READ LIBRARY CAREFULLY, note key items (e.g. key elements to a statute, legal
rules in cases, etc.) in the margins or by marking up the documents.

Go down to the case analysis and find your POINTS (e.g. An FMLA action needs
four things to be maintained: (1) a parent or someone standing in loco parentis, (2)
meow meow, (3) meow meow meow, (4) meow meow meow meow.)

Drop those down and make them into CONCLUSORY statements (e.g. Ms.
Waltersons' grandma was a parent within the meaning of FMLA section § 200 as she
stood in loco parentis to her granddaughter)

STATUTE FIRST – RULES OF LAW

CASE PROOFS SECOND.

APPLICATION (Here, in the instant case, etc) basically COMPARE your case facts
to the STATUTES AND CASES.

Then possible counter-argument (it could be argued that...)

Then a likely conclusion for memo's (Therefore, it is likely that....)

REMEMBER sample answers have STRONG opening sentences on each


paragraph

1. review the task memo ( 5 minutes)


2. Setup outline (5 minutes)
 Include introduction, conclusion, macro headings
 If document that will provide organizing principles. (eq: letter, motion)
3. Skim file (5 minutes)

4. Skim and read the library (15 minutes)

 Read each case with purpose


 Focuse on the analysis of each case
 Assign cases to appropriate issues
 Identify where to draft a rule explanations/ case explanations / rule proofs
5. Draft rules, rule explanations (15 minutes)

 In (case name) the court held (holding) bc (facts + reasoning)


6. Read Library (15 minutes)

7. Write analysis (25 minutes)

8. Proofread ( 5 minutes)
