GEM BID NOTICE

E-Tenders are invited from eligible Security agencies having experience of handling the Security
Services work in reputed organizations preferably in Government or Public Sector for at least three years
and providing Certificate of Satisfactory Performance from such clients to be enclosed.

Service Providers have to deposit the Earnest Money Deposit (EMD) of requisite amount, if
applicable, as per bid details on GEM portal in the form of Demand Draft drawn in favour of "ESI Fund
Alc No.1" payable at Hubballi.

The interested Service Providers should upload duly filled signed Bid form and their bids along
with scanned copies of all the relevant certificates, documents, etc. in support oftheir technical bids -all
duly signed on the GEM portal within the stipulated I last date of BID.

Bid Documents are also available for viewing on the website of Employees' State Insurance
Corporation i.e. www.esic.nic.in

SECURITYSERVICETERMS AND CONDITIONS OF BID

1. Estimated Bid value: The estimated tender value is Rs.40,00,OOO/- Lakhs Approximately
(Rupees Forty Lakhs only) for one year.

2. Period of Contract: The Contract shall initially be valid for a period of ONE year and may be
extended further for a period of one year subject to satisfactory performance, on the same
terms and conditions. The rates quoted by the Service Provider shall remain unchanged during
the period of contract. ESIC, however, reserves the right to terminate the contract by serving
one month notice, in writing. The Contract may be terminated by either side by giving one
month notice in writing.

3. Earnest Money Deposit (EMD): EMD of requisite amount if applicable to be deposited in the
form of Demand Draft drawn in favour of "ESI Fund A/c No.1" payable at Hubballi. The scanned
copy of the same to be uploaded on GeM portal. Firm registered under MSME will be exempted
from EMD as per existing guidelines.

4. PERFORMANCE BANK GUARANTEE/SECURITY DEPOSIT: The successful Service Provider will


have to deposit Performance Bank Guarantee/Security Deposit as per Bid Details on GEM in the
form of Demand Draft in favor of "ESI Saving Fund Alc No.1" payable at Hubballi and execute
the contract within 15 days of acceptance of Bid.

5. The minimum service charges in the procurement of Manpower Outsourcing Service may be
3.85% (3%profit plus tansaction charges, which are 0.85% at present) as proposed by GeM.

6. Last date of submission: Last date of uploading of Bid is stipulated on GeM portal.

7. Date of opening of Bids: Technical Bid will be opened on stipulated date and time on GeM
portal.

8. Eligibility Criteria: Agencies having sufficient experience as per bid requirement of providing
Security Services through Ex-Servicemen in reputed organizations in Public Sector (Central
Govt./State Govt'/UT Govt'/PSUs) preferably are eligible to participate in bid. The Service

a. One similar work of Annual value not less than Rs. 44,00,000/- ( Rupees Forty Four Lakhs

b. Two similar works of Annual value not less than Rs.33,OO,OOO/-(Rupees Thirty Three
Lakhs only) (equals to 60% of the value of the work to be executed)
c. Three similar works of Annual value not less than Rs.22,OO,OOO/-(Rupees Twenty Two
Lakhs only) (equals to 40% of the value of the work to be executed)

9. The Agency must be registered with the following statutory bodies such as ESIC,EPFO, PT, CLRA,
Income Tax and GST.

10. The average annual turnover of Service Provider must be duly certified by the Certified
Chartered Accountant/Auditor/any other prescribed authority and it should be minimum
Rs.48,OO,OOO/-(Rupees Forty-Eight Lakh Only)

11. The Bidder should have a Registered Office I Branch office in KARNATAKA State.

12. The Service Provider firm who does not have Main Code of ESIC/EPFOin the Hubballi area, then
the Service Provider firm should have ESIC Sub Code and EPFO Sub Code respectively for the
Hubballi area for ensuring that Security Personnel are getting the benefits as per their
convenience.

13. Documentary evidence (Labour license of Karnataka / PSARA registration of Karnataka / Valid
registration under shop & establishment act Karnataka Govt.) must be uploaded with bid.

