IN THE NAME OF ALLAH, THE MOST BENEFICIENT, THE MOST MERCIFUL

All praises and adorations belong Almighty Allah and we bear witness that there is no deity
worthy of worship except Allah (SWT) without associate and we bear witness that Muhammad (SAW)
is his servant and messenger.

Verily, the most truthful speech is the book of Allah (SWT) and the best guidance is the
guidance of Muhammad (SAW) while the worst affairs are novelties, for every novelty is and
innovation, every innovation in matters of religion is misguidance and every misguidance is in the fire.

We appreciate the opportunity given to us by a serious colleague in producing out the bye-law.

We pray to Allah to lead us alright (Amin).


CHAPTER I

GENERAL PROVISION

SECTION 1:

INTRODUCTION

All praises and adorations belong to Almighty Allah, the Lord of the entire universe, and we
bear witness that, there is no deity worthy of worship except Allah alone and prophet Muhammad
(SAW) is the servant and the seal of messengers.

We Muslim Students' Society of Nigeria (MSSN (SPED) branch, are ready to transform our
faith into action and to propagate the religion of Allah (SWT) e (Al-Islam) with total submission and
devotion to the cause of justice, emancipation of all oppressed and victimized Muslims, working for
the unification of Muslims regardless of colour. race, ethnics group or status under the guidance of
Allah (SWT) and his messenger.

With these, we have responded to the call of Allah (SWT) which says, the believers are
nothing else than brothers, so make reconciliation between your brothers: and fear Allah (SWT), that
you may receive mercy. O ye who believe!!! Let no group scoff at another group, it may be that, the
latter are better than the former. Nor let women scoff at other women, it may be that, the latter are
better than the former. Nor defume another, nor insult one another by nicknames, how bad it is to
insult one's brother after having faith, and whosoever does not repent, then such are indeed wrong-
doers.

O you who believe!!! Avoid suspicion as much (as possible): for suspicion in some cases is a
sin, and spy not on each other nor speak ill each other behind their backs. Would any of you like to eat
the flesh of his dead brothers? Nay, ye would abhor it... but fear Allah for Allah oft- returning most
merciful (049 V10-12)

If any provision of this bye-law inconsistent with the provision of the society constitution, the
society constitution shall prevail and the provision herein shall be null and void. In the same vein, if
any provision of the society constitution is inconsistent with the provision of the Qur'an and Sunnah,
the latter shall prevail and the provision shall be null and void, according to the prophet says;
"whosoever established novelties without the prior permission from the Qur'an and Sunnah shall have
it back (Bukhari to him Muslim)
NAME OF THE SOCIETY AND ADDRESS

SECTION 2:

SECRETARIAT AND THE VARIOUS HOSTELS.

The name of the society is Muslim Students' Society of Nigeria, which is referred to as MSSN
SPED Branch under the umbrella area council. The address shall be MSSN SPED Branch, P. M. B
1089, Oyo.

The secretariat shall be, MSSN secretariat building, F. C. E (Sp), Oyo. Motto: there is no deity
worthy worship except Allah, and Muhammad his servant and the seal of messengers.

The names of the various hostels are as follows;

HOSTEL A. IDS Eleekara area Oyo, Oyo State HOSTEL B: Eleekara area Oyo, Oyo State. 2.
HOSTEL C 1: Opp. Afijio Local Government Secretariat, Jobele, Oyo.

HOSTEL C 2: Opp. Afijio Local Government Secretariat, Jobele, Oyo.

MUSLIM EMBASSY: Opp. Police post, koto ogede area, Akinmoorin, Oyo)

SECTION 3: AIMS AND OBJECTIVES

The aims and objectives shall be as contained in the MSSN constitution. These are listed as
follows, To inculcate the habit of serving mankind, especially the disabled members of the society in
our college

To bring Muslim students on campus into closer union and inculcate in them, the true Islamic
spirit of brotherhood and absolute faith in Allah as the only basis for achievement of peace among
mankind.

To establish an Islamic ummah governed by the welfare of the Muslims and safeguard their
interest and rights in any community.

To constitute a strong force for the propagation and strengthening of Islam in sped and the
whole world at large To encourage the study of the holy Qur'an as an Holy Book and the hadith of the
Prophet (SWT) and to use it as a way to achieve peace and harmony on the campus.

SECTION 4: MEMBERSHIP AND REGULATIONS

Subject to the aims and objectives of MSSN being ready to guard and adhere strictly and
honestly to the constitution and the bye-law.

SUB SECTION 4: EXECUTIVES MEMBERS

Membership of the society shall be open to Muslim students in Sped.


