Respectfully Sheweth:

Brief Facts of the case are as under;

1. That the instant case was fixed before this Hon’able Court on 24-06-2021.
2. That the instant case was sine die adjourned on the date fixed for the reason
that an appeal against the judgment of High Court is pending before the
Supreme Court of Pakistan.
3. That the petitioners humbly request for restoration of the execution petition
on the following amongst other grounds:

GROUNDS:

i. That the judgment debtors on date fixed produced a list of cases

pending before worthy Supreme Court of Pakistan, showing various
cases but strange enough that this list does not bear the names and
other description of the instant decree holders. Copy of the list is
Annex-A.

ii. That the judgment debtors have furnished wrong information

regarding the suspension of the execution in the instant case,
because the minute steady of the list would reveal that names of the
present decree holders Abdur Rehman etc are no where mentioned
in the said list.

iii. That as no stay has been granted in the instant case by the Supreme
Court, therefore the sine die adjournment order is misconceived.

It is, therefore, most graciously prayed that while accepting this application,
the instant execution petition may please be restored for onward
proceedings.