14. The Service Provider firm should not have been indicted for any criminal, fraudulent or anti
competition activity and not been blacklisted by any Government Departments.

15. Registrations under Contract Labour (R&A) Act, 1970 and Private Security Agencies Regulations
Act, 2005 for Security Services are mandatory.

16. Only agencies having valid registration under contract Labour Act, ESI, EPF and other statutory
law required for providing Security services shall apply.

17. The Service Provider firm should not have been indicted for any criminal, fraudulent or anti
competition activity by any Government Departments/PSU/ Statutory Bodies etc. Undertakings
in below mentioned format must be uploaded with bid duly ink signed & dated after the date of
tender publication.

20. The Service Provider is expected to examine all instructions, eligibility criteria, forms, General
terms and conditions and Special Terms and Conditions in the GeM tender document.
Failure to furnish complete information as required with reference to the tender document
shall result in rejection of the bid.

21. Service Provider has to submit all the undertakings as per bid requirement duly ink signed &
dated after the date of bid publication.

22. Certified translated copy of supporting documents should be uploaded in Hindi/English, in case
of documents available in Regional language.

23. Documents to be uploaded: Service Provider firms which fulfill the above eligibility conditions
may upload the technical bid along with the scanned copy of following documents failing which
their bids may be rejected:-

i. Copy of Audited Accounts Statement of annual turnover for last three financial years
(2019-20, 2020-21 and 2021-22).
ii. Registration / Incorporation Certificate of firm.
iii. Scanned copy of EMD, if applicable
iv. Proof of registration with Contract Labor (Regulation & Abolition Act, 1370), PSA (A) Act,
2005, Goods and Services Tax (GST), Employees' State Insurance Act, 1948, Employees
Provident Fund Act.
v. Copy of registration certificate under shop and establishment for having Registered office
I Branch Office in KARNATAKA.
vi. Copies of satisfactory work completion report in support of eligibility conditions.
Satisfactory Work Completion report shall be considered for determining the work
experience of the Service Provider.
vii. Copy of Income Tax PAN Number.
viii. Declaration as per format at 'Annexure - A'
ix. Scanned Bid Document containing all terms and conditions of the bid duly signed and
Stamped by the Service Provider.
x. Copies of paid challans in r/o. GST, ESI& EPFfor the period from Jan - 2022 to Mar - 2023.

The EMD must be submitted to The Deputy Director I/c, ESIC, Sub Regional Office,
Hubballi, in a sealed cover, before the last date of submission of tender as per Gem Portal.

OTHER TERMS AND CONDITIONS

EVALUATION OF TECHNICAL AND FINANCIAL BID


a. The Bidders are required to upload Technical bid as per Bid Specification uploaded on GEM
Portal.
b. Each and every page of attached document should be signed and stamped by Service Provider or
its authorized representative of Service Provider.
c. The competent authority of ESIC reserves the right to reject all or any Bid in whole, or in part,
without assigning any reason thereof.
d. Lowest financial bid will be evaluated based on overall lowest rate quoted by the Service
Provider as per GEM guidelines.
e. The earnest money shall be refunded to the unsuccessful Service Providers after finalization of
the contract. It shall be refunded to the successful Service Provider on receipt of performance
security deposit, No interest is payable on the EMD.
f. The bid shall be valid for 90 days from the date of opening.
g. Bids which are incomplete or Conditional in any form shall be rejected out rightly.
h. In case the successful Service Provider declines the offer of Contract, for whatsoever reason(s),
their EMD shall be forfeited.
i. A formal contract shall be executed/ entered into with the successful Service Provider. In this
contract, the successful Service Provider shall be defined as Contractor.

PERFORMANCE BANK GUARANTEE/SECURITY DEPOSIT

The successful Service Provider will have to deposit Performance Bank Guarantee/Security
Deposit as per Bid Details on GEM in the form of Demand Draft in favor of liESI Saving Fund A/c No.1"
payable at Hubballi and execute the contract within 15 days of acceptance of Bid.

