28/08/2014 Exhibit "A." is the copy Registered Irrevocable
Power of Attorney dated 28-08-2014 executed by
accused Smt. Sonal Bimal Bhatt in favour of Smt.
Sandhya Pradip Vakil effectively relinquishing her
rights with respect to agricultural land properties
from sr.no. 1 to sr.no. 15 of village: Ambivali,
Taluka : Panvel bearing serial no. PVI- 4352/2014
registered at Sub-Registrar office, Panvel- I on
payment of stamp duty of Rs.4,30,50O/- . The said
Power of Attorney gave Sandhya Vakil complete
and unfettered rights to sell the propert5r as per
her own sweet wish and choice and further gave
her the authority to even collect the proceeds from
the sale.

comprising of 56 gunthas situated at Village
Ambivali, Tal. Panvel, Dist. Raigad were sold by
Accused Smt. Sonal Bimal Bhatt through her
constituted attorney Smt. Sandhya Pradeep Vakil
to Ms. Janhavi fradip Vakil @ Janhavi Aditya
Bhatt by executing a registered agreement for sale
without possession dated 05-11-2O14 with respect
to two properties. However due to lis-pendens
remark in Regular Civil Suit no.I35/2OAB pending
before Hon''ble Court of Civil Judge Junior
Division at Panvel the name on the 7 /I2 extracts
concerning these two properties could not be
transferred to Ms. Janhavi Pradip Vakil @ Janhavi
Aditya Bhatt and constructive possession of said.

Sonal Bimal Bhatt. The name of the 7 /12 extract
of the remaining 13 properties was transferred to
the name of the Intervener in 2014 itself.

The Interwener f First Informant most respectfully submits as under:-

1. It is submitted that the Intervener is the first informant and the


original complainant who has given her written complaint which is
taken cognizance by Panvel Taiuka Police Station by registering the
FIR No, l-L32 of 2O2O u/s. 42O IPC against accused namely Mrs.
Sonal Bimal Bhatt dated 17 / Og /2O2O.

2 It is submitted that the intervener being a first informant in the


present FIR against the Accused Smt. Sonal Bimal Bhatt would like to
intervene and oppose the anticipatory bail application filed by the
t Smt. Sonal Bimal Bhatt for seeking pre-arrest bail in the
lodged against her at behest of the intervener

3. It is submitted that the Intervener is seeking permission of the
Hon"ble Court for intervening for the purpose of assisting the Ld.
Government Pleader State of Maharashtra through Public Prosecutor
on merits as the materials which are necessary for deciding the
application of the Applicant are within the exclusive knowledge of the
Intervener who would eflectively demonstrate the modus operandi of
the Applicant Smt. Sonal Bimal Bhatt.

4. It is further submitted that the Applicant Smt. Sonal Bimal Bhatt has
inspite of all knowledge that Intervener has ownership rights over the
said properties which are subject matter of FIR dishonestly sold these
2 plots of land to third party only for monetary gain and caused
wrongful loss to Intervener. .

5. It is submitted that Registered Irrevocable Power of Attorney dated


28-OA-2O14 was executed by Applicant Smt. Sonal Bimal Bhatt in
favour of Smt. Sandhya Pradip Vakil effectively relinquishing her all
rights with respect to agricultural land properties i.e. total l5
properties witl: 7 / 12 extracts situated at village: Ambivali, Taluka :
Panvel bearing serial no. PVL-4352 /2O14 registered at Sub-Registrar
office, Panvel- 1 on payment of stamp duty of Rs.4,30,500/-. The said
Power of Attorney gave Sandhya Vakil complete and unfettered rights
to sell the property as per her own sweet wish and choice and further
gave her the authority to even collect the proceeds from the sale.

