INTRODUCTION The development of crime counting rules is motivated by the need to standardise crime counting in the South African Police Service (SAPS). The crime counting rules are used by the SAPS during the recording and registration of crime. They will also apply to any circumstances of an incident of crime. A distinct or single or separate incident of crime can take any of the following formats: - Comprise of a single crime or a sequence of different crimes. - Be committed by a single offender or group of offenders. - Target a single victim or a group of victims. It is extremely important to have standards on how crime(s) of each incident are going to be counted. In determining the number of counts, every clearly distinct incident should be separately evaluated. AIM To standardise the counting of crime in the SAPS and align with international standards. OBJECTIVES The objectives of the crime counting rules are as follows: - To standardise rules regulating the way in which crime is counted + To outline the different stages regarding the timing of collecting crime data for statistical purposes - To standardise counting units regarding crime statistics - To standardise how multiple offences in an incident are counted - To standardise how an offence committed by more than one person is counted Crime Registrar Page 3132 Document No. X of 2019/2020 4, DEFINITIONS AND ACRONYMS. (1) DEFINITIONS (a) “Controt” means (a) depriving a victim of his or her freedom of movement; and (b) the power and ability to influence or direct the victim's behaviour. (b) “Counting rule” means the rules applied to count the offences that will be included in the crime statistics. (c) “Counting unit” means an entity of measurement used to determine the number of charges in respect of crime. (d) “Crime incident” means an event or happening that involves the transgression of the law. (e) “Crime statistics” mean statistical measurement of the crime in societies (universal) and in South African society (country-specific). (f) “Finished incident rule” means an incident comprising a sequence of the same type of crime committed by the same offender (or group of offenders) against the same victim should be counted as one count if reported to the police at the same time. However, if the offending resumes after coming to the police’s attention, further crimes are recorded as these come to the police's notice. BASIC PRINCIPLES OF CRIME RECORDING STANDARDS, The basic principles of crime recording standards in the SAPS are as follows: - All reports of crime, whether from victims, witnesses or third parties, will result in the registration of such crime by the police if: (a) The reported incident involves the following elements of crime, namely: * Legality (prohibited conduct) * Conduct (an act or failure to act) © Unlawiuiness + Culpability (intention or negligence) (b) The circumstances as reported amount to a crime as defined by the definitions of crime. (c) No credible evidence to the contrary is available. - Once recorded, a crime would remain recorded - unless credible evidence emerges to disprove that a crime had actually occurred. - Its important that the crime recording standards support a victim-focused approach to crime recording meeting the public's call for service. 6. WHEN TO COLLECT THE CRIME DATA FOR STATISTICAL PURPOSES The collection of crime data or statistics can happen at one of the following three different stages, namely: - The input stage: crime data are recorded for statistical purposes when the offence is reported to the police (or when police officers observe or discover an offence). - The intermediate stage: at some point in time between the input stage and the output stage (it could e.g. be after preliminary investigation). - The output stage: crime data are recorded when the police have completed their investigations. The SAPS took a decision to collect and record crime data at the input stage. Crime Registrar Version 0.1 __ Page 5/32 Document No. X of 2019/2020 ~ Crime Counting Rules One should expect that, all other things being equal ~ including, for example, the definitions of offence, the actual level of crime, the propensity to report and to record offences, as well as all other statistical, legal and substantive factors, countries using input statistics will present higher crime levels than countries using output statistics. 7. CRIME COUNTING UNITS AND RULES The following counting units and rules are applicable: 7.1GENERAL CRIME COUNTING RULES - Acrime incident is equals to one case docket. - Charges are counted on the basis of the incidents, perpetrators and victims. - The finished incident rule: An incident comprising a sequence of the same type of crime committed by the same offender (or group of offenders) against the same victim should be counted as one count if reported to the police at the same time. However, if the offending resumes after coming to the police's attention, further crimes are recorded as these come to the police’s notice. An incident involves the control of the victim or the victim's property by the perpetrator over a period of time. In an incident, control means (a) depriving a victim of his or her freedom of movement or exercising the rights of the victim in respect of his or her property; and (b) the power and ability to influence or direct the victim's behaviour. 