BAR PART 1 CRIMINAL LAW PRE-CLASS ACTIVITIES OF 22ND MARCH, 2023

On the 12/04/2006, Mr. Frank, a Police Officer forced himself on a 12 years old
Chinyere and had a sexual intercourse with her at Guzape area of the FCT. On
being apprehended, he brought out his gun and aimed at the crowd which got
scared and allowed him to escape. On the process, Mr. Frank injured one Koleri
who later died in a hospital after two weeks. Chinyere vowed to get him arrested
and led some people to the house where Mr Frank used to have intercourse with
her and arrested him. The angry mob on the leadership of one Kabiru descended
on Frank and made sure he gave the ghost. Unknown to the said Kabiru, he set
Mr. Frank ablaze to kill him. Tukura, a member of the group attacked Mrs. Frank
and had her pregnancy terminated with the premature delivery of her 7 months
baby who died shortly. On the course of celebrating their success in attaining
justice, Miss Agnes, a long time girl friend of Mr. Tukura got drunk and allowed
Tukura to have sex with her. On the other hand, another member of the
syndicate, Mr Thomas believed Miss Cindy who did not resisted, allowed him to
have sex with her which he did. Mr. Dango and Tulala who are known members of
the group came to bail Kabiru, Tukura and Thomas were arrested and charged
along with them for killing Mr Frank. As a reknown Director of Public Prosecution,
answer the following questions.

1. Comment on the consent of Chinyere to the action of Mr. Frank

2. What offences can you allege against Mr. Frank?
3. What offence can you charge Mr. Kabiru for setting Frank ablaze and how
can you establish it?
4. Comment on the culpability of Mr. Tukura for killing the baby.
5. Do you think Miss Agnes and Cindy can validly complain against their
respective assailants for rape? Give reasons for your answer.
6. Advise on the propriety or otherwise of charging all of them for killing Mr
Frank.
