment of the duties and tasks of the members of the commission, one of
the following decisions shall be made within the period specified in Article 8.1:
8.2.1. in the event that all members of the commission believe that the building facility
complies the requirements for operation, conclusion to accept the building facilities into
operation in accordance with the form specified in Appendix No.2 of this rule;
8.2.2. in the event that the building facility does not comply with the requirements specified
in Article 5.1, and 6.1 of this rule, and duties and tasks were not fulfilled within the time deadline
specified in Article 8.1 of this rule, conclusion to reject the building facilities into operation.
8.3. The commission shall draw conclusions based on the acts and conclusions made by technical
commission in order to commissioning building facilities specified in Article 32.1.5 of the Law
on Construction at the decision specified in Article 3.2 of this rule.
8.4. In the event that the technical commission concludes to refuse to let the commission start
working on the commissioning of building facilities, or the tasks and duties given by the
technical commission are not fulfilled, the technical commission shall work again.
8.5. In accordance with Article 37.1.20 of the Law on Construction, the Client shall be
responsible for the related costs in regard to commission and technical commission to work again
as specified in Article 8.2.2, and 8.4 of this rule.
8.6. In the event that the chairman of the commission concluded and verified acceptance of
building facility into operation, the governor of the respective province and capital city shall be
notified within 5 working days.
8.7. The governor of the province and capital city shall notify state organization authorized for
construction inspection within 10 working days after the acceptance of the building facilities into
operation.

8.8. The state organization authorized for construction inspection shall take measures to issue
certificate of building facility for operation in accordance with the procedures specified in
Article 49.5 of the Law on Construction.
9.1. The Client shall be responsible for submitting the design drawings and documents of the
commissioned building facilities to the state archive, and submitting the relevant information to
the joint database specified in Article 34.1.7 of the Construction Law.
9.2. The Client shall be responsible for submitting the copies of the conclusions of the
commissions and other necessary informations to the department responsible for construction
and urban development of the province and capital city, in order to make entries into the
cadastral electronic database.
Ten. Other
10.1. The Client may submit a complaint regarding illegal decision of the commission, technical
commission, illegal actions of the members to the authorized official, who established the
commission, or to the relevant law enforcement agency.
10.2. In the event that the commission member gives duties and tasks that do not meet the
requirements of the approved design, relevant laws, regulations, and norms, those commission
members shall be held accountable for themselves.
10.3. It is prohibited to let the commission work in building facilities that have been found to be
in use, and the commission shall commence work only after this issue is solved by the decision
of the court.
10.4. Officials, organizations and individuals who violate the provisions of this rule shall be held
responsible in accordance with the relevant laws.

normal oepration of building facilities.