Members of Muslim students are all Muslim students on the campus.

ACTIVITIES of the MEMBER

All Muslim students in this citadel of learning are members of MSSN

Muslim students should try as much as possible to participate in any MSSN programmes,
whether in the campus environment or outside the campus environment

Muslim students should try to see one another as one All Muslim students on campus should
campaign against indecent dressings on campus and dress in an accurate ways.

CHAPTER II

EXECUTIVES STRUCTURE

SECTION 1:

SECTION 2: APPOINTMENT OF EXECUTIVES

o Officers shall be chosen by the shuroh committee, which shall be nominated by the executive
and approved by the present Amir at most three weeks or at least two weeks before the
inauguration day.

o The inauguration shall be a session, event that shall take place at the earliest convenient time
after the jihad week programme.

o Shuroh committee shall consist of members that have spent at least 2 academic sessions on
campus and must be active and experienced.

o There must be an immediate orientation for the newly appointed executives which should be
organized by the shuroh committee. Shuroh committee must be dissolved immediately after the
orientation programme for the newly executive members

SECTION 3:

ELIGIBILITY OF MEMBERS FOR OFFICES

The Amir, Gen. Sec., chairman Dawah committee, Fin: Sec Treasurer, Hostel coordinator.
Director of Studies, Liberian, Editor -in Chief, Secretary to Sisters' Circle, Chairman AT- Taqwa
Venture, Director of Handicapped, Visitation Committee. that will be appointed shall be regular of at
least three or four semesters students on the campus.

Any other officers shall be any register member. The officers, especially the Amir should be
well experienced, active and be ready to serve the society.

SECTION 4: TENURE OF OFFICE

Following the tradition of Islam, the Amir, gen. sec. chairman Dawah committee, fin. Séc.,
treasurer, hostel coordinator. director of handicapped, director of studies, Liberian, editorial in chief,
secretary to sisters circle, chairman AT- Taqwa venture, visitation chairman shall stay in the office till
the end of their normal academic programme in the institution, if they are in final level.
All members of the executive shall hold office for a period of academic year but are eligible for
re-appointment on their merit.

SECTION 5: OATH OF OFFICE

This shall be administered on the newly executives by the shuroh committee by reciting both in
Arabic and English "verily those who swear allegiance to you, indeed swear allegiance to Allah, the
hand of Allah is over their hands. So, whoever breaks the oath breaks it to his own loss, and whoever
fulfils the covenant that he made with Allah.. he will surety give him a great reward." (Q48:10).

SECTION 6: FUNCTION OF THE EXECUTIVES

1. THE AMIR

i. Shall be responsible for the running of the society. Shall preside over all the meetings of the
society.

ii. Shall coordinate the activities of the society with the cooperation of other executives.

iii. Shall be the chief spoken man for the society.

iv. Shall seek to interpret the society to the Muslim community and the general public on behalf
of the executive council of the society

v. Shall be in constant touch with other organizations in the areas to which the society is afflicted
to the improvement and expansion of the scope of the society.

vi. Shall have power to query any erring executive and non executive member.

vii. Shall have access to any ad hoc committee that might be set up.

viii. Shall have power to delegate on any of his duties or power to any of the deputy officers and
members of the society as he deems fit and as the need arises.

ix. Shall have the attendance of those who present in the executive meeting both the central
executive and the general executives meetings.

2. NAIBUL AMIR

i. Shall assist the Amir and act in his absence.

ii. Shall have power to assume the post of Amir in case of an unforeseen circumstance.

iii. Shall be coordinator of leadership training programme (LTP).

iv. Shall be the chairman of Dawah committee.


3. DAWAH COMMITTEE

i. Shall be the organizer of all Dawah activities on the campus and outside the campus for the
society.

ii. Shall be the coordinators of all Arabic classes in various hostels

iii. Shall plan the lectures and fix the lecturers for orientation and Jihad week programmes

iv. Shall be the coordinators of all imams in the various hostels.

4. GENERAL SECRETARY

i. Shall be responsible for the running of the society secretariat,

ii. Shall have power to summon general and central executives: meetings of the society as
directed by the Amir.

iii. Shall ensure that the minutes of general meetings are duly prepared and kept.

iv. Shall have power to represent the Amir as the need arise.

v. Shall be a signatory to the society account

vi. Shall carry out other duties assigned to him from time to time.

