MRS MARBEL OWADIALI


of No 28 Oyekunle Street Agegunle Dalimo Alakuko Lagos
(hereinafter called the TENANT) of the other part.

W H E R E A S:
(A)1. The Landlord being the owner of the property containing A SHOP with
appurtenances situate, lying and being Locate at POWA SHOP at ALAKUKO POLICE
STATION Alakuko Lagos, which is hereinafter referred to as the “DEMISED
PREMISES”

2. The Landlord has agreed to let and tenant has agreed to take DEMISED PREMISES
with all the appurtenances thereto for the term of one year certain commencing
from 1ST DAY of OCTOBER 2023 TO 31st day of 1ST DAY of September 2024
at a yearly rent of N170,000 (One Hundred and Seventy Thousand Naira only)
payable in advance.

3. In pursuance of this agreement and as consideration thereof, the sum of


N170,000 (One Hundred and Seventy Thousand Naira only) payable in advance
representing rents in advance for the one year rent in respect of the DEMISED
PREMISES is hereby paid by the tenant to the Landlord and the receipt whereof the
Landlord hereby acknowledges.

4. The Tenant has also agreed to pay his rents yearly in advance.

(B) THE TENANT HEREBY COVENANTS WITH THE LANDLORD AS FOLLOWS:


(1) To pay the sum of N170,000 (One hundred and seventy thousand naira
only) payable in advance yearly rent herein reserved at the times and in the
manner aforesaid without demand.

(2) To keep the interior of the DEMISED PREMISES and every part thereof and
the windows thereof in tenantable repair throughout the term hereby
granted and it is hereby agreed and declared that there are included in these
covenants as repairable by the tenant (including replacement whenever such
shall be necessary) the tiles (viny) or as the case may be flooring walls
thereof and the plaster of the ceilings and walls thereof.

(3) That incase of any amendment or repairs to the existing fixtures


and fittings in the demise premises the landlord should be informed
and the fittings especially window blind etc should not be removed at the
expiration of this tenancy or alternatively the fixtures and fittings removed
should be replaced.

(4) Wall should not be broken for the purpose of installing air conditioner or any
fixtures or fittings without the consent and approval of the landlord or his
attorney.

(5) That this agreement shall continue to be applicable in respect of


the premises for every given year provided that the tenant still in
possession and until another agreement is entered by parties or
possession is given up.

(D) PROVIDED ALWAYS AND IT IS EXPRESSLY AGREED AS FOLLOWS BY THE


PARTIES:
That if any of the convenient is breached or the tenant refuse to pay her rent on
the actual due date a THREE MONTHS NOTICE TO QUIT shall be issued and not
6month notice.

(1) TAKE notice that A THREE MONTHS NOTICE TO QUIT SHALL BE ISSUED
TO THE TENANT FAILURE TO DELIVER UP POSSESSION WITHIN THE
THREE MONTHS STIPULATED IN THE NOTICE TO QUIT THE LANDLORD
WILL ISSUE 7DAYS NOTICE OF OWNER’S INTENTION TO
APPLY TO RECOVER POSSESSION TO THE TENANT AND THE PROVISION
CONTAINED
IN THE RENT CONTROL AND RECOVERY OF PREMISES LAW
(APPLICABLE IN LAGOS STATE)AND/OR TENANCY LAW OF LAGOS
STATE WILL NOT BE EXCLUDED.

(2) To use all fixtures and fittings in a reasonable and tenantable manner and to
replace all missing items or all damages and defects caused by the servants or
agents of the tenant except they are due to ordinary wear and tear or Act of God.

(3) Except with the consent of the Landlord through his attorney/Solicitor in
writing, the tenant shall not make any structural alterations or additions
to the DEMISED PREMISES or any part thereof.

(4) Not to use or suffer or permit the premises to be used otherwise than for the
purpose for which is rented for which is to be used for residential only.

(5) Not to assign, under-let or otherwise part with possession of the DEMISED
PREMISES or any part thereof without the writing consent of the Landlord.

(6) Not to do any RELIGIOUS ACTIVITIES in the shop whatsoever e.g. shop
fellowship, Asalatu etc in the compound or any other religious activities that can be
noticeable to the neighbors.

(7) Not to keep or rear any animal be it domestic or otherwise in the demise premise.

(8) To allow the Landlord and/or his Attorney/solicitor and all persons
authorized by them on giving not less than forty-eight hours notice to
critically examine the state and condition of the DEMISED PREMISES
(periodically )(demised premises includes the bedrooms, bathrooms,
kitchen, sitting rooms, corridors, the surroundings of the apartment e.t.c)
and thereupon the Landlord may serve upon the tenant notice in writing specifying
any repairs necessary to be done and require the tenant forthwith to execute the
same and if the tenant shall not within 10 days after the service of such notice
proceed diligently with the execution of such repairs then to permit the Landlord to
enter upon the premises and execute such repairs and the cost thereof shall be a
debt from the tenant to the Landlord and forthwith recoverable on request or by
action.

(9) To pay all expenses incurred in the preparation of this agreement including
Solicitor’s fee.

(10) To ensure the maintenance and up keep, cleansing of the demise premises and
surroundings and dislodgement of septic tanks, refuse disposal, soak away and
sewage system serving the DEMISED PREMISES.

(11) To indemnify the Landlord at all times in respect of any damage to the interior or
its contents be it, the fittings or fixtures.

(13) The Landlord shall not be liable for the loss to tenant’s property by whatever
means.

(13) That the tenant will not constitute nuisance either by herself, her visitors or persons
that occupies the flat together with the tenant.
(14) That the shop and it surroundings shall be tidy and quiet at all times.
(15) On the termination of this tenancy the tenant shall quietly surrender the premises
to the Landlord in good repair and tenantable condition as aforesaid.

HANDS AND SEAL THE DAY AND YEAR FIRST ABOVE WRITTEN
