Explanation of the Nine FOIA Exemptions

The following is a list of FOIA exemptions which apply to Government information in


accordance with 5 U.S.C. § 552(b):

(b)(1) EXEMPTION – Protects Classified Matters of National Defense or Foreign Policy.


This exemption protects from disclosure national security information concerning the national
defense or foreign policy, provided that is has been properly classified in accordance with the
substantive and procedural requirements of an executive order.

(b)(2) EXEMPTION – Internal Personnel Rules and Practices.


This exemption exempts from mandatory disclosure records “related solely to the internal
personnel rules and practices of an agency.” Courts have interpreted the exemption to encompass
two distinct categories of information:
(a) Internal matters of a relatively trivial nature – sometimes referred to as “low2”
information: and

(b)(3) EXEMPTION – Information Specifically Exempted by Other Statues:


This exemption incorporates the disclosure prohibitions that are contained in various other
federal statutes. As originally enacted in 1966, Exemption 3 was broadly phrased so as to simply
cover information “specifically exempted from disclosure by statute.” The new Exemption 3
statute prohibits agencies from releasing under the FOIA proposals,” unless that proposal” is set
forth or incorporated by reference in a contract entered into between the agency and the
contractor that submitted the proposal.”

(b)(4) EXEMPTION – Trade Secrets Commercial of Financial Information.


This exemptions protects “trade secrets and commercial or financial information obtained from a
person (this is) privileged or confidential.” This exemption is intended to protect the interest of
both the government and submitter of information.

(b)(5) EXEMPTION – Privileged Interagency or Intra-Agency Memoranda or Letters.


This exemption protects “inter-agency or intra-agency memorandums of letters which would not
be available by law to a party… in litigation with the agency.” As such, it has been construed to
“exempt those documents, and only those documents, normally privileged in the civil discovery
context.”

(b)(6) EXEMPTION- Personal Information Affecting an Individual’s Privacy.


This exemption permits the government to withhold all information about individuals in
“personnel and medical files and similar files” when the disclosure of such information “would
constitute a clearly unwarranted invasion of personal privacy.” This exemption cannot be
invoked to withhold from a requester information pertaining to the requester.

(b)(7) EXEMPTION – Investigatory Records Compiled for Law Enforcement Purposes.


As amended, this exemption protect from disclosure “records or information compiled for law
enforcement purposes.
EXEMPTION 7(A) Records of information that could reasonably be expected to interfere
with enforcement proceedings. This exemption authorizes the withholding of “records or
information compiled for law enforcement purposes, but only to the extent that
production of such law enforcement records or information… could reasonably be
expected to interfere with enforcement proceedings.”

EXEMPTION 7(B) Disclosure which would deprive a person of a fair trial or an


impartial adjudication. Records that would prevents prejudicial pretrial publicity that
could impair a proceeding, protect “records of information compiled for law enforcement
purposes (the disclosure of which) would deprive a person of the right to a fair trial or an
impartial adjudication.”

EXEMPTION 7(C) Personal Information in Law Enforcement Records. This exemption


provides protection for personal information in law enforcement records. This exemption
is the law enforcement counterpart to Exemption 6, providing protection for law
enforcement information the disclosure of which “could reasonably be expected to
constitute an unwarranted invasion of personal privacy.”

EXEMPTION 7(D) Identity of a Confidential Source. This exemption provides protection


for “records or information compiled for law enforcement purposes (which) could
reasonably be expected to disclose the identity of a confidential source – including a
State, local or foreign agency or authority or any private institution which furnished
information on a confidential basis – and, in the case of a record or information compiled
by a criminal law enforcement authority in the course of a criminal investigation, or by an
agency conducting a lawful national security intelligence investigation, information
furnished by a confidential source.”

EXEMPTION 7(E) Circumvention of the Law. This exemption affords protection to all
law enforcement information which “would disclose techniques and procedures for law
enforcement investigation or prosecutions, or would disclose guidelines for law
enforcement investigations or prosecutions if such disclosure could reasonably be
expected to risk circumvention of the law.”

EXEMPTION 7(F) Physical Safety to Protect a wide Range of individuals. This


exemption permits the withholding of information necessary to protect the physical safety
of a wide range of individuals. Whereas Exemption 7(F) previously protected records that
“would… endanger the life or physical safety of law enforcement personnel.” The
amended exemption provides protection to “any individual when disclosure of
information about him or her “could reasonably be expected to endanger (his/her) life or
physical safety.”

