Cockmates, I need your advice. I live in the heart of Quezon City, in a 1,500 sq. meter lot where I have my backyard
"farm". I have 30 corded roosters in teepees and about 20 hens and pullets in pens. One of my neighbors has been
complaining about the crowing of my roosters which they say constitutes public nuisance. The have been at it since 2001
when they filed a complaint with our barangay and with the Public Order and Safety Office of Quezon City. I have been
harassed by inspectors from both the barangay and city hall but in both instances, their complaint was dismissed because,
to my knowledge, I have violated no law or City Ordinance. My area is zoned as Major Commercial wherein amusement
centers, theaters, commercial stables, dance halls, beer houses, discoteques and the like are among the permitted uses. I
have not received any other complaint from any of my other neighbors, one of which is a major hospital in Quezon City.
This morning, I received a letter from the same neighbor and they are renewing their crusade against my roosters. I'm
afraid that they will again be using their influence, in media and in politics. Although they were not able to take my
roosters away from me the last time they complained, I lost my position in my office and suffered a heart attack (I had to
undergo angioplasty procedure). By the way, my neignbor is a 96 year old lady who says she finds it hard to sleep because
of the crowing of my roosters. Should I give in to them now out of neighborly love, or out of delicadeza? Please help me
decide by giving me your advice. Many thanks.

96 years is way past retirement

if your lot is actually setting in a "commercial zone", then get a breeders license. then tell your neighbour (if her lot is also
within the commercial zone) to relocate to a residential area.

first, try to check if the city zoning ordinance or a related law that prohibits or restricts the raising of gamefowls within the
area. if no such prohibition exists, then you have nothing to worry about.
second, try to check if there are barangay ordinances regulating the raising of chickens within the barangay. check for
compliance if there is one. I doubt if there is any.
third, please check on the sanitation code ( city, or barangay, if any). this has something to do with the disposal/smell of
chicken wastes. check again for compliance.
fourth, find legal comfort in the principle that you have a right to privacy. this right allows you to raise chickens within the
confines of your property without being badgered by other people. moreso, you have the right to the use and enjoyment of
your own property, which of course includes the right to use it according to your desire.
as to your 96 year old neighbor, i think that everytime she hears a chicken crow, she thinks that she is already within
armslength of sr. san pedro at the gates of heaven, haunted by her own mortality. i suggest that once in a while you throw
her a broodstag.. this will perk her up.

Pre. brother ko taga DENR. Sila magsasabi ung dapat ka paalisin, o inde. and sabi nya sa akin, di ka mapapaalis kasi, ung
reklamo sayo, noise pollution. eh sa criteria nila sa pagiging noisy, malayo daw ang tilaok ng manok. kung maingay na
factory nga daw eh nakakalusot, yung sayo pa.