6. It is submitted that pursuant to the above Irrevocable Po wer o


Attorney 13 properties out of total 15 properties were transferred 6y
the Applicant Smt. Sonal Bimal Bhatt through her constituted
attorney Smt. Sandhya Pradip Vakil in the name of the Intervener
from time to time and all the 7 /12 extracts of the 13 plot of lands bear
the name of the Intervener duly entered on the strength of register*,i/
@ agreements between both the parties.

7. However, there was a notice of Lis-Pendens in remark column of 7 I 12


extracts of the remaining 2 plot of lands out of these, 15 properties, so
a registered Agreement for Sale without possession dated 05-11-2014
transferring and selling these two properties was executed by
Applicant Smt. Sonal Bimal Bhatt through her constituted attorney in
favour of the Intervener due to which although the ownership was
transferred to the Intervener, however the name of the Applicant Smt.
Sonal Bimal Bhatt remained in the 7 / 12 extracts of these 2 properties
due tc the mutation entry of term notice of lis-pendens in Regular
Civil Suit no.l35l2OO8 pendiirg before Honble Court of Civil Judge
Junior Division at Panvel entered in it.

8. It is submitted that the Agreement for Sale without possession dated


05-11-2014 of these 2 plots of land situated at village: Ambivali,
Taluka: Panvel comprising of 56 gunthas was executed by the
Applicant through the constituted attorney Smt. Sandhya Pradip Vakil
in name of the Intervener for a sale consideration of Rs.'15,00,0OO1-
bearing serial no. PVL1-538O-2014 registered at Joint Sub-Registrar
',};. , oflice, at Panvel on payment of stamp duty fee of Rs.75,000 /-&

registered with Sub-Registrar on dated 05-11-2014 is marked as
a\: cExhibit- B" .

9. Further, It is submitted that taking advantage of the fact that though


the ownership was transferred, the constnrctive possession remained
with the accused. Inspite of giving Irrevocable Power of Attorney to her
attorney holder namely Sandhya Pradip Vakil and transferring the
said two properties to the Intervener, the accused Mrs. Sonal Bhatt
with dishonest intention to cheat and cause wrongful loss to the
Intervener sold these 2 properties in question for consideration price
of Rs.8O,O0,000/- and executed registered sale deed bearing no.
PVLl3935/2O19 with one Mr. Hirji Parbat Gada on 12/04/20L9; thus
gaining unlawfully. This fact came to the knowledge of the intervener
and immediately she complained about wrongful loss caused to her
and thus the present FIR no. I-132 of 2O2O came to be registered
against the Applicant Mrs. Sonal Bimal Bhatt.

10. Intervener submits that the Applicant Mrs. Sonal Bimal Bhatt
anticipating her arrest filed a Criminal Bail Application no. 227 of.

2020 before the Honble District & Sessions Judge Shri. R.G.Asmar for
seeking anticipatory bail. However during pending of hearing of the
application, neither the Applicani nor her Advocate appeared in the
matter, hence, the previous bail applicatio., *"" disposed of for want
of Prosecution as ordered by the Hon'ble Court. The Intervener had
filed intervention application through her Advocate and was permitted
to intervene in the matter

11. The Applicant Mrs. Sonal Bimal Bhatt filed Criminal Baii
Application no. 175 of 2O2l before the Hon"ble Adhoc District &
Sessions Judge -2 Shri. N.B.Lavate. Hence, the Intervener filed
application for transfer of said criminal bail application from the Court
of J Shri. N.B.Lavate to the Court of J Shri. R.G.Asmar before the
Hon'ble Court of Principal District Judie J Smt. Vibha Ingle at Alibaug
and accordingly the Transfer Petition was allowed and thus the same
Bail application was directed to be transferred before J. Smt. Madhuri
Anand. That the Intervener through her Advocate has filed the
vakalatnama in the present matter which is on record. Even the
counsel of the Intervener Adv. Kiran Kulkarni has appeared before the
Ld Court of Shri. N.B.Lavate and opposed the grant of interim relief.