(b)(8) EXEMPTION – Records of Financial Institutions.


This exemption covers matters that are “contained in or related to examinations, operating, or
condition reported prepared by, on behalf of, or for the use of an agency responsible for the
regulation or supervision of financial institutions.”

(b)(9) EXEMPTION – Geographical and Geophysical Information Concerning Wells.


This exemption covers “geological and geophysical information and data, including maps
concerning wells.”

EXECUTIVE SUMMARY
1. This reactive investigation was initiated on 28Junl9 following receipt
of information from US Air Force Office of Special Investigations (AFOSI)
regarding a possible sexual assault that allegedly took place in 200G at a
Naval Clinic aboard Camp Life Support Area (LSA), Kuwait. The incident
involved deceased civilian World Wrestling Entertainment (WWE) personality
Ashley MASSARO. As background, in an affidavit signed prior to her death
pertaining to her lawsuit against the WWE, MASSARO claimed that while on a
USO tour to Kuwait in "2007", she was taken to a medical facility to be
treated for dehydration and/or (b)(6), (b)(7)(C) and was subsequently "raped" and
"sodomized" by an individual she believed to be an active duty military
physician while an unknown female stood guard. AFOSI and US Army Criminal
Investigation Division (USACID) conducted initial inquiries into the
allegations and provided results of their investigation to NCIS. An
interview of MASSARO's attending physician was conducted. An unsuccessful
attempt to locate the alleged crime scene was conducted. All logical
investigative leads have been exhausted. To date, no subject, scene, or
witnesses have been identified. The reported victim is deceased, and no
prosecutorial venue exists within the NCISRU Corpus Christi, TX area of
responsibly. This case is closed.

1. This reactive investigation pertains to suspected violations of Article
120 (Sexual Assault) of the Uniform Code of Military Justice (UCMJ) or Title
18 U.S.C. 2242 (Sexual Abuse). On 24Mayl9, the Air Force Office of Special
Investigations (AFOSI) initiated an investigation into this allegation.
Additionally, Army CID has conducted investigative activity pertaining to
this investigation. However, on 28Junl9, NCIS assumed primary investigative
authority.

2. Subsequent to the submission of Reference (E), on 24Jan20, a review of


Ashley MASSARO's medical record was conducted by CDR (b)(6), (b)(7)(C) MC, USN,
OB/GYN Speciality Leader, BUMED. The record review did not indicate anything
indicative of the allegations of sexual assault provided by MASSARO. Exhibit
(15) provides amplifying details.

3. All logical investigative leads have been exhausted. To date, no


subject, scene, or witnesses have been identified. The reported victim is
deceased, and no prosecutorial venue exists within the NCISRU Corpus
Christi, TX area of responsibly. This case is closed.

1. This reactive investigation was initiated on 28Junl9 following receipt
of information from US Air Force Office of Special Investigations (AFOSI)
regarding a possible sexual assault that allegedly took place in 2006 at a
Naval Clinic aboard Camp Life Support Area (LSA), Kuwait. The incident
allegedly involved deceased civilian World Wrestling Entertainment (WWE)
personality Ashley MASSARO. As background, in an affidavit signed prior to
her death pertaining to her lawsuit against the WWE, MASSARO claimed that
while on a USO tour to Kuwait in "2007", she was taken to a medical facility
to be treated for dehydration and/or (b)(6), (b)(7)(C) and was subsequently
"raped" and "sodomized" by an individual she believed to be an active duty
military physician while an unknown female stood guard. AFOSI and US Army
Criminal Investigation Division (USACID) conducted initial inquiries into
the allegations and provided results of their investigation to NCIS. An
interview of MASSARO's attending physician was conducted. An unsuccessful
attempt to locate the alleged crime scene was conducted. To date, no
subject, scene, or witnesses have been identified. The alleged reported
victim is deceased and no prosecutorial venue exists within the NCISRU
Corpus Christi, TX area of responsibly. This case is pending additional
coordination with BUMED.