5. ASSISTANCE GENERAL SECRETARY

i. Shall assist the general secretary and act for him in his absent

ii. Shall be the secretary to the society's executive meetings and prepare the minutes of such
meetings.

iii. Acting on the directive of the general secretary shall take the attendance of those present in the
minute of the meetings.

iv. Shall carry out the duties assigned to him by the executive.

6. PUBLIC RELATION OFFICER

i. Shall be the link between society and the public through the mass media and other avenue

ii. Shall be responsible for collecting and disseminating of information to the members.

iii. Shall have power to set up and coordinate a publicity and mobilization committee.

iv. Shall be responsible for welcoming suggestions from members in suggestion boxes.

v. Shall carry out other duties assigned to him by the society.


7. AMIRAH

i. Shall be directly responsible for the organization of sister's circle.

ii. Shall be the principal liaison between the society and the sister's circle with a view to bringing
out about the effective participation in programmes.

iii. Shall preside over all meetings of the society's sister's circle, sister general meetings and sister's
hostels representative council.

iv. Shall be a member of programme plan committee with a view to including the sisters need into
their programmes.

v. Shall help the Amir in appointing Naqibahs in our various hostels.

vi. Shall reside in the most populous hostel and be the Naqibah of the hostel.

8. NAIBATUL AMIRAH

i. Shall assist the Amirah and act when Amirah is absent.

ii. Shall have power to represent the amirah when the need arises.

iii. Shall be a member of Dawah committee.

9. FINANCIAL SECRETARY

i. Shall have power to collect all subscriptions, donations and special levies:

ii. Shall keep proper record of all financial transactions of the society.

iii. Shall have the power to issue out money as approved by the executives.

iv. Shall be a signatory to the society's account

v. Shall keep proper records of the society's account

vi. All funds generated by the society shall pass through the financial secretary to the treasurer except
rents payments which shall be kept by the hostel coordinator

vii. Shall be updating and announcing the account at every general meeting

10. TREASURER

i. Shall give account when there is a need for it.

ii. Shall be in charge of document relating to the society account.

iii. Shall receive and account for the society money derived from any source.

iv. Shall keep the proper account of the society.


v. Shall release money for the society's expenditure as directed by Amir through the financial
secretary.

vi. Shall update the financial records with the financial secretary.

11. ASSET MAINTENANCE OFFICERS (AMO)

i. Shall keep proper records of all assets of the society.

ii. Shall keep the central executive council informed about the state of the assets.

iii. Shall have the proper records of all lost items and should bring them to the mosque for
identification on every usurah programme or Jumah service.

iv. Shall be responsible for provision of materials needed for worship.

12. DIRECTOR OF STUDIES (DOS)

i. Shall be responsible for organizing academic programmes for the society.

ii. Shall give due information to members on the academic activities on campus

iii. Shall be the custodian of all publications owned by the society

iv. Shall be responsible for newly admitted students, collection of forms and also organize tutorial for
them, before the commencement of the examination.

13. LIBRARIAN

i. Shall see to the up keep of the society's library

ii. Shall ensure that books are available for the members whenever there is a need for it.

14. EDITOR IN CHIEF

i. Shall be the chairman of the editorial board.

ii. Shall be responsible for the editing of articles, journals from the members of the society.

iii. Shall make news and information concerning the Islamic world available to the society.

iv. Shall be responsible for collection of relevant materials for the society publications and notice
boards.

15. SECRETARY TO SISTERS CIRCLE

i. Shall have the status of the general secretary within the sister’s circle.

ii. Shall keep the attendance records of the sisters at any gathering

16. WELFARE DIRECTOR (MALE)


i. Shall be the chairman of the welfare committee.

ii. Shall from time to time meet with the members to know their problems and discuss such problem(s)
at the executive meeting.

iii. Shall have power to respond to the fixing of lectures, exams especially during Jumah service.

iv. Shall see to the academic progress of members in conjunction with the director of studies.

v. Shall keep a personal data record of members and make functional use it.

17. WELFARE DIRECTOR (FEMALE)

i. Shall assist the welfare officer in his duties.

ii. Shall be directly responsible for sisters' welfare.

iii. Shall be a member of welfare committee.

18. HOSTEL COORDINATORS

i. Shall see to the acquisition and maintenance of hostels for member.

ii. Shall be the chairman of accommodation committee.

iii. Shall see to the registration and other responsibilities of hostels.

iv. Shall source for fund through the prospective occupants and keep proper record of account.

v. Shall have power in conjunction with other executives to promulgate code of conduct for each
hostel.

vi. Shall have power to respond to violations such code of conduct.