12. It is submitted that till the lodging of the FIR the allegations
against Applicant Mrs. Sonal Bimal Bhatt was u/s. 42A IPC that
despite of giving Irrevocable Power of Attorney to her attorney holder
namely Sandhya Pradip Vakil and transferring the said two properties
to the Intervener, the applicant Mrs. Sonal Bimal Bhatt with dishonest
intention to cheat caused wrongful loss to the Intervener and sold
these 2 properties in question for consideration price of
Rs.80,00 ,OOO l- and executed registered sale deed bearing
no.PVLl393512O19 with one Mr. Hirji Prabhat Gada on 12/0412019
and thus duped the Intervener.

13. It is pertinent to note that earlier a bogus Sale Deed dated


3112/2012 was executed with respect to said properties.by one lady
namely Ravindra Kaur Jagjitsingh Bhatia impersonating herself as
fake Accused Mrs. Sonal Bimal Bhatt. So, notarised lrrevocable Power
of Attorney dated 15/1012013 was signed by Accused Smt. Sonal
Bimal Bhatt in favour of Smt. Sandhya Pradeep Vakil relinquishing
her rights and accordingly Sandhya Pradip Vakil lodged a criminal
complaint for cheating, impersonation and fabrication of forged
documents against all the offenders. Subsequently, the cancellation
deed dated 21/O1/2O14 was registered between Applicant Smt. Sonal
Bimal Bhatt through her power of attorney holder Mrs. Sandhya
Pradeep Vakil and one person namely Namdev Gangaram Shingade
bearing registration no. PVL4/779/20L4 executed at office of
Sub-Registrar of Panvel for cancellation of forged documents

L4. That the contents of the said notarised Power of Attorney dated
l5ll0l2}13 are self-explanatory stating that Applicant Smt. Sonal
Bimal Bhatt was merely entrusted as authorised representative on
behalf of Vatsa Builders Ltd. and she was never a owner of those 15
properties & as such her claim that she has not receive Sale
consideration money out of sale of two properties under subject of the
present FIR loses its significance; further the act of selling to a third
party without the knowledge of her power of attorney holder Smt.
Sandhya Pradeep Vakil or without obtaining consent of the Intervener
who has purchased those properties, thus amounts to causing
criminai breach of trust in capacity of accused acting as authorised
agent had wrongly entered. her name in 7/12 extracts and deceived
the Intervener and Sandhya Vakil of Vatsa Builders R/t ltd. A copy of
the notarized Power of Attorney notarized on 15.10.2013 is annexed
hereto and marked as Exhibit- 'CD. The Cancellation Deed duly
registered 17 .O1.2014, which is registered based on the above referred
notarized power of attorney, and of which the notarized power of
attorney is an integral part is annexed hereto and marked as Exhibit-
3.Drr.

15. Thus she was entrusted with properties on behalf of Vatsa Builders
in her capacity as agent has already acknowledged it by herself
signing and getting notarised Irrevocable Power of Attorney dated
L5/1O12O13, but later inspite of registering Agreement for Sell
(without possession) on 5/11 l2OL4, the Applicant Smt. Sonal Bimal
Bhatt dishonestly by way of misrepresentation pretending herself as
owner based on her name on 7 /12 extracts of the said property
fraudulently executed Sale Deed dated 12/4/2O19 with one Shri Hirji
Prabhat Gada without knowledge and consent of intervener &
followed due process of law for cancelling the Irrevocable

