NOTES:

What are the cardinal rules in drafting legal documents? Explain each.
1) The usual commencement of a contract should be: “This Agreement”, “An
Agreement”, or “Articles of Agreement”, although it is better to state the
particular kind of contract or agreement to be drafted, as “This Mortgage”,
“This Contract of Sale”, “This Contract of Lease,” etc.
2) The full (not abbreviated or initial) names of the parties, their capacity, civil
status, and their residences, should come next. A logical order in which
parties are to be named in the document must be observed. Thus, in deed
of conveyance, the name of the seller, mortgagor, or grantor must first be
stated; in employment contracts, the name of the employer usually comes
first.
3) The principal or operational clauses of the document should be stated in
separate, numbered paragraphs to facilitate ready reference thereto.
4) Verbosity should be avoided.
5) Specific or technical terms, which have special meanings in the document
should be especially defined.
6) Names of parties should be repeated, where the use of pronouns would
give rise to ambiguity.
7) The document must be neat, free from erasures, interlineations, or
suspicions of alterations.
8) A clause may be inserted at the end of an agreement that “this contract shall
extend and be binding upon the parties thereto, their executors,
administrators, and assigns.”
9) The place and date of execution of the document usually come last, and
may be stated thus: “Signed in the City of Manila, Philippines, this __ day
of, 2__.”
Any instrument notarized by a notary public or a competent public official
with the solemnities required by law, is a “public document”.

What are the qualifications in order for one to be eligible for appointment as
a notary public?
To be eligible for appointment as notary public, a person must be:
1) A citizen of the Philippines;
2) Over 21 years of age;
3) A resident in the Philippines for at least one (1) year and maintains a regular
place of work or business in the place where the commission is to be issued;
4) A member of the Philippine Bar in good standing with clearances from the
Office of the Bar Confidant and the Integrated Bar of the Philippines;
5) Must not have been convicted of any crime involving moral turpitude.

What should a notary public enter in the register at the time of notarization?
The notary public shall enter in the register, at the time of notarization:
1) The entry number and page number;
2) The date and time of day of the notarial act;
3) The type of notarial act;
4) The title or description of the instrument;
5) The name and address of each principal;

6) The competent evidence of identity if the signatory is not personally known


to the notary;
7) The name and address of each credible witness swearing to or affirming the
person’s identity;
8) The fee charged for the notarial act;
9) The address where the notarization was performed if not in the notary’s
regular place or work or business;
10) Any other circumstances the notary public may deem of significance or
relevance.

What are the powers of a notary public?


Every notary public shall have the power to:
1) To perform notarial acts such as:
a) Acknowledgments;
b) Oaths and affirmations;
c) Jurat;
d) Signature witnessing;
e) Copy certifications; and
f) Any other act authorized by the 2004 Rules on Notarial Practice;
2) To certify the affixing of a signature by thumb or other mark on an instrument
or document presented for notarization; and
3) To sign on behalf of a person who is physically unable to sign or make a
mark on an instrument or document.

What are the grounds for revocation of commission?


a) The Executive Judge shall revoke a notarial commission for any ground on
which an application for a commission may be denied.
b) In addition, the Executive Judge may revoke the commission of, or impose
appropriate administrative sanctions upon, any notary public who:
1) Fails to keep a notarial register;
2) Fails to make the proper entry or entries in his notarial register
concerning his notarial acts;
3) Fails to send the copy of the entries to the Executive Judge within the
first ten (10) days of the month following;
4) Fails to affix to acknowledgements the date of expiration of his
commission;
5) Fails to submit his notarial register, when filled, to the Executive Judge;
6) Fails to make his report, within a reasonable time, to the Executive
Judge concerning the performance of his duties, as may be required by
the judge;
7) Fails to require the presence of a principal at the time of the notarial act;
8) Fails to identify a principal on the basis of personal knowledge or
competent evidence;
9) Executes a false or incompetent certificate under Section 5, Rule IV;
10) Knowingly performs or fails to perform any other act prohibited or
mandated by these Rules;

11) Commits any other dereliction or ac which in the judgment of the


Executive Judge constitutes good cause for revocation of commission
or imposition of administrative sanction.

Distinguish Jurat from Acknowledgement

JURAT is that part of an affidavit in which the officer certifies that the
instrument was sworn to before him. It is not part of the affidavit. A jurat should be
used only in affidavits, sworn statements, certifications, verifications and the like –
NEVER IN CONTRACTS.

ACKNOWLEDGEMENT is the formal declaration of a person who executed


an instrument that it is his free and voluntary act and deed; that said person
appeared before the notary public at the place and on the date stated therein; that
he exhibited his community tax certificate and gave the number, the date and place
of issuance of the same.

The acknowledgement may be simple when it refers only to one property


and the instrument consists of only one page. It may be complex if the instrument
consists of only one page. It may be complex if the instrument consists of two or
more pages and two or more parcel of lands are involved. In such a case, the
acknowledgement should state that the document is signed in the left hand margin
by the person or persons executing the instrument and their witnesses, and at the
bottom/middles/upper portion (as the case ,may be) of page ___ and that it is
sealed with a notarial seal (Legal Forms, Suarez, pp. 35-36, 2019).

SECTION 3. Format and Style. — a) All pleadings, motions, and similar


papers intended for the court and quasi-judicial body's consideration and action
(court-bound papers) shall be written in single space with a one-and-a-half space
between paragraphs, using an easily readable font style of the party's choice, of
14-size font, and on a 13-inch by 8.5-inch white bond paper; and

b) All decisions, resolutions, and orders issued by courts and by quasi-


judicial bodies under the administrative supervision of the Supreme Court shall
comply with these requirements. Similarly covered are the reports submitted to the
courts and transcripts of stenographic notes.

SECTION 4. Margins and Prints. — The parties shall maintain the


following margins on all court-bound papers: a left-hand margin of 1.5 inches
from the edge; an upper margin of 1.2 inches from the edge; a right-hand
margin of 1.0 inch from the edge; and a lower margin of 1.0 inch from the edge.