19. CHAIRMAN OF AT-TAQWA VENTURE.

i. Shall be the chairman of the society venture

ii. Shall have power to establish any form of business under the venture after ratification by the central
executive council.

ii. Shall keep proper record of the society venture.

20. VISITATION CHAIRMAN

i. Shall be the chairman of visitation committee.

ii. Shall ensure that visitation is going on in every hostel.

iii. Shall ensure proper visitation to all Muslim lecturers.

21. DIRECTOR OF HANDICAPS


i. Shall ensure that the disabled are carried along in all that is available

ii. Shall ensure to update them with the necessary information programmes arranged by the society..

iii. Shall consult them for their being.

22. APPEAL FUND CHAIRMAN

i. Shall be able to generate money for the society.

ii. Shall keep proper record for the fund in charge.

iii. Shall pay money to the society's account.

iv. Shall make an annual budget for the society

23. EX-OFFICIO MEMBERS

i. There shall be three ex-officio members who shall be appointed from the immediate past executives
at the discretion of the shuroh.

SECTION 7: BRANCH PROGRAMMES

This branch shall organize the following regular and periodic programmes;

Brothers and sisters' forum.

Visitation.

Al-Usurah

Leadership training programme Sisters' circle

Arabic class

General leadership training programme

Orientation week

Jihad week

Annual conference.

Brothers' and sisters' forum: This shall take place on every Monday at each hostel and be
coordinated by the Dawah committee

Visitation: this shall be holding on every Tuesday of the week and to be coordinated by the visitation
chairman starting from 4:00pm.

Al- usurah: this shall take place midweek (Wednesday) at the college central mosque by 2:00pm-
4:00pm.
Leadership training programme: this shall be held on every Thursday of the week at each discreet
mosque after ishai.

Sisters' circle: this shall be weekly after Jumah service at the college central mosque.

Arabic class: this shall be holding at least three times in a week in various hostels.

General leadership training programme: this comes up once in a month at Akinmoorin central
mosque after ishai

Orientation week: this shall hold for the newly admitted Muslim brothers and sisters in the college.

Annual conference: there shall be annual conference of the branch during which the general
secretary, financial secretary and other necessary reports will be presented and new executives shall be
sworn in

SECTION 8: COLLECTIVE DUTIES OF THE EXECUTIVES

i. The executives branch shall exercise jurisdiction overall matters concerning the society.

ii. The executive branch shall have power to initiate new projects and execute them in a way that does
not contradict to the aims and objectives of the society.

iii. The executives shall have power to negotiate for financial and materials assistance, which shall not
in any way compromise the independent and aspiration of the society.

iv. The society executives shall have to consider all proposals for appeals for financial and material
assistance by any branch. Council and unit.

v. The executives shall have power to consider approval for all proposals submitted to the financial
secretary/ treasurer by any member of the committee or standing committee in the society.

vi. The society executives shall have power to appoint or confirm members for vacant executive posts
or acting committee.

vii. Executives shall ensure that they complement one another's effort.

viii. The executives meeting as well as emergency may be called when necessary.

ix. When the members of the executive present for a meeting are less than 113 every decision of the
day should not be concluded upon until next meeting.

x. Issues discussed at executive meeting shall not be divulged out until executed or disclosed by any
executive.

SECTION 9: IMAMSHIP

i. Every hostel shall have an imam who will be leading salat

ii. There shall be forum of imams.


iii. Imams shall ensure implementation of programme designed by the society

iv. Imams shall report any development to Amir or Naibul Amir.

v. Imams shall be members of Dawah committee.

CHAPTER III

ACTING COMMITTEES

For the effective administration of the society, these committees shall function in the specified area
and they shall give regular reports to the central executives.

LEADERSHIP TRAINING PROGRAMME COMMITTEE: Naibul Amir shall be the chairman.

 Shall plan and execute training programme.

 Amir shall be an automatic member of the committee.

DAWAH COMMITTEE

 The committee shall plan lectures and appoint lecturers for the society's programmes.

 Shall also plan special programmes e.g. orientation week, and seminar.

 Shall produce and make available to members, line up activities for the programmes of the
society. iv.

 Shall organize and monitor functional Arabic classes

 The Amir as the chairman of implementation committee shall appoint members of the
committee for Jihad and orientation week.

EDITORIAL BOARD

 The editor in chief shall be the chairman.

 The committee shall plan the effective use of the editorial board.

 They shall monitor the articles publication and the notice boards of the society and ensure that
Islamic image is adequately protected.

DISCIPLINARY/SHARIAH COMMITTEE

 The committee shall be headed by the qaddi who shall be appointed by incumbent Amir on the
advice of the CEC. He shall stay in office till the end of his programme.