GENERAL CONDITIONS OF CONTRACT (GCe)

1. The Agency should engage all guards from the category of Ex-Servicemen not above the age of
60 years. The Contractor shall provide satisfactory proof of Ex-Servicemen status of the Security
Guards before their deployment. The Security agency shall not employ any person below the
age of 21 years and above the age of 60 years. Manpower so engaged should be trained for
providing security services. The Security Personnel should be qualified themselves in medical
fitness tests as per the norms. The medical certificate should be obtained by the vendor and
submit to this office before engaging them.

2. The rate quoted shall be responsive and the same should be inclusive of all statutory obligations
such as Minimum wages, ESI, PF contributions, bonus, service charges, all kind of taxes etc. The
offers of those prospective Service Providers which do not meet the statutory requirements of
applicable minimum wages, ESI& PF and Bonus are liable to be rejected.

3. Minimum wages as fixed and revised from time to time by the DGR as applicable to
"Ex-Serviceman Security Guard" without arms (skilled) and "Ex-Serviceman Security
Supervisor (highly skilled)" should be paid by the contractor.

4. Whenever Minimum wages is revised by the respective authorities, it shall be duty of the
contractor to immediately pay such revised minimum wages to the contract personnel deployed
after getting necessary approval from the office for the same and then re-imbursement may be
claimed from The Deputy Director I/c, ESIC,Sub Regional Office, Hubballi.

5. The Agency shall comply with Contract Labour (R&A) Act, PF provisions, ESI provisions, Payment
of Bonus Act etc. whichever applicable and all other statutory payments will be the liabilities of
the Security Agency, applicable from time to time.

6. The Security Guards should be of sound bodily & mental health, preferably having education not
below than the 10th standard and shall be able to read & write in Hindi, English & Kannada
languages. Their character antecedents must be verified from the concerned Police Station by
the Security Agency and a proof thereof should be submitted to the Sub Regional Office,
Hubballi authorities before their deployment.

7. The Contractor must provide standard liveries (uniform) at his own cost to the Security staff /
Supervisors. The staff/supervisor shall be in proper uniform as approved by ESIC and with
their identity card properly displayed.

8. The Guards whose services are provided by the Agency will at all times and for all purposes, be
the employees of the Agency who will be responsible for necessary service benefits to them.
The Sub Regional Office authorities shall have the right for removal of a person of the Agency
who is not discharging his duties satisfactorily or his role is found dubious in nature.

9. The Agency shall not engage any sub-contractor or transfer the contract to any other person.

10. The approximate number of persons required to be engaged will be 07 (Seven) Security Guards
(Including Reliever) for three shifts and 01 (One) Security Supervisor for general duty i.e. from
09:00 hrs to 18:30 hrs at Sub Regional Office, ESIC, Hubballi (Karnataka) and 04 (Three)
Security Guards (Including Reliever) for three shifts at ESI Dispensary, N R Pet, Davanagere
(Karnataka). However, the Sub Regional Office, Hubballi has the right to change the number of
Guards at his/her discretion at any time and the agency shall be bound to provide the amended
numbers required.

11. The Eight Hours Shift will normally commence from 0600 hrs to 1400 hrs, 1400 hrs to 2200 hrs
and 2200 hrs to 0600 hrs and would be called Morning, Evening and Night Shifts respectively.
But the timings of the shift are changeable and can be fixed by this office from time to time
depending upon the requirements. Prolonged duty hours (more than 8 hours at a stretch) shall
not be allowed. No payment shall be made by this office for double duty, if any.

12. Weekly Day of Rest: An employee (Security Guard) in a scheduled employrr.ent in respect of
which minimum rates of wages have been fixed under the Act, shall be allowed a day of rest
every week (hereinafter referred to as "the rest day") which shall ordinarily be Sunday, but the
employer may fix any other day of the week as the rest day for an employee.

13. Attendance of personnel will be maintained by the Service Provider and copy of the same shall
be provided (with authorized counter signature by this office) along with the monthly bill to the
office of the ESICon the 1st working day of the following month.

14. On any given day, if any of contractor's personnel(s) deployed under the contract is (are) absent
or fails to report in time, the contractor must provide a suitable substitute in time, for this
purpose, the contractor must monitor on a daily basis, the sanction of leave to the staff
deployed.

