### G.R. No.

213582
## Odiamar v. Valencia
######
### Facts:
- Respondent Linda Odiamar Valencia filed a complaint for sum of money and damages
against petitioner Nympha S. Odiamar.
- Respondent alleged that petitioner owed her P2,100,000.00 and issued a check to
guarantee the payment of the debt, but the check was dishonored.
- Petitioner argued that it was her deceased parents who owed respondent money and
that respondent's claim should be filed in the proceedings for the settlement of
their estates.
- Petitioner also claimed that she made installment payments to respondent, but
respondent refused to accept further payments.
### Issue:
- Whether or not petitioner should be held liable to respondent for the entire debt
of P2,100,000.00.
### Ruling:
- The Court affirmed the ruling of the lower courts with modification.
- Petitioner is ordered to pay respondent the amount of P1,010,049.00, which is the
remaining balance of her principal debt to respondent in the original amount of
P1,400,000.00.
### Ratio:
- Petitioner's liability to respondent is well-established as she admitted to
obtaining loans from respondent.
- Petitioner's debt to respondent amounted to only P1,400,000.00 and not
P2,100,000.00.
- Petitioner had already made installment payments totaling P389,951.00, leaving an
unpaid balance of P1,010,049.00.
- The remaining P700,000.00 of the total debt is properly for the account of the
estates of petitioner's deceased parents and should be claimed in the relevant
proceeding.
- Novation by substitution of debtor did not take place as there was no express
release of the estates of petitioner's deceased parents from their obligation.
- There was no written agreement for the payment of interest, therefore no interest
is due.