 The committee shall include experienced members who had at least spent four semesters on
campus. it shall be comprised not more than five members (four males and 1 female).
 The committee shall handle the cases of indiscipline on the part of members referred to them
by the CEC.

 It shall have power to summon any member or officer to the shariah court for fair handling of
cases

 It shall try cases involving executives directly and cases involving other members on the
advice of the CEC.

 It shall apply the provision of chapter v, section 1 in giving its judgment.

 It shall follow the principles of the Qur'an & Sunnah in giving its judgment.

 It shall consult elders of the LMC (in particular the college imam) on cases of members before
passing a judgment if the need arises.

SECTION 2: APPOINTMENT OF PATRONS AND TRUSTEES.

 The society has power to appoint patrons and trustees who shall be; Pious, enlightened and
dedicated Muslim.

 Ready to give moral and materials support to the society whenever sought.

FINANCE

SECTION I: SOURCE OF INCOME

The financial secretary shall receive fund from the following source;

 Special or general levies on members.

 Donation.

 Yearly dues from members.

 Fund raising programmes.

 Returns from the committees

 Proceed from business.

EXPENDITURE

SECTION II:

All expenditure shall be well documented and the Amir shall have the knowledge of all
expenditure. General expenses of the society shall be with the knowledge central executive council
(CEC).

SECTION III:
SIGNATORIES

The society money shall be deposited in the bank. Signatories of all cheques or forms and
disbursement of society money shall be by the Amir, general secretary, financial secretary and
treasurer. At least three of the four above are authorized to sign or withdraw from the society's account
Impress account should not exceed #1,000.00.

CHAPTER IV
DECORUM

SECTION 1: DISCIPLINE OF OFFICERS

 The society shall have power to discipline any officer or member that is found guilty of
behaving contrary to lay down rules and regulations.

 The shariah panel recommends punishment for erring members An officer of the society shall
be deemed erring if

 He/she is found writing in the discharge of the function of his/her office.

 He/she acts contrary to the Islamic code of conduct.

 Allegation or complaints may be referred to the shariah panel.

 An officer shall be removed from office for inability to discharge his/her duties or for
misconduct or continuous absence from meeting.

SECTION 2: GENERAL MEETINGS AND CONDUCT AT MEETINGS

 The society shall hold two general programmes weekly except when it coincide with any other
programmes.

 Emergency meeting may be summoned by the Amir or his deputy in collaboration with the
secretary if need be, information for such meetings may be verbal or written.

 Every member should participate actively during meeting

 There shall be weekly society executive meeting and the executives shall decide monthly
society general meetings and the days for such meeting.

 A member shall continue his observation to the subject under discussion and shall not
introduce irrelevant matter therein.

 The use of abusive language or calling of nicknames in the meeting or outside or in the
Islamic gathering are strictly prohibited for all members.

 Any member found guilty shall be reprimanded or rebuked and disciplined.


 At first contribution during meeting a member shall be asked to recite the memory verse for the
week.

 All members present at the meeting shall be in attendance sheet. .

 Any executive that may be absent from the meeting should forward a letter of notification two
days before such a meeting.

CODE OF CONDUCT FOR THE VARIOUS HOSTELS

 The mode of dressing should be islamically upright for both brothers and sisters in and out of
the hostel. This means that nobody should go out from the hostel in an abusive manner and
while in the hostel.

 Any music cassette is not allowed, except Islamic cassette eg. Qur'an, Al Mathuurat, Al-Qunut,
lectures.

 The type of visitor we have will determine where he/she should stay.

 The environment must be clean all the time. Discussion between brothers and sisters after
10:30pm is prohibited.

 Going out or traveling to anywhere till another day is not allowed without informing roommate
or Naqeebat or Imam.

 Fighting is prohibited for both brothers and sisters.

 No sister should walk alone in the bush.

RECOMMENDATIONS

 All incoming executives should be sincere in every under taking

 There should be serious devotion to the coordination and management of hostels.

 Incoming executives should extend their welfares packages to non MSSN hostel and should
make visitation often to student residential areas and hostels.

 Incoming executives should try to embrace love and cooperation among one another and
should try to promote these among members for peace and development.

 Members are encouraged to pay up their house rent promptly

 The incoming executives should work towards establishing guidance and counseling unit for
the society

 Members are advised to be more committed to ensure the stability of the ummah The incoming
executives should see to the accurate production of the AT-Tarsheed magazine. All executives
should refer to the recommendation given by their predecessors for coordinated way forward.