3. On 15Augl9, NCISRA Great Lakes conducted an interview of (b)(6), (b)(7)(C)


(b)(6), (b)(7)(C) USN at the Federal Health Care Center, Naval Station Great
Lakes. (b)(6), (b)(7)(C) stated she had no knowledge of the Naval Clinic aboard
Camp Life Support Area, Kuwait. (b)(6), (b)(7)(C) said she was in Kuwait assigned
to the EMF Kuwait, Camp Pendleton Attachment from 19Feb06 to 19Aug06.
(b)(6), (b)(7)(C) said after arriving in Kuwait she was processed in country at the
main hospital located at Camp Arifjan. While there, she was assigned to Camp
As Sayliyah's (UIC 40250) and transported to Qatar. After her six-month tour
was completed, she was processed out through Camp Arifjan. (b)(6), (b)(7)(C) said
Qatar was a 2-3 hours away from Kuwait and had no knowledge of the events
that took place there. Exhibit (9) pertains.

4. On 26Augl9, Mr. (b)(6), (b)(7)(C) Esquire, K&L Gates LLP, was interviewed.
(b)(6), (b)(7)(C)represents the World Wrestling Entertainment Inc. (WWE) who was the
former employer of Ashley MASSARO, Civ. (b)(6), (b)(7)(C) was unable to provide any
additional documents relevant to captioned investigation. Exhibit (10)
Provides amplifying details.

5. On 22Augl9, (b)(6), (b)(7)(C) USN, was interviewed and stated she was
deployed to Kuwait for approximately six months from February 2006 to August
2006. While in Kuwait, (b)(6), (b)(7)(C) claimed she never worked at a Camp Life
Support and was not familiar with that camp. (b)(6), (b)(7)(C) stated she never
attended any USO events and said that Montgomery Gentry, a country band is
the only celebrity visitor she remembers seeing while in Kuwait. (b)(6), (b)(7)(C)
declared she was not familiar with Ashley MASSARO and had no knowledge of
MASSARO's alleged sexual assault. Exhibit (11) pertains.

6. On 27Augl9, NCISRA Camp Pendleton, CA, interviewed (b)(6), (b)(7)(C)


USN, Naval Hospital Camp Pendleton (NHCP), CA, regarding her knowledge of
the details and circumstances surrounding captioned investigation. (b)(6), (b)(7)(C)
relayed she was stationed onboard Camp Arifjan, Kuwait, circa 2006-2007, but
she had no recollection of any civilians affiliated with World Wrestling
Entertainment (WWE) that may have received treatment at the base aid station
(BAS). (b)(6), (b)(7)(C) provided amplifying details about medical facilities
onboard Camp Arifjan; Exhibit (12) pertains.

7. On 03Sepl9, LT (b)(6), (b)(7)(C) USN, Patient Administration


Department Head, Naval Health Clinic Patuxent River, MD (NHCPR) was
interviewed regarding to her knowledge of the report made by Ashley MASSARO.

August 2006; however, stated she was stationed at the Expeditionary Medical

Pittsburgh, PA. (b)(6), (b)(7)(C) represents the World Wrestling Entertainment Inc.
(WWE) who was the former employer of Ashley MASSARO, Civ. As background, in
an affidavit signed prior to her death pertaining to her lawsuit against the
WWE, MASSARO claimed that while on a USA tour to Kuwait in "2007", she was
taken to a medical facility to be treated for dehydration and/or
(b)(6), (b)(7)(C) and was subsequently "raped" and "sodomized" by an individual
she believed to be an active duty military physician while an unknown female
stood guard.

2. (b)(6), (b)(7)(C)advised that subsequent to the release of MASSARO's affidavit,


he requested researched the allegation and found a blog posted online by WWE
wrestler and USO participant (b)(6), (b)(7)(C) titled (b)(6), (b)(7)(C)
detailing the events of 03Jul06, which is the date of the alleged rape of
MASSARO, Enclosure (A) pertains. (b)(6), (b)(7)(C)noted that mentions MASSARO
(b)(6), (b)(7)(C)
insisted on attending a photo shoot with troops after her release from the
medical clinic which is inconsistent with the narrative in her affidavit
wherein she reports being taken to her hotel room where she went to sleep
and remained until it was time for the tour to move to the next destination

the photograph session mentioned in(b)(6), (b)(7)(C) blog, which included MASSARO.

