Petition filed on behalf of the Petitioner under section 13 (1) (ia) of Hindu
marriage act.

I. Description of the parties:-

1. The petitioner is the son of sreenu, Hindu, aged about 25 years, working as employee

in private company, resident of Karlapalem village, Guldur Mandal, Salipeta,

Ramayapatnam, S.P.S.R Nellore district. His Mobile number No. 9346811702 . His

Aadhar card No. 538663637042. His address for service of notices etc. is that of his

counsel Ch.Harikrishna Advocate, Kandukur.

2. The Respondent is the wife of petitioner i.e., Nelluru Sravan Kumar and daughter of Revu

Babu@ Babulu, Hindu, house wife, aged about 21 years, resident of Pallipalem, Near N.T.R

statue, Kothapatnam village and mandal, Prakasam District. His Mobile No 8045789563. His

address for service notices etc. is the same as stated above.

II. The petition is filed for the relief of dissolution of marriage of the petitioner with the

Respondent by way of decree of divorce and for other appropriate reliefs.

II. Brief facts of the case :-


1.The Petitioner humbly submits that the marriage of the Petitioner was Performed with

the respondent on 30-06-2021 at the house of my client in Karlapalem village of Guldur

Mandal, as per the principals of Hindu marriage act, rites and their caste, custom and usage.

Immediate after the marriage the respondent joined with the Petitioner at his house in

Karlapalem village where the Petitioner is living. As such their marriage was consummated and

solemnized. No dowry or gifts were presented by the respondent and her parents at the time

of said marriage. The marriage was performed with the expenses of the petitioner. The

Petitioner and Respondent were not blessed with any children.

2.The Petitioner submits that the Petitioner and Respondent lived with the petitioner for only

one month. During the said period, the Respondent developed hatred and dislike towards the

Petitioner and used to state to the petitioner that she has no love and affection towards him

and also stated that her marriage was performed against her will with the pressure of her

parents. The Respondent used to abuse the petitioner in filthy language and used to harass

him without any reasonable cause. The Respondent never allowed the Petitioner to share the

bed with the Respondent. The Respondent is not interest to lead conjugal life with the

Petitioner and she used to demand the Petitioner to leave his presence. The Respondent

harassed the Petitioner subject to cruelty. While so on 05-08-2021 the Respondent without any

reason, quarreled with the Petitioner by abusing him and left the house of the Petitioner and

reached to her parent’s house at Kothapatnam village, and stayed there.

3.The Petitioner submits that himself, his parents, and elders approached the Respondent on

several times and requested her to join the Petitioner for his conjugal life and to lead happy
marital life. But the Respondent did not change her attitude and refused to join the Petitioner

for his conjugal life stating that she has no love and affection towards the Petitioner. The

Respondent without any fault of the Petitioner acted cruelly towards petitioner by denying the

conjugal life and also harassed the petitioner physically and mentally with her acts and

adamant attitude. The Petitioner waited all these days that the Respondent will change his

attitude, but in vain. The Respondent neglected him and acted subject to cruelty to the

Petitioner and she has been living on her own accord. There is no possibility of reconciliation

between the petitioner and the respondent due to the adamant attitude and cruel nature of the

respondent. Hence the petitioner of constrained to file this petition. The Petitioner did not file

any petition of this nature in any court previously and there is no any collusion between the

Petitioner and the Respondent in filing this Petition.

III. Cause of action:-

The cause of action for the Petition arose on 30-06-2021, when the Petitioner married the
Respondent at the house of Petitioner in Karlapalem village, Guldur mandal, S.P.S.R Nellore
District, as per the Hindu rights and their cast custom and subsequent there to when their
marriage was consummated and when the respondent was ill treating the petitioner cruelly by
denying the conjugal life and on 05-08-2021, when the respondent left the house of Petitioner
by quarreling with him and reached to her parents house and acted cruelly towards the
petitioner by denying the conjugal life, and when the Petitioner himself, his parents, and elders
requested the respondent to join the Petitioner for conjugal life and tried to change the attitude
of the Respondent and lost his hope and could not bear the ill treatment of the Respondent.
Where the marriage of the Petitioner and Respondent was performed and where the both
parties lastly residing are all within the jurisdiction of the Hon’ble court.

IV. A fixed court fee of Rs 10/- paid here with U/schedule II article 1(VII) of A.P.C.F act.

V. Prayer:-

Therefore, the petitioner prays that the Hon’ble court may be pleased to pass judgement and
decree his favor :

A. Dissolving the marriage of the Petitioner with the Respondent by a decree of


divorce
B. Directing the Respondent to pay the cost of this Petition
C. To grant such other reliefs.

Proof affidavit of the Petitioner

I, Nelluru Sravan Kumar son of sreenu, Hindu, aged about 25 years, Private employee

working in Hyderabad, resident of Karlapalem village, Guldur Mandal, Salipeta,

Ramayapatnam, S.P.S.R Nellore district, do here by solemnly affirm and state as

follows:-
1. I am the Petitioner here in and the Respondent is my wife. I am well acquainted with

the facts of the case.

2. I humbly submit that my marriage was performed with the Respondent on 30-06-2021 at my

house in Karlapalem village of Guldur Mandal, as per the principals of Hindu marriage act, rites

and their caste, custom and usage. Immediate after the marriage I joined with the respondent

at my house in Karlapalem village. As such their marriage was consummated and solemnized.

No dowry or gifts were presented by the respondent and her parents at the time of said

marriage. The marriage was performed with the expenses of the petitioner. I am not blessed

with any children.

3. I submit that myself and respondent lived with happily for only one month. During the said

period, the Respondent developed hatred and dislike towards me and used to state to me that

she has no love and affection towards me and also stated that her marriage was performed

against her will with the pressure of her parents. The Respondent used to abuse me in filthy

language and used to harass me without any reasonable cause. The Respondent never

allowed me to share the bed with the Respondent. The Respondent is not interest to lead

conjugal life with me and she used to demand me to leave his presence. The Respondent

harassed me subject to cruelty. While so on 05-08-2021 the Respondent without any reason,

quarreled with me by abusing me and left my house and reached to her parent’s house at

Kothapatnam village, and stayed there.

4. I submit that my parents, and elders approached the Respondent on several times and

requested her to join the Petitioner for his conjugal life and to lead happy marital life. But the

Respondent did not change her attitude and refused to join me for his conjugal life stating that
she has no love and affection towards me. The Respondent without any fault of me acted

cruelly towards me by denying the conjugal life and also harassed me physically and mentally

with her acts and adamant attitude. I have waited all these days that the Respondent will

change his attitude, but in vain. The Respondent neglected me and acted subject to cruelty to

me and she has been living on her own accord. There is no possibility of reconciliation

between me and the respondent due to the adamant attitude and cruel nature of the

respondent. Hence I constrained to file this petition. I did not file any petition of this nature in

any court previously and there is no any collusion between me and the Respondent in filing

this Petition.

5. Therefore, I pray the Hon’ble court may be pleased to pass judgement and decree in my favor

by dissolving my marriage with the Respondent as prayed by me in the petition. I will be put

to heavy loss and irreparable injury.
