CIVIL PROCEDURE I
Course Outline & Reading List
(To be conducted by EWK & JK)
The subject will generally focus on how aggrieved parties to civil legal
disputes can resolve their disputes either through a formal court process or
alternative dispute resolution (ADR). The course is only sub divided into two
(the first part Covered in Semester 1 and 2 nd Part Covered in semester 2) not
because the applicable principles are wholly distinct but because the entire
course can’t be covered in one semester. Nevertheless, the part covered in
the 2nd semester is merely an extension of the introductory part covered in
the 1st semester of otherwise quite a number of legal principles may overlap.
The students must have mastered the powers of all the courts in the
structure of court system in Uganda, relevant documents to support any
proceedings, the time limits of taking particular steps in the proceedings
and how best to safe guard the interests of the clients, whether as
successful parties or unsuccessful parties in an election.
The specific aspects that must inter alia be appreciated are set out under
each topic/ sub topic on the reading list.
2.1 There are recent developments in the area of Civil Litigation including
impact of technology which had generated the need for amendment of
the Civil Procedure Rules in 2019-2020.
iii. The issues of challenges, areas for legal reform, reconciliation of the law
procedure and practice with the human rights concerns, shall equally be
considered
v. Each Student must possess a copy of the Reading Guide, the Civil
Procedure Act and the Civil Procedure Rules for every class. The
Students must read the other statutes referred to and the cases under
each topic in advance so as to be able to follow the discussion.
4.0 Authorities;
The law and rules applicable to civil procedure have been and continues

Introduction to the Law and Practice of Civil Procedure
To be considered; the law that regulates civil litigation/practice; the
distinction between Civil Procedure and Substantive law, the sources of
the law of Civil Procedure, and the applicable principles; interpretation

approach adopted by courts etc.;