Attorney given to her constituted Attorney nor initiated ariy
proceedings in the Court of Lavr for purpose of cancellation
Agreement for Sale (without possession) dated 5 / 1l /2Ola; thus
wrongfully gained Rs. 80 lakhs as consideration amount.
16. It is submitted that after the fraudulent sale of the property by thuz
accused by alleged sale deed dated 12/0412019, the Intervener has
taken the copies of 7l12 extracts of said two properties which are the
subject matter of FIR from the revenue officer on dated llloT/2019
and it was still found that the name of Applicant Smt. Sonal Bimal
Bhatt was existing and due to the remark of notice of Lis-pendens
name of Ms. Janhavi Pradip Vakil, now Janhavi Aditya Bhatt i.e. the
Intervener cannot be reflected on the same. Thus, the Applicant who
was holding the property in trust took advantage of this situation and
got executed and registered a fraudulent sale of the property already
transferred to the Intervener and subsequent to such fraudulent sale
in order to cover her tracks further erred in seeking cancellation of the
Power of attorney on February, 2021 without following procedure of
law.
The copies of 7/L2 extracts of said two properties dated 11/O7l2ol9
is marked as "Exhibit- E' .

17. It is submitted that the Applicant Smt. Sonal Bimal Bhatt in


conspiracy with others acting in her capacity as agent was entrusted
with the property belonging to Vatsa Builders Ltd but still got her
name reflected in 7 /12 extracts of the said properties. These
properties were conveyed by Irrevocable Power of Attorney dated
l5lLO/2013 and 28/08/2O14 coupled with Agreement for Sale dated
05/ 1 I l2OL4 duly executed by the Appticant Smt. Sonal Bimal Bhatt,
but inspite of all knowledge and only with sole intention to cheat and
gain wrongfully, the Applicant sold the two plots of land in
L2l04l2019, thus the provisions of Sec. 4O9,406IPC for commission
of criminal breach of trust by agent is applicable to the applicantrf w.
42O IPC and the role of doing fictitious transactions by the Applicant
Smt. Sonal Bimal Bhatt has to be investigated by seeking custodial
interrogation of the Applicant as iight, title & interest of Intervener
has been transferred to a third party by the applicant without
knowledge of intervener causing wrongful loss to the intervener/first
informant.

18. Thus considering aforesaid facts and circumstances as narrated


above, the Intervener is a victim and being the first informant in
lodging FIR is most directly and substantially affected, she should be
allowed to prosecute in the first instance.
19. It is further submitted that though Police have taken cognizance of
the case- based on information given by lst informant & begin the
investigation does not in any way mean that informant is wiped out
from the scenario.
2A. The Intervener states that the present Applicant must be made
accountable for her illegal activities through which she has earned
illegal gain amonting to lakhs of Rupees.
2I.- The Interyener states that the Intervention be allowed as there is
no bar prohibiting such action on the part of the Intervener. Needless
to add that it is well settled law that in procedural law anything which
is not prohibited could be allowed in the interest of justice.
22. The Intervener states and submits that this Hon'ble Court has
jurisdiction to entertain the present application.
23. The Intervener states and submits that unless the reliefs as
prayed for are granted in favor of the Intervener, irreparable harm,
injustice and great prejudice would be caused to the Intervener.
24. The Intervener states and submits that the Intervener has not filed
any other Application praying for the same reliefs before this Honhle
Court or the Supreme Court in India or any other Court in India.
25. The Intervener craves leave of this Hon'ble Court to add to, alter,
amend, modify any of the aforesaid ground, if need be, with the
permission of this Honorable Court.
26. The Intervener states that he has approached this Honorable Court
as expeditiously as possible and there is no delay in filing the present
Application.

0r 27. The Intervener states and submits that there is no other alternatirLz
and efficacious remed-v but only to approach this by way of this
Application.

28. Therefore in light of above considering aforesaid facts &


circumstances and in the interest of justice the Intenrener/first
informant PRAYS that this Hon"ble court may be pleased to :-

(a) Thatthis Honble court be pleased to allow the present lntervention


Application and make the Intervener f First Informant a party to the
proceedings,
(b) That this Honble Court be pleased to allow the Intervenerf First
Informant to make oral submissions as well as written submissions at
the time of arguments;
(c) Pass any other orders as this Hon"ble court deems fit in the
interest ofjustice.