7.2COUNTING UNIT AND RULES FOR CRIMES PERPETRATED AGAINST THE PERSON - Counting unit: The victim or perpetrator features as a counting unit if the crime is perpetrated against the person. - Counting rules — there are two rules that apply: + Sexual offences: one count per victim per perpetrator Crime Registrar Version 0.1 Page 6|32 Document No. X of 2019/2020 Crime Counting Rules The number of perpetrators who violated each victim should be counted and the totals for all the victims involved in that incident have to be added together to arrive at the total number of counts to be registered in respect of that case. ‘* Attempted murder: one count for multiple shootings that missed the person or persons. In an incident where there are injuries, each injured person should be counted as one count of attempted murder * Other victim based offences: one count for each victim violated by a single perpetrator or group of perpetrators These rules apply to crimes with specific, intended or identifiable victim(s). If more than one victim is violated in one incident, all victims will be counted. 7.3COUNTING UNIT AND RULES FOR PROPERTY-RELATED CRIMES Counting unit: The incident serves as a counting unit if property is the target of the crime. Counting rule: One count per incident. This rule applies to specific and identifiable incident of crime. With regard to robbery if: * there are victims assaulted during the robbery, only one count the robbery should be recorded and registered * there are murders and attempted murders committed during the robbery, count the murders and attempted murders in addition to the count of robbery 8. CRIME STATISTICS SYSTEM DESIGN This relates to how the system that is used to capture crime data is designed. This is strictly not a counting rule but is a critical component of the generation of crime statistics in the SAPS. Currently both CAS and ICDMS are designed in such a way that in a crime incident where there is more than one person involved the system does not link charges to specific victims and perpetrators. CRIME SCENARIOS 9.1 CRIMES PERPETRATED AGAINST THE PERSON CRIMES: Sexual offences + Rape + Attempted rape + Sexual assault + Incest Attempted murder + Attempted Other victim-based offences + Murder + Attempted murder * Assault (both assault GBH and common assault) + Abduction + Kidnapping + Trafficking in persons (TIP) + Compelling or causing children to witness sexual offences, sexual acts or seff-masturbation Crime Registrar Version 0.4 Page 8[32 * Document No. X of 2019/2020 _ Crime Counting Rules CRIME COUNTING RELATING TO ONE TYPE OF SEXUAL OFFENCE Scenario 01: Rape A girl is raped by two boys in a classroom at school. They leave her there. On the playing ground they meet a group of four boys and tell them that there is an opportunity for them to have sex with an “easy girl’ in the given classroom. The four boys are thereupon accompanied by one of the original rapists back to that classroom and all five rape the girl in question. Number of counts: Seven counts of rape (7 X rape) Note: One boy was involved in both incidents. Between the two incidents there was no control or influence over the movements of the girl. The first incident ended when the woman was released and regained her freedom of movement. The second incident started when the woman was deprived of her freedom of movement for the second time by five boys. Note: There are three separate incidents. Scenario 02: Rape ‘A girl is raped by two boys in a classroom at school. They leave her there. On the playing ground they meet a group of four boys and tell them that there is an opportunity for them to have sex with an “easy gi in the given classroom. The four boys are thereupon accompanied by one of the original rapists back to that classroom where he watches the four raping the girl in question. Number of counts: Six counts of rape (6 X rape) Note: There are two separate incidents. ‘Scenario 03: Rape Awoman is raped by seven males in a park and left lying under a tree. Five minutes later a completely unrelated group of three males notice her lying half-naked and decide to also rape her. Another male approaches the scene, notices what was happening and hides behind some bushes from Grime Registra Version 0.4 Page 9132 Document No. x of 2019/2020 Crime Counting Rules where he could observe the three suspects raping the woman. After these three had also left the scene, he approaches