15. The administrative issues like leave, weekly off, discipline etc., of the Security personnel are
responsibility of the contractor.

16. The Agency shall deploy security personnel after medical examination at its own cost and
medical certificate is to be submitted to the Sub Regional Office authorities at the time of
deployment.

17. The list containing the names, verified addresses, affixing a photograph along with the signature
of each employee appointed by the Agency shall be made available to the Sub Regional Office,
Hubballi authorities with their Bio-data before commencing the contract.

18. The changes in the personnel deployed will not be allowed without prior approval/permission of
Dy. Director I/c of this office or any other authorized officer.

19. No enhancement in the agreed rates will be allowed during the Contract period except statutory
revision, if any.

20. The Agency will submit the proof of deposit of EPFO, ESIC & PT within one week from the
disbursement of wages every month, to the Sub Regional Office authorities. Copy of the
Challans, vouchers in relation to ESIC, EPFO & PT subscription deposit with the Bank should be
submitted along with every month bill with certified copy of list of deployed security guards
against whom the amount is deposited. Certified copy of returns submitted to the ESI, EPF& PT
authorities should be produced periodically.

21. The bill for each month shall be presented in Triplicate by the Agency by is" of every following
month duly pre-receipted. The security Agency will pay the wages to their guards/personnel
latest by 7th of every month. Payment of wages shall be done through bank account only by
electronic clearance system. The payment to guards/personnel is not linked with payment of
bill by ESICcliam made as that of cash payments of wages will be accepted.

22. The Performance Bank Guarantee shall be returned to the Agency on the expiry of the contract
period on furnishing usual clearance/No Demand Certificate. The Security Deposit shall be
returned on the expiry and termination of the Contract subject to conditions that the Security
Agency has indemnified the 1st Party (The Deputy Director I/c, Sub Regional Office, ESIC,
Hubballi) for all payments to the staff. The Security Agency while requesting for release of the
Performance Bank Guarantee shall certify that all payments including Labour Laws obligations
have been fulfilled and that the ESI Corporation authorities shall not be responsible for such
payments to the staff arising out of the decision of the Labour court, if any.

23. The Contract shall come into force from the date mentioned in the Agreement signed by both
the parties. In case the Agency fails to execute the job after signing the Agreement Deed or
leave the job before completion of the period of Contract at their own accord, the Deputy
Director I/c shall have the right to forfeit the Performance Bank Guarantee Deposited by the
Agency for execution of the Contract.

24. The Agency shall comply with the Labour laws applicable and Sub Regional Office, ESIC,Hubballi
shall not be responsible for any litigation/default from Agency-side.

25. In addition to existing criteria for selection, in case there is any tie in the rates, the documentary
support on the period of experience for engagement of personnel in various Govt. /Semi. Govt.
offices and number of such personnel shall be given more weightage in selection.

26. The security personnel should be rotated from their deployment at an interval of three months.

27. The Deputy Director I/c shall have the full powers to terminate the tender process at any stage,
without assigning any reason. The Deputy Director's decision in this regard will be the final.

28. No Hostel/Accommodations will be provided by Sub Regional Office, ESIC, Hubballi.


Contractor/Agency and security guards must make their own arrangements.

29. If as a result of post payment audit any overpayment is detected in respect of any work done by
the agency under the tender, it shall be recovered from the agency by Sub Regional Office, ESIC,
Hubballi.

30. In case of natural disaster, the security personnel should be able to respond, act and deliver
additionally assigned duties by Sub Regional Office, ESIC, Hubballi. They shall also be a part of
disaster management of the Sub Regional Office, ESIC,Hubballi.

31. The contractor will maintain Attendance Register in which day to day deployment of personnel
will be entered. While raising the bill, the deployment particulars of the personnel's engaged
during each month, shift wise, should be shown. The Attendance register shall remain available
round the clock for inspection by the authorized representative of the Sub Regional Office, ESIC,
Hubballi.

32. Prolonged duty hours shall not be allowed. No payment shall be made for overtime or
prolonged duty hours, if any. Alternative arrangements should be made in case of leave,
sickness, unauthorized absence etc,.

