ORDER

The petitioner, M/s Indoves Industrial Pvt. Ltd. (hereinafter


‘petitioner’) is a registered company and is at present, running its existing
Tube Mill at Vill-Jamgaon, Dist. Raigarh (Chhattisgarh).

2. The petitioner has impleaded Chhattisgarh State Power
Transmission Company Limited (hereinafter ‘respondent’ or CSPTCL), the
transmission licensee in the State as respondent.

3. The petitioner intents to setup its DRI based integrated steel plant
with a captive power plant of 46 MW capacity, for which a MoU has been
signed between the Govt. of Chhattisgarh and the petitioner on
02.11.2021. The integrated plant is to be setup by expansion of its existing
tube mill. According to the MoU, petitioner is availing power on 33 KV with
a contract demand of 0.95 MVA, which is required to be enhanced up to
20 MVA for its future expansion.

4. Petitioner submits that in order to meet the requisite demand of


power as well as synchronization of the CPP, the unit would require
connectivity from the respondent at 132 KV. In absence of any nearby 132
KV grid substation, for laying 132 KV dedicated line for the connectivity, a
feasible proposal of a pooled sub-station on existing 132 KV transmission
line with Loop-in and Loop-out arrangement at suitable location in
Jamgaon village is proposed. The petitioner has submitted an application
for 132 KV connectivity containing all the technical specifications and
justification to meet the power requirement but no response received from
the respondent.

5. The petitioner prays for following reliefs: -

(a) To direct the respondent to comply with requests of the petitioner


pertaining to petitioner’s requirement of power supply, in light of
clause 4.2.2 of State Grid Code, 2011.

(b) To direct the respondent to expeditiously comply with the request of


supply of bulk EHV power supply to the industries in consideration
of merit of the proposal in terms of huge income of the State at zero
investment.

(c) To instruct the respondent to grant the requisite approval so that
the proposed expansion can be executed without any further delay.

(d) Allow the petitioner to make addition / alterations / modifications /


changes to the petition, if required, at a future date along with any
additional documents pertaining to the matter.

(e) Provide any such other and further reliefs which this Commission
may deem fit and proper.

6. The respondent CSPTCL, in its reply dated 10.04.2023 submitted


that the petitioner along with another applicant desires connectivity from
pooling sub-station having 132 KV grid connectivity to MSP Steel & Power
Limited, which does not fulfil the requirements specified in Grid Code, 2011
and Connectivity and Intra-State Open Access Regulation, 2011 due to
following reasons:-

(i) Applicants have not applied for connectivity as per the procedure
defined in the Connectivity and Intra-State Open Access
Regulation, 2011.

(ii) They have applied for upgradation of their connectivity from 33 KV


to 132 KV with contract demand of 20 MVA through pooling sub-
station. As per the proposed arrangement, the pooling sub-station
shall be constructed by LILO of 132 KV line feeding to the petitioner
along with M/s MSP Steel & Power Ltd. and M/s MSP Sponge & Iron
Ltd. Therefore, requirement of connectivity as per clause
10(3)(i)(e) of the Connectivity and Intra-State Open Access
Regulation, 2011 is not fulfilled.

7. Petitioner further vide its rejoinder submitted that presently there is


one 132 KV line emanating from 220/132 KV sub-station Raigarh,
connected to M/s MSP Steel & Power Ltd. If this line is disconnected in
between and connected to the proposed 132 KV pooling substation, then
in that case this 132 KV line is a very much dedicated one which is owned

by CSPTCL only, and therefore this line can be connected to the proposed
pooling sub-station. Further, to ensure compliance of the clause 4.2.2 of
Grid Code, 2011, this proposed pooling sub-station shall have 3 Nos., 132
KV outgoing Bays for connecting all the following three industries including
petitioner:-

(a) M/s Indoves Industrial Private Limited, the petitioner

(b) M/s MSP Sponge Iron Ltd., and

(c) M/s MSP Steel & Power Ltd.

These industries are proposed to be connected through their


individual dedicated feeders, emanating from the pooling substation
through 3 numbers 132 KV bays.

8. It is further submitted by the petitioner that power supply to the


petitioner and other related industries can certainly be given from the
proposed pooling substation through their dedicated lines which fulfil all
the conditions as per clause 4.2.2 of the Grid Code, 2011. For this the
petitioner is ready to construct complete 132 KV pooling substation along
with the dedicated lines at its own expenses as required and further ready
to complete all the required formalities as required by CSPTCL.

9. Petitioner further submits that as per Section 42(1) of the Electricity


Act, 2003, it shall be the duty of a distribution licensee to develop and
maintain an efficient co-ordinated and economical distribution system in
his area of supply and to supply electricity in accordance with the
provisions contained in this Act.

10. Respondent CSPTCL in its reply submitted that as per earlier


proposal of contract demand required by the petitioner and its group
companies, loading condition of lines and transformers at 220 KV
substation, Raigarh, the connectivity was not feasible.

11. Further, petitioner and its group companies came up with new
proposal for connectivity to their power plants as follows:-

a. M/s Indoves Industrial Pvt. Ltd. has withdrawn their application for
20 MVA power drawl and 5 MW power injection from / to the
proposed 132KV pooling substation near Vill. Jamgaon.

b. M/s MSP Steel & Power Ltd. having contract demand of 18 MVA and
proposed for reducing their CD from 18 MVA to 15 MVA for which
application is submitted to CSPDCL.

c. M/s MSP Sponge Iron Ltd. reduced their drawl quantum from 12.5
MVA to 4 MVA.

12. Subsequent to the submission of new proposal submitted by the


petitioner, technical feasibility report has been carried out. As per the
report, pooling substation can be constructed near Village Jamgaon
through existing 132 KV bay for M/s MSP Steel at 220 KV substation
Raigarh. As per the technical feasibility report, maximum load condition of
132 KV EHV lines is 340 MW and 38 MW on 40 MVA transformers (I, II
and III) for the export. Maximum load on 132 KV lines for M/s MSP Steel
is 10 MW during the evening of 25.03.2023.

13. It is further submitted that as per technical report for connectivity


in respect of M/s MSP Sponge Iron Ltd. from proposed 132 KV pooling
substation near Vill. Jamgaon, Distt. Raigarh by making LILO of 132 KV
dedicated line of M/s MSP Steel & Power Ltd. emanating from 220KV
substation Raigarh and stated that as per present load scenario at 220KV
substation Raigarh only 1 MVA load is increasing in the existing system.
Therefore, in view of the above, the new proposal submitted by applicant
for connectivity for their power plant is found to be feasible.

14. Respondent submits that the connectivity by 02 Nos. generators i.e.


M/s MSP Steel & Power Ltd. and M/s MSP Sponge Iron Ltd. has been
desired through a proposed pooling substation near Vill. Jamgaon to be

constructed by making LILO the existing 132 KV line presently connected
to M/s MSP Steel & Power Ltd. Respondent shall abide by the order,
whatsoever, passed by this Commission in the instant petition.

Commission’s analysis and decision.

We considered pleadings of both the parties and arguments made during


the course of hearing.

15. In view of the new proposal for connectivity to its power plant
submitted by the petitioner and other group companies which is accepted
by the respondent, the Commission allows pooling substation in 132 KV
line for M/s MSP Steel. Construction of pooling substation is subject to
fulfilment of technical requirements as per prevailing Rules and
Regulations.

16. Also, for future, if circumstances arise for load enhancement and
connectivity related issues, the Commission is of the view that technical
feasibility on the new circumstances needs to be carried out.

We order and petition is disposed off accordingly.
