RE: ELECTION(S) OF SHOP STEWARDS IN COMPLIANCE WITH THE RECOGNITION AGREEMENT//
YOURSELVES,
1. Your attention is drawn the Recognition Agreement (agreement) entered into between SITA
and the PSA dated 15 May 2013, which is a document governing the relationship between
Management and Union.
2. The agreement in question, defines the term bargaining unit as follows:
“means employees in the workplace whose job levels are DS (or equivalent) and
below, excluding managers in the job levels D1 and above” (definition)
“Permanent employees in the job levels Al to D5, excluding managers in job levels
DI and above, will constitute the bargaining unit” (Annexure A)
3. Having pointed out the definition(s) above, read in conjunction with provisions of Section 14
of the Labour Relations Act as well as the total membership that the Union holds at SITA, it
is common cause that, the Union is entitled to elect twelve Union Representatives. That
said, it has however been brought to our attention that, one of the elected Trade Union
Representatives, namely, Mr Paul Montlhabaki (MontIhabaki) holds a position of Technical

Manager, D3, a position which is graded on a managerial level. With this being the case, it
is common cause that, in terms of the definitions pointed out, such a person is excluded
from the definition of a bargaining unit and cannot therefore be allowed to hold office as a
trade union representative.
4, You are therefore informed that, in accordance with clause 6.3 (6.3.1.7) of the agreement,
Montlhabaki in question is deemed to have vacated his elected position as a Trade Union
representative by virtue of his appointment into a Managerial position with immediate
effect. Management therefore urges you to, in terms of the same clause, call by-elections in
to elect a new Union Representative.
5. Lastly, be informed that, any request to perform Union work in by Montlhabaki, will not
be approved by management for reasons explained afore. You are therefore requested
to, within the timelines provided by the agreement and upon finalisation of your by-
elections, inform management accordingly of a newly elected representative in the
instance of Montlhabaaki in question,