RESULTS OF INTERVIEW OF (b)(6), (b)(7)(C) , USN

1. On 22Augl9, (b)(6), (b)(7)(C) USN, NAVEXPMEDSUPCOM was interviewed


at NCISRU Yorktown, VA regarding her knowledge of the alleged sexual assault
of World Wrestling Entertainment (WWE) Ashley MASSARO (MASSARO), CIV.

2. The interview of (b)(6), (b)(7)(C) USN was audio/video recorded and


placed onto a DVD in its entirety utilizing the Case Cracker system. A copy
of the DVD is attached to this report as Enclosure (A).This Investigative
Action (IA) is a synopsis of the interview and should not be considered a
verbatim account.

3. (b)(6), (b)(7)(C) stated she was deployed to Kuwait for approximately six months
from FEB06 to AUG06. (b)(6), (b)(7)(C) indicated she was first stationed at U.S.
Army Camp Victory her two to three months and completed the remaining months
of her deployment at U.S Army, Camp Buehring. While in Kuwait, (b)(6), (b)(7)(C)
claimed she never worked at a Camp Life Support and was not familiar with
that camp. (b)(6), (b)(7)(C) stated she worked at the Battalion Aide Station and
that the clinics were the stopping point for the Army, Air force, and Navy
members entering and exiting Iraq. RA asked (b)(6), (b)(7)(C) about her attendance
to United Service Organization (USO) events while in Kuwait. (b)(6), (b)(7)(C)
stated she rarely attended any USO events and said that Montgomery Gentry, a
country band, is the only celebrity visitor she remembers seeing while in
Kuwait. RA asked (b)(6), (b)(7)(C) if she attend the WWE USO tour's visit to Camp
Life Support Area she indicated she did not attend. RA asked (b)(6), (b)(7)(C) if
she knew WWE personality Ashley MASSARO (MASSARO) and had any knowledge of a
sexual assault against MASSARO, she declared she had no knowledge. (b)(6), (b)(7)(C)
stated she did not remember (b)(6), (b)(7)(C) proclaimed her
memory of her deployment to Kuwait is limited and that she kept to
herself.

1. On 27Augl9, Special Agent (SA) (b)(6), (b)(7)(C) and I interviewed


(b)(6), (b)(7)(C)
(b)(6), (b)(7)(C) USN, at NCIS Resident Agency (NCISRA) Camp Pendleton, CA
(CPC), onboard Marine Corps Base (MCB), CPC. For identification purposes, SA
(b)(6), (b)(7)(C)and I verbally identified ourselves as Special Agents and displayed
our agency-issued credentials to (b)(6), (b)(7)(C) As background, NCISRU Corpus
Christi, TX, is investigating an allegation of sexual assault made by Ashley
MASSARO, CIV, a professional wrestler from World Wrestling Entertainment
(WWE) who visited US military personnel in Kuwait circa 2006. MASSARO
reported being raped and sodomized subsequent to being administered a
paralytic medication during treatment by a US Army doctor wearing an orange
t-shirt and cargo shorts, onboard Camp Life Support Area (LSA), Kuwait,
circa 2006. MASSARO alleged an unidentified female guarded the door during
the assault. NCISRU Corpus Christi identified four (4) current active duty
female service members, including (b)(6), (b)(7)(C) who may have been present in
Kuwait circa 2006. Investigation by U.S. Air Force Office of Special
Investigations revealed MASSARO was treated at the Camp LSA clinic on
02Jul06, by (b)(6), (b)(7)(C) CIV, former USN LT Physician Assistant.

2. I collected biographical information from (b)(6), (b)(7)(C), who confirmed she


was stationed onboard Camp Arifjan, Kuwait, circa 2006-2007, during her USN
enlistment prior to her acceptance of a commission. (b)(6), (b)(7)(C) explained
medical services were provided in two (2) locations onboard Camp Arifjan;
the base aid station (BAS) and the clinic. (b)(6), (b)(7)(C) explained she worked in
the BAS which provided medical care for service members reporting for
sick-call and individuals who were medically evacuated (MEDIVAC) in
helicopters. (b)(6), (b)(7)(C) explained the BAS was a tent facility which included
a large open bay in the middle with two (2) separate wards on either end.
(b)(6), (b)(7)(C) explained the wards were used when patients required additional
medical services after being seen in the middle bay.