33. The Service Provider should ensure that the ex-servicemen security guards deployed by the
agencies, confirm to the definition of Ex-Servicemen as contained in Gazette Notification
Number GSR 757 (E) DATED: 04.10.2012 of Govt. of India, Ministry of Personnel, Public
Grievance and Pension, published I the Gazette of India extraordinary part 2 section 3 sub-
section(i) dated: 10.10.2022.

34. No Over writings/Erasings/Corrections are allowed in Technical Bid page 1 & page 2 and
Annexure - A and such tenderers will be 'Rejected',

35. The Sub Regional Office, ESIC, Hubballi shall not be under any obligation for providing
employment to any worker of the contractor during the contract or after the expiry of the
contract. Sub Regional Office, ESIC, Hubballi does not recognize any employee/employer
relationship with any of the workers of the contractor.

36. GST applicable will be reimbursed on actual basis on production of documentary evidence.

PENAL TV CLAUSE

1. In case of any loss/theft of property, the Deputy Director I/c, Sub Regional Office, ESIC,Hubballi
will consider the circumstances leading to the loss/theft and if the responsibility is fixed upon
the Agency by the Deputy Director I/c , the Agency will make good the loss within a specified
period or else deduction of the cost will be made from the security bill of the following month.

2. For any breach of contract, the Deputy Director I/c shall be entitled to impose a penalty to the
extent of Rs.l,OOO/-on the 1st occasion upon the Agency in the event of breach, violation or
contravention of any of the terms and conditions contained herein brought to the notice of the
Deputy Director I/c.

3. If the lapse is repeated again, the extent of penalty will be doubled on each such occasion. The
decision of the said Officer in this regard shall be final and binding upon the Agency. Some of the
instances in which penalty would be imposed, are enumerated below. But these are not
exhaustive and penalty may be imposed on any violation, breach or contravention of any of the
terms and conditions as well as assigned duties and in following conditions:-

a. Ifthe personnel are not found in proper Uniform and displaying Photo Identity Card.

b. If the personnel found indulging in smoking/drinking/sleeping during duty hours.

c. If the personnel found performing double Duty within 24 hours without prior approval.

d. The Agency is supposed to provide 9 Security Guards per day across all location. If the
Agency is not able to provide the required number of personnel, a penalty for shortage
of attendance will be imposed.

e. Penalty will also be imposed if the behavior of personnel found discourteous.

f. If any Guard found performing duty, submitting a fake name and address.

g. No persons other than the persons mentioned in the approved list supplied by the
agency should be engaged for duty.

MANPOWER

1. Any misconduct / misbehavior on the part of the manpower deployed by the Contractor will not
be tolerated and such person will have to be replaced by the Contractor at his own costs, risks
and responsibilities immediately, with written intimation to ESIC.

2. The contractor should ensure to maintain adequate number of manpower. In case the available
manpower is less when compared to the required, a penalty of Rs.500/- per day will be
deducted from the bill.

3. The Contractors shall employ adult labourers only. Employment of child labour will lead to the
termination of the contract. The contractor shall be responsible for payment by following the
Minimum wages Act, ESI Act, PF Act, Bonus Act GST Act as applicable and also of obeying all
existing Labour laws.

4. The number of manpower required (10 nos) is likely to increase or decrease depending upon the
actual requirement.

TERMINATION CLAUSE:

During the period of agreement, if it is found that, the agency is not providing proper services or
charging by fraudulent manner or otherwise, the whole Performance Bank Guarantee deposited with
ESIC or part thereof shall be forfeited in favor of ESIC and agreement will be terminated after giving
30 days notice.

The Sub Regional Office, ESIC, Hubballi reserves the right to terminate the contract in case of
breach of contract by giving one month notice.

DUTIES AND RESPONSIBILITIESOF SECURITYSTAFF

1. The Agency shall authorize the Security Supervisor to monitor all Security Guards deployed at
SRO, ESIC,Hubballi as well as ESIDispensary, N R Pet, Davanagere.

