AN ORDINANCE PROVIDING FOR MANDATORY PET ANIMAL CARE AND WELFARE


SYSTEM, REQUIRING BARANGAY PET ANIMAL REGISTRATION AND MICROCHIP
IMPLANT SYSTEM WITH ANTI-RABIES VACCINATION IN THE CITY OF MANILA, AND
FOR OTHER PURPOSES

Be it ordained by the City Council of Manila, that:

SECTION 1. Declaration of Policy. It is hereby declared the policy of the City Government to
address the issue of owning and maintaining pet animals within the City of Manila and
therefore establish responsibility among owners in terms of responsibility for proper
safekeeping, sanitation in their respective communities, and protection against rabies for the
animal welfare and the protection of third parties.

SECTION 2. Pet Animal Responsibility and Limitation of Type of Pet Animal. Every
person within the City of Manila who owns or shall acquire any pet animal regardless of
number, variety, breed or classification shall assume full responsibility for the care and
safekeeping of such animal with the assumption of responsibility in regard to the protection of
life and property of other persons. For this purpose, only domesticated animals shall be
allowed as pet animals, and any other animal found otherwise beyond this limitation shall be
subject to confiscation and turnover to proper government authority.

Section 3. Handling of Pet Animals in Veterinary Clinics and Pet Shops. It shall be the
duty of every owner of any establishment in the City of Manila engaged in the business of
veterinary care and sale of pet animals to ensure the safety of such animals while within the
possession or service and with provisions for public viewing. For this purpose, such
establishment shall maintain a viewing window for owners who will have their pet animals
brought for professional service.

SECTION 4. Proper Safekeeping of Pet Animals. Every pet animal shall be properly kept at
all times by its owner within his control or possession. For this purpose, no pet animal that can
be maintained indoors shall be let loose in any public place and shall be completely kept by
leash, harness, kennel or similar shelter. When taken outdoors, such animal shall be kept by
leash, bag stroller or similar means with provisions for cleanup in the event of the animal’s
urination or defecation in any public place.

SECTION 5. Establishment of a Pet Animal Registration for Dogs and Cats with
Monitoring System. A system of registration and monitoring of pet dogs and cats is hereby
established, in which such animals as owned by persons residing in the City of Manila shall be
registered and kept track of their progress through an implanted microchip under the
supervision of the Veterinary Inspection Board (VIB) with the coordination of barangay units
and under the following steps:

A. Within the period of thirty (30) days from the formulation of the Implementing Rules and
Regulations of this Ordinance, all pet dogs and cats belonging to persons residing in the
City of Manila shall be presented to the VIB for registration with the assistance of
corresponding barangays, with subsequent registration every three (3) months from the
first day of registration in the case of newly-acquired pet animals.

B. A microchip shall be implanted by the VIB to every registered pet dog and cat, which
shall collect data including, but not limited to –

1) The full name, contact number, address and barangay of the pet animal’s owner,
2) The name if available, age, breed and sex of the pet dog or cat, and
3) The date of the pet’s details of anti-rabies vaccination and expiration thereof, and its
location in the event that it becomes a stray dog or was figured in any incidence bite.

C. Upon the registration of every pet animal, it shall be the duty of the owner thereof to
present the same to VIB to administer the proper anti-rabies vaccine.

D. The barangay units shall keep a record of registered pet dogs and cats in their
respective jurisdictions, with updating for every subsequent registration and without
prejudice to supplemental recording for unregistered every animal found and
confiscated within their territorial jurisdiction.

E. In the event of a reported stray dog or cat or an incidence causing injury to any person
or both, the same shall be reported to the corresponding barangay for appropriate
action in order to determine the animal’s owner and the injury sustained by any third
party including the details of anti-rabies vaccine administered thereto if any.

F. In the event of a registered pet animal that has been impounded, the VIB shall
immediately determine its registration details and contact its owner for redemption,
without prejudice to mandatory anti-rabies vaccination at the owner’s expense before its
release.

G. The VIB shall furnish the barangays with scanners to be placed over the pet dog’s part
where the microchip was implanted to retrieve registration details.

SECTION 6. Prohibition against Extraction or Tampering of Electronic Tag. After the


microchip is implanted to any registered pet dog, it shall be unlawful for any person to extract
or remove the same, and neither shall it be lawful to tamper with its external or internal
components in any manner whatsoever.

SECTION 7. Implementing Rules and Regulations. Within thirty (30) days from the approval
of this Ordinance, the VIB together with the Manila Barangay Bureau (MBB) shall formulate
rules and regulations implementing the provisions of this Ordinance, which shall include, but
not be limited to, the following:

A. The mandatory registration of all pet animals and the presentation thereof by their
respective owners

B. The mandatory administration of appropriate anti-rabies vaccine to pet animals on a


sustained basis

C. The outsourcing of a qualified provider of microchips for implanting as herein indicated


together with scanners for distribution to barangays

SECTION 8. Appropriations. The amount of Forty-four Million and Five Hundred Thousand
Pesos (PhP44,500,000.00) or so much thereof is hereby appropriated out of the

unappropriated funds of the City Government for the purpose of acquisition of the microchips
and scanners for pet dogs and cats with monitoring devices to be managed by the VIB and the
barangays as hereinabove stated.

SECTION 9. Penalties. Any person who violates the provisions of this Ordinance shall be
penalized, as follows:

a. For the first offense, a fine of One Thousand Pesos (PhP1,000.00);

b. For the second offense, a fine of Two Thousand Pesos (PhP2,000.00), or an


imprisonment for a period not exceeding thee (3) months, or such fine and
imprisonment at the discretion of the court;

c. For the third and succeeding offenses, a fine of Three Thousand Pesos (PhP3,000.00),
or an imprisonment for a period not exceeding three (3) months, or such fine and
imprisonment at the discretion of the court

SECTION 10. Liability under Other Laws. The foregoing penalties under this Ordinance shall
be without prejudice to any other liabilities under existing laws arising from or on the occasion
of the prohibited acts herein prescribed.

SECTION 11. Repealing Clause. Any ordinance, implementing rule or regulation or provision
thereof contrary to or inconsistent with this Ordinance or any provision hereof is hereby
repealed, amended or modified accordingly.

SECTION 12. Effectivity. This Act shall take effect after its publication in any newspaper of
general circulation.
