Appointment of assessors and procedure of referee


1. Appointment and Instructions:
 A Revenue Officer has the authority to appoint a referee in
situations where there's a dispute regarding the division of
produce between a landlord and tenant.
 The Revenue Officer has the discretion to provide instructions to
the referee about various aspects, including:
 Associating other individuals as assessors to assist the
referee.
 Determining the number, qualifications, and selection
criteria for these assessors.
 Establishing the procedure that should be followed during
the division or appraisement process.
2. Referee's Responsibilities:
 The referee, once appointed, is obligated to carry out the division
or appraisement based on the instructions provided by the
Revenue Officer.
3. Notice to Landlord and Tenant:
 Prior to conducting the division or appraisement, the referee is
required to inform both the landlord and the tenant about the
specific time and place where the process will take place.
 If either the landlord or the tenant fails to attend the process in
person or through a representative, the referee is allowed to
proceed with the division or appraisement even in the absence of
that party.
4. Access to Property:
 The referee and any assessors, if appointed, are authorized to
enter onto the relevant land where the produce is located, as well
as into any buildings where the produce is stored.

Procedure after division or appraisement
Recording and Submission of Result: (1) The result of the division or
appraisement shall be recorded and signed by the referee, and the record shall
be submitted to the Revenue-Officer.
Review and Order by Revenue-Officer: (2) The Revenue-Officer shall conside r
the record, and, after such further inquiry, if any, as he may deem necessary,
shall make an order either confirming or varying the division or appraisement.
Costs Determination by Revenue-Officer: (3) The Revenue-Officer shall also
make such order as to the costs of the reference as he thinks fit.
Inclusive Costs and Adjustment: (4) The costs may include the remuneration
of the referee and of the assessors, if any, and may be levied from the
applicant before the appointment of the referee subject to adjustment at the
close of the proceedings.
The purpose of this section is to outline a clear and structured process for
resolving disputes related to the division or appraisement of produce between
a landlord and tenant in the context of an agricultural or land-based rental
agreement
