Definitions
Aplace from where the business is ordinarily carried on, and includes a
warehouse,a god ownor any other place where a taxable person
his goods, supplies or receives goods or services or both or
aplace where a taxable person maintains his books of account; or
a place where a taxable person is engaged in business through an agent
by whatever name called
The definition of term place of business is inclusive. Thus, the places 0r
locations listed in the definition are illustrative and not exhaustive. From the
definition it can be seen that clause makes a reference to "taxable person
Therefore,place of business should be understood as a term that is specitic to
each taxable person, having (or requiring) distinct registrations.
2(86) Place of Supply "Place of supply means the Place of supply as referred to in chapter V of the
Integrated Goods and Services Tax Act.
The termn place ofsupply is very important to determine whether a supply is
interstate supply or intrastate supply which in turn is necessary to determine
the nature of tax payable. Chapter V of the IGST Act provides for
determination of the Place of supply' in respect of any supply of goods or
supply of services.
2(90) Principal Supply "Principal supply" means the supply of goods or services
Which constitutes the predominant element of a composite supply, and
To which any other supply forming part of that composite supply is
ancillary.
2(98) Reverse Charge "reverse charge" means the liability to pay tax by the recipient of supply of
goods or services or both instead of the supplier of such goods or services or
both under Section 9(3) /(4), or under Section 5(3)/(4) of the Integrated Goods
and Services Tax Act.
119) Works Contract "Works contract" means acontract for -
building,
construction,
fabrication,
completion,
erection,
installation,
fitting out,
improvement,
repair,
maintenance
renovation,
alternation or commissioning of any immovable property wherein
transfer of property in goods (whether as goods or in some othe Form) is
involved inthe execution of such contract.