3. (b)(6), (b)(7)(C) explained, in addition to the bay and two (2) wards, the BAS
also housed a small pharmacy behind a wooden door. (b)(6), (b)(7)(C) explained
medications would be transferred from the clinic to the BAS as necessary,
and she opined that any anesthetic-type medication that may cause paralysis
was unlikely to have been maintained in advance in the BAS pharmacy. (b)(6), (b)(7)(C)
explained the BAS formulary would account for any medications
(b)(6), (b)(7)(C)
transferred to the BAS from the clinic. (b)(6), (b)(7)(C) explained, only pharmacy
staff would have access to stored medications which had to be transferred
from the clinic to the BAS by a registered nurse (RN).

4. (b)(6), (b)(7)(C) explained she did not recall any professional wrestlers
visiting Camp Arifjan, nor any receiving any medical treatment, but added it
could have happened when she was off-duty. (b)(6), (b)(7)(C) explained only two (2)
Army personnel supported the BAS in an administrative capacity. (b)(6), (b)(7)(C)
recalled BAS staff wore uniforms while at work and did not recall any staff
ever wearing orange shirts or shorts. (b)(6), (b)(7)(C) provided a hand-drawn map of
Camp Arifjan; Enclosure (A) pertains.

5. (b)(6), (b)(7)(C) explained she recalled (b)(6), (b)(7)(C) USN, Naval Medical
Center San Diego (NMCSD), and (b)(6), (b)(7)(C) USN (RET) both worked at
the BAS with her. (b)(6), (b)(7)(C) denied any knowledge of (b)(6), (b)(7)(C)

USN, Patient Administration (b)(6), (b)(7)(C) Naval Health Clinic Patuxent
River, MD (NHCPR) in regards to her knowledge of the report made by Ashley
MASSARO, World Wrestling Entertainment (WWE) personality, that she was
sexually assaulted in 2006 while on an armed forces entertainment tour in
Kuwait at a medical facility to be treated for dehydration. Records showed
MASSARO was treated at Camp Life Support Area, Kuwait by (b)(6), (b)(7)(C)
former USN LT Physician Assistant.

2. (b)(6), (b)(7)(C) advised she was deployed to Kuwait from February 2006 through
August 2006; however, stated she was stationed at the Expeditionary Medical
Facility. (b)(6), (b)(7)(C)advised she was enlisted at the time of the 2006
deployment, being an E6 at the time. According to (b)(6), (b)(7)(C) she was working
in the operating room and was not familiar with the "Camp Life Support Area"
name or facility. (b)(6), (b)(7)(C) recalled working with (b)(6), (b)(7)(C) who is now
the (b)(6), (b)(7)(C) but was (b)(6), (b)(7)(C) for
the second half of her tour. In addition, (b)(6), (b)(7)(C) recalled a (b)(6), (b)(7)(C)
(NFI) who was the lead surgeon for the facility. (b)(6), (b)(7)(C) could not recall
the WWE armed forces tour, but stated there were so many that came through
the area and she did not go to any of them. In addition, (b)(6), (b)(7)(C) stated
that she could not recall treating any civilians during her deployment;
however, stated the procedures for treating civilians would have been the
same as miltiary members being that they were the only medical facilities in
the AOR.

3. (b)(6), (b)(7)(C) reiterated that she did not believe she was at the same facility
called Camp Life Support Area, nor did she recall any members of the WWE
tour being treated at her facility, specifically she stated she did not
recall seeing or hearing about Ashley MASSARO being treated at her facility.
(b)(6), (b)(7)(C)again stated that she would have been located in the operating
room and would not have treated or seen any patients that came into the
clinic for minor injuries. In addition, (b)(6), (b)(7)(C)did not recall any service
providers by the name of (b)(6), (b)(7)(C) nor could she believe any of the
service providers she served with capable of sexually assaulting a patient.
Further, (b)(6), (b)(7)(C)did not see how it could be possible seeing how the clinic
was physically set up. (b)(6), (b)(7)(C)advised the clinic was an open bay with no
doors, except for the pharmacy. (b)(6), (b)(7)(C)indicated even the tent-like
curtains provided for privacy for the exams barely stayed closed, leaving
the exam areas exposed.