2. The Agency shall be responsible for overall security measures and arrangements to safeguard
the movable and immovable property and prevention of theft within the premises.

3. Controlling the crowds.

4. Protection of persons and property.

5. Evacuation of occupants in case of the fire or natural calamities.

6. Prevention of unauthorized entry of personnel including all types of outside vendors in the
entire campus.

7. The vehicles that enter into the premises must be identified, noted in the Register and parked at
designated places. Trolley mirrors, wherever required may be provided for the inspection of
four wheelers/other vehicles.

8. Operating of Fire fighting equipments in emergency.

9. The Agency staff shall work on duty and they will be deployed in three shifts i.e. 6 AM to 2 PM /
2 PM to 10 PM / 10 PM to 6 AM. The guard of the previous shift will submit the attendance of
the incoming guard within 15 minutes of the commencement of the shift to the caretaker on
duty for verification.

10. The Agency shall provide proper uniform, whistle, baton for the day shift workers and five cell
Torch Light and 5 ft. long stick for staff on night duty.

11. The Agency shall be fully responsible for the performance and fitness on their duty of their
personnel (Guards). For this, the Agency will have to keep close liaison with the Sub Regional
Office Hubballi authorities, Caretaker and Officer in-charge.

12. The Agency shall have to maintain a round-the-clock Control Room with Telephone No., Mobile
No., names of persons manning the Control room in their office for any urgent communication
regarding any extra-ordinary situation.

13. The Agency shall conduct surprise Night Patrolling at all the projects and shall submit written
report to the Deputy Director I/c, Sub Regional Office, ESIC,Hubballi periodically at least twice a
month.

14. The agency shall provide their own communication system to their staff for the coordination
with Officers/officials of Sub Regional Office.

15. The Agency shall undertake any other work of similar nature assigned to them by the Deputy
Director I/c from time to time.

16. The security personnel shall watch that there are no unidentified /unclaimed /suspicious objects
/persons in the buildings/premises.

17. The security personnel shall also ensure that all the electrical equipments/instruments/ lights
and fans must be switched off at the time of closure of the office or part of the office.

18. The security guards must be deployed in such a way that no part of the building /premises
remains unnoticed /unattended.

19. The security personnel should not leave the duty point unless and until the reliever comes for
shift duties.

20. The security personnel shall have knowledge about operating of water lifting motor and Diesel
Generator.

21. The security supervisor will maintain all the registers, which are kept at the main gate and other
points.

21. To check people on entry/exit base on production identity cards system, issue of passes, etc.,
and maintain visitor's record.

22. Thorough checking of incoming and outgoing material against proper Gate pass duly signed by
the authorized signatory.

23. To ensure that no hawkers, marketing persons or vendors are allowed into the campus without
permission.

24. The security guards must take round of the buildings at fixed intervals.

25. Collecting intelligence about anti-social and other subversive elements in the crowd, and also be
alert in tackling the mischief - mongers trying to gain entry in the campus.

26. The security personnel must have the telephone numbers of the nearest Police Station, Fire
Station, Ambulance, etc. for the sake of emergency if any.

27. The Agency shall have to provide the Mobile Phone Nos. of all the security guards for records.

DISPUTE SETTLEMENT

It is mutually agreed that all difference and disputes arising out of or in connection with this
Agreement shall be settled by mutual discussions and negotiations and if such disputes and differences
cannot be settled and resolved by discussions and negotiations then the same shall be referred to the
Sole Arbitrator appointed by the Deputy Director I/c, Sub Regional Office, Hubballi, whose decision shall
be final and binding on both the parties. The arbitration proceeding's shall be governed by Indian
Arbitration and Conciliation Act 1996 as amended from time to time.

The cost of Arbitration shall be borne by the respective parties in equal proportions. During the
pendency of the arbitration proceeding and currency of contract, the contractor shall not be entitled to
suspend the work/service to which the dispute relates on account of the arbitration and payment to the
contractor shall continue to be made in terms of the contract. Arbitration proceedings will be held at
Hubballi only.

The Courts at Hubballi shall have the exclusive jurisdiction to try all disputes, if any, arising out
of this agreement between the parties.