the victim and rapes her as well. Number of counts: 11 counts of rape (11 X rape) Note: There are three separate incidents. Scenario 04: Rape The victim is penetrated per anus and per vagina by the same offender. Number of counts: One count of rape (1 X rape) Scenario 05: Attempted rape ‘A. woman tries to undress a man in an office. The man overpowers her and ran away. Number of counts: One count of attempted rape (1 X attempted rape) Scenario 06: Sexual assault In one incident, all three suspects touch the breasts of two women. Number of counts: Six counts of sexual assault (6 X sexual assault) CRIME COUNTING RELATING TO ONE TYPE OF SEXUAL OFFENCE INVOLVING THE FINISHED INCIDENT RULE Scenario 07: Rape (The finished incident rule applies) A 15-year-old girl reports to Klipgat CSC that she had been raped by her stepfather over the period of a year. This always took place during the absence of her mother. She produces a diary in which she had been recording all the dates on which the rapes occurred. The dates are checked by the police member attending to the victim and he counts that she had been penetrated a total of 20 times according to the entries in the diary. Number of counts: One count of rape (1 X rape) Note: One perpetrator and one victim are involved. The other rapes were never reported to the police. Scenario 08: Rape (The finished incident rule applies) A gitl is raped by her stepfather two times in a month before the crime is reported to the police. Number of counts: One count of rape (1 X rape) Note: Only one rape was reported to the police. The other rape was never reported to the police and as such will not be counted. Scenario 09: Rape (The finished incident rule applies) A girl is raped by her stepfather two times in a month. The rape is reported to the police, but the father is not arrested. He rapes the girl again once during the following month. Number of counts: Two counts of rape (2 X rape) Note: In the first month, there was only one rape reported to the police. The other rape during the first month was never reported to the police and as such will not be counted. The second count of rape counted was the one that occurred during the following month and was also reported to the police. Scenario 10: Rape (The finished incident rule applies) A girl is raped by her stepfather two times in a month. The rape is reported to the police and the stepfather is arrested. He is released on bail. He rapes the girl once again while he was out on bail. The second one that occurred during the first month was never reported to the police and as such will not be counted. The second count of rape occurred after the perpetrator was released on bail Scenario 11: Sexual offence (The finished incident rule applies) A series of sexual assaults on a victim by the same suspect on numerous occasions over several years is reported for the first time. Number of counts: One count of sexual assault (1 X sexual assault) Scenario 12: Incest (The finished incident rule applies) Abrother and sister aged 21 years old and 24 years old respectively engage in sexual intercourse on several occasions for a period of two years. Their parents only discover after two years and report the matter to the police. Number of counts: One count of incest (1 X incest) CRIME COUNTING REGARDING ATTEMPTED MURDER TO INDIVIDUAL CRIME CATEGORIES Scenario 13: Attempted murder A man fires three shots at his girlfriend and her friend. Fortunately all the shots miss. Number of counts: Two counts of attempted murder (2 X attempted murder) Scenario 14: Attempted murder A perpetrator shots randomly at a crowd of people and miss all of them Number of counts: One count of attempted murder (1 X attempted murder) strar Version 0.4 Page 12/32 Document No. X of 2019/2020 Crime Counting Rules Scenario 15: Attempted murder Three perpetrators fire shots at people in a taxi and miss all of them Number of counts: One count of attempted murder (1 X attempted murder) Scenario 16: Attempted murder Multiple shots (e.g. 10) are fired at a crowd only one person is wounded Number of counts: One count of attempted murder (1 X attempted murder) Scenario 17: Attempted murder ‘Two perpetrators shot randomly into a crowd of people and miss all of them Number of counts: One count of attempted murder (1 X attempted murder) CRIME COUNTING REGARDING ONE TYPE OF OTHER VICTIM-BASED OFFENCES Scenario 18: Murder Three human bodies are found in a house with their hands tied behind their backs and gunshot wounds in to the head. Number of counts: Three counts of murder (3 X murder) Scenario 19: Assault (for both assault GBH and common assault) The victim is assaulted with a broomstick by one offender at location X, thereafter the victim flees from the offender. The offender chases him down the street and assault him again at another location, e.g. place Y. Number of counts: One count of assault (1 X assault) Note: There is only one incident because perpetrator always had control or influence over the movements of the victim. Number of counts: Ten counts of trafficking in persons for sexual purposes (10 X trafficking in persons for sexual purposes) Scenario 21: Compelling or causing children to witness sexual offences, sexual acts or self-masturbation A man and a woman have sexual intercourse in front of four children aged between 10 and 14 years. Number of counts: Eight counts of compelled or causing children to witness sexual offences, sexual acts or self-masturbation (8 X compelled or causing children to witness sexual offences, sexual acts or self-masturbation) CRIME COUNTING RELATING TO MULTIPLE OFFENCES AGAINST THE PERSON Scenario 22: Murder and attempted murder A gunman opens fire on a crowd of people in a hall - killing 10 and wounding 5, whilst 7 are unharmed. Number of counts: - 10 counts of murder (10 X murder) - counts of attempted murder (5 X attempted murder) Scenario 23: Rape and abduction A 14-year old girl and a 19-year old man agree to go to the man’s home to have sexual intercourse. At the man's home they are joined by three of his friends. The girl agrees to have sexual intercourse with one of the friends, who is 15 years old. The second friend, who is also 15 years old forces himseff on the girl. The third friend who is 20 years old also forces himself on the girl. Crime Registrar Version 0.4 Page 14132 * Document No. X of 2019/2020 Crime Counting Rules Number of counts: = One count of abduction (1 X abduction) - Two counts of rape (2 X rape) Note: * Aminor is abducted in order to have sexual intercourse * There is no crime between the 14-year old girl and the 15-year old boy Scenario 24: Rape and kidnapping ‘A woman is forced into a car by four males. They drive for a kilometre and stop near a bush. They all rape her in the car. After an hour they continued driving to one of the suspect's house and all raped her several times throughout the night. She is then driven to the main road and released. Number of counts: - Four counts of rape (4 X rape) - One count of kidnapping (1 X kidnapping) Note: There is only one incident because the perpetrators always had control over the movements of the victim until the time she was released. Scenario 25: Rape and kidnapping ‘A woman is forced into a car by four males. They drive for a kilometre and stop near a bush. They all rape her in the car. After an hour they continue driving to one of the suspect's house and all rape her several times throughout the night. She is then driven to the main road and released. In the afternoon of the same day the same perpetrators meet the same victim ‘on the road on her way from the hospital. The woman is ordered to enter into the car and is taken to the same house and again raped by the same perpetrators. Number of counts: - Eight counts of rape (8 X rape) - Two counts of kidnapping (2 X kidnapping) Note: There are two incidents in the scenario, The first incident ended when the woman was released and regained her freedom of movement. Crime Registrar Version 0.1 Pa ye 15132 Document No. X of 2019/2020 - Crime Counting Rules The second incident started when the woman was deprived of her freedom of movement for the second time while coming from the hospital. Scenario 26: Rape, kidnapping and intimidation ‘A. woman is forced into a car, by four males. They drive for a kilometre and stop near a bush. They all rape her in the car. After an hour they continue Griving to one of the suspect's house and all rape her several times throughout the night. She is then driven to the main road and released. Before releasing the woman, she is threatened to return to the same house later in the evening or her family will be killed. The woman retum to the same house without reporting the incident to anyone. The woman is again raped by the same perpetrators and only released in the morning. Number of counts: - Four counts of rape (4 X rape) ~ One count of kidnapping (1 X kidnapping) ~ One count of intimidation (1 X intimidation) Note: This is regarded as one incident, because even after being released, the woman believed that the perpetrators will kill her family if she fails to go back, i.e. the perpetrators had control over her actions as indicated in scenario 2 above. She was still acting under their control, even in their absence. Scenario 27: Rape, kidnapping and intimidation ‘A boy meets a girl from the school on the street, takes her to his room and rape her three times overnight, In the moming he lets her bath and releases her to go to school after threatening to kill her if she reports the crime or does not come back to his place after school. The girl attends school and after school goes straight to the suspect's place where she is raped again before being allowed to go home. Crime Counting Rules Scenario 28: Rape and kidnapping ‘Aman is walking along the street when he comes across two females who drag him into their car. The suspects then drive to one suspect's house. When they arrive at the house they lock the man inside the house and rape him three times each before leaving him. On the following day they both go to the same house and again rape the man once each Number of counts: - Two counts of rape (2 X rape) - One count of kidnapping (1 X kidnapping) CRIME COUNTING RELATING TO MULTIPLE OFFENCES AGAINST THE PERSON INCLUDING THE FINISHED |NCIDENT RULE Scenario 29: Rape and kidnapping (The finished incident rule applies) ‘A lady is kidnapped and kept in a brothel where different males are allowed to have sexual intercourse with her against her consent upon payment to the brothel owner. One male visits the brothel on three consecutive days and after paying is provided access to the same lady and has sexual intercourse with her against her consent. Number of counts: = One count of rape (1 X rape) = One count of kidnapping (1 X kidnapping) Note: The one count of rape is for the identified perpetrator, while additional counts should be added once the other perpetrators are identified. Number of counts: Four counts of robbery at business premises — with weapon or instrument other than firearm (4 X robbery at business premises — with weapon or instrument other than firearm) Scenario 31: Robbery A group of four people carrying firearms rob a firearm business of 50 firearms and 100 rounds of ammunition. Number of counts: One count of robbery at business premises ~ with a firearm (1 X robbery at business premises ~ with a firearm) Note: The firearms can still be circulated. Scenario 32: Robbery During a bank robbery, five clients standing in a queue are also robbed. Number of counts: One count of bank robbery (1 X bank robbery) Scenario 33: Robbery A truck transporting five motor vehicles is robbed. Number of counts: One count of robbery of truck — with cargo (Truck jacking) ((1 X robbery of truck — with cargo (Truck) Note: The motor vehicles can still be circulated. Number of counts: One count of robbery of motor vehicle - with a firearm (Carjacking) ((1 X robbery of motor vehicle — with a firearm (Carjacking)) Scenario 35: Robbery ‘Two women rob another two women of their handbags without any weapon. Number of counts: One count of common robbery (1 X common robbery) Scenario 36: Burglary A house rented jointly by three tenants is burgled. The tenants inhabit different parts of the house, but each part is not separately lockable. Number of counts: ‘One count of burglary at residential premises (1 X burglary at residential premises) Scenario 37: Attempted burglary ‘Asshop owner discovers that one of the corrugated irons of the roof has been removed and the ceiling tampered with, but nothing is missing from the shop. Number of counts: One count of attempted burglary at business premises (1 X attempted burglary at business premises Scenario 38: Arson ‘Two suspects set fire to one shack in an informal settlement, The fire spreads to 21 more shacks owned by different people. Number of counts: One count of malicious damage to property (1 X malicious damage to property) Scenario 40: ATM bombing A group of individuals bombs a standalone ATM. Number of counts: One count of ATM bombing (1 X ATM bombing) Scenario 41: ATM bombing and ATM grinding A group of two men and one woman bombed an ATM at a filing station and move to the shopping centre across the road to grind an ATM. Number of counts: - One count of ATM bombing (1 X ATM bombing) - One count of ATM grinding (1 X ATM grinding) Scenario 42: Theft of motor vehicle A chassis of a motor vehicle is stolen from a scrapyard. Number of counts: One count of theft of motor vehicle (1 X theft of motor vehicle) Scenario 43: Theft of truck Three trucks owned by the same owner are stolen whilst parked at a construction site. ‘Number of counts: One count of theft of truck (1 X theft of truck) Note: The three trucks can still be circulated. Scenario 44: Stock theft A syndicate steals six herd of cattle from one kraal in a village. Number of counts: One count of theft out of and from motor vehicle (1 X theft out of and from motor vehicle) Scenario 46: Theft of critical infrastructure An electrician working for Eskom discovers that a 12m electrical cable was missing. Number of counts: One count of theft of critical infrastructure (1 X theft of critical infrastructure) Scenario 47; Illegal mining Four men aged between 22 and 35 are arrested at a closed shaft for illegal mining. Number of counts: One count of illegal mining (1 X illegal mining) CRIME COUNTING RELATING TO ONE TYPE OF PROPERTY -— RELATED CRIMES INVOLVING THE FINISHED INCIDENT RULE Scenario 48: Malicious damage to property (The finished incident rule applies) A victim reports for the first time that her house has been damaged on five occasions by the same people.
