SUPPLEMENTARY FOUNDING AFFIDAVIT

I, the undersigned,

MTHINI WITNESS MTHEMBU

(Identity Number: 7401315321086.)

Do hereby make oath and say that:

I deposed to the main founding affidavit herein jurat 29 April 2022 and it was filed with
this Honourable court on the 03 March 2022

The facts set out below fall within my own personal knowledge, information and belief
save where the context indicates otherwise, in which case I believe them to be true for
the reasons given.

I have seen and read the concerns of both the LPC and the North-West Bar Council,
I hereby wish to attest to a supplementary affidavit to address same.

I wish to respond thus

3.1.1 The applicant to be comprehensive in addressing the jurisdiction of the

court.

I wish to state that I am an adult male resident at 5 kgogo street, Vander

Hoff Park, Potchefstroom, North West Province a resident within the above
court area jurisdiction; I wish to be admitted as an advocate of the High
Court of North West Division, Mahikeng. I therefore submit the above
honorable court has jurisdiction to entertain this application.

3.1.2 The concern of paragraph 6.2 of the founding affidavit, which did not flow
properly on what was awarded on my person

The University of Johannesburg awarded a bachelor of law degree

(Baccalaureus legum) on my person on this date 07 October 2008. I refer
the above Honourable Court to a certified copy of the relevant page of my
Degree annexed hereto marked “MW 4”

3.1.3 that –paragraph did not 8.2. 0f the founding affidavit does not flow
with regard to what was conferred on person

I served articles of clerkship as a candidate attorney at G. C. N. Bungane attorneys at

Oberholzer which were registered in the Law Society of North Gauteng from March 31
2009 under contract no 732/2009. However, I had to abandon them on the 1st of July
2010, to peruse a lucrative legal-orientated offer by the Merafong City Municipality as
a project management officer.

As a project manager, my duties entailed the following:

- Ensuring projects meet planning objectives.

- Managing the monitoring database and preparing all necessary reports
 - Implementing professional tools.
- Coordinating program and portfolio management.
- Facilitating and improving strategic project management

In 2013 I was promoted to the position of Facility Manager.

As a facility manager I had to:

- Draw lease agreements according to the policies and legislation

- Implementation of policies, procedures, systems and control.
- Manage the provisioning and maintenance of facilities
- Implementation of risk management and supply chain management
strategies, policies and legislation

In 2016 I was elevated to the position of Contract Management because of my

legal expertise. I refer the above Honourable Court to a relevant copy of a
document annexed hereto marked “MW5”

In 2016 my duties as a Contract Manager included the following:

-Creating and amending contracts

-Writing up contracts related to purchase or sale of goods and services

-Tracking contracts through their life circle

- Negotiating contracts

-Providing commercial sales legal advice to the Municipality and supervising the
implementation of contracts for optimal efficiency

-Responsible for contract agreements

In 2019 I left the Merafong Local Municipality employment with an intention lodge an
application to be admitted as an advocate .My endeavours were affected by the
preparations of 2021 Local elections. The circumstances resulting from covid-19 could
only afford me the opportunity to lodge this application this year 2022. Within the period
between 2019 and 2022 I was involved with the communities of Wedela township
about the social issues those that affects their fundamental rights (service delivery)
In 2014 I registered for an advanced diploma in labour law at the University of
Johannesburg but did not successfully acquire the qualification. However, in August
2015 I registered for a postgraduate diploma in management at the North West
University and graduated in 2016 September 2016. See attached certified copy of the
certificate hereto marked as annexure “MW2”

WHEREFORE: I humbly request the above Honourable Court to grant an order in

terms of the Notice of Motion of which this affidavit is annexed.