while on an armed forces entertainment tour in Kuwait at a medical facility
to be treated for dehydration. Records showed MASSARO was treated at Camp
Life Support Area, Kuwait by (b)(6), (b)(7)(C) former USN LT Physician
Assistant. (b)(6), (b)(7)(C)advised she was deployed to Kuwait from February 2006
through August 2006; however, stated she was stationed at the Expeditionary
Medical Facility. According to (b)(6), (b)(7)(C) she was working in the operating
room and was not familiar with the "Camp Life Support Area" name or
facility. (b)(6), (b)(7)(C) could not recall the WWE armed forces tour, nor could
not recall treating any civilians during her deployment. (b)(6), (b)(7)(C)reiterated
that she did not believe she was at the same facility called Camp Life
Support Area, nor did she recall any members of the WWE tour being treated
at her facility, specifically she stated she did not recall seeing or
hearing about Ashley MASSARO being treated at her facility. In addition,
(b)(6), (b)(7)(C) did not recall any service providers by the name of(b)(6), (b)(7)(C)
(b)(6), (b)(7)(C) nor could she believe any of the service providers she served
with capable of sexually assaulting a patient. (b)(6), (b)(7)(C) did not see how it
could be possible seeing how the clinic was physically set up. (b)(6), (b)(7)(C)
advised she could not recall any additional information from her deployment
that could be beneficial to the captioned investigation. (b)(6), (b)(7)(C) reported
that if one of the service providers did infact commit the alleged offense
they should lose their license and serve jail time for the offense.
However, based off information provided and what she recalls from the
clinic, she was skeptical that an offense could have occured at the facility

EXECUTIVE SUMMARY
1. This reactive investigation was initiated on 28Junl9 following receipt
of information from US Air Force Office of Special Investigations (AFOSI)
regarding a possible sexual assault that allegedly took place in 2006 at a
Naval Clinic aboard Camp Life Support Area (LSA), Kuwait. The incident
allegedly involved deceased civilian World Wrestling Entertainment (WWE)
personality Ashley MASSARO. As background, in an affidavit signed prior to
her death pertaining to her lawsuit against the WWE, MASSARO claimed that
while on a USO tour to Kuwait in "2007", she was taken to a medical facility
to be treated for dehydration and/or (b)(6), (b)(7)(C) and was subsequently
"raped" and "sodomized" by an individual she believed to be an active duty
military physician while an unknown female stood guard. AFOSI and US Army
Criminal Investigation Division (USACID) conducted initial inquiries into
the allegations and provided results of their investigation to NCIS. An
interview of MASSARO's attending physician was conducted. An unsuccessful
attempt to locate the alleged crime scene was conducted. This investigation
is pending additional investigative leads to identify personnel who may have
been present during the alleged assault as well as other probative steps.

NARRATIVE
1. This reactive investigation pertains to suspected violations of Article
120 (Sexual Assault) of the Uniform Code of Military Justice (UCMJ) or Title
18 U.S.C. 2242 (Sexual Abuse). On 24Mayl9, the Air Force Office of Special

Investigations (AFOSI) initiated an investigation into this allegation.


Additionally, Army CID has conducted investigative activity pertaining to
this investigation. However, on 28Junl9, NCIS assumed primary investigative
authority.

2. Per Reference (A), on 17Junl9, INV (b)(6), (b)(7)(C) Chief, Cold Case Team,
AFOSI, provided NCIS with information regarding a possible sexual assault
that allegedly took place at a Naval Clinic aboard Camp Life Support Area
(LSA) , Kuwait. The incident allegedly occurred in 2006, and involved
deceased World Wrestling Entertainment (WWE) personality Ashley MASSARO,
CIV. As background, in an affidavit signed prior to her death pertaining to
her lawsuit against the WWE, MASSARO claimed that while on an armed forces
entertainment tour to Kuwait in "2007", she was taken to a medical facility
to be treated for dehydration and/or (b)(6), (b)(7)(C) In the affidavit, MASSARO
alleged while she was in the clinic, an unidentified male, identified by her
as a "US Army Doctor," wearing an orange shirt and cargo shorts, gave her a
drug which induced paralysis, and then proceeded to rape and sodomize her,
while an unidentified woman in fatigues guarded the door.

3. AFOSI investigative efforts revealed MASSARO was treated at the Camp LSA
clinic on 02Jul06, by (b)(6), (b)(7)(C) CIV, former USN LT Physician
Assistant. According to AFOSI's report, (b)(6), (b)(7)(C) treated MASSARO (b)(6), (b)(7)(C)
(b)(6), (b)(7)(C) examination
(b)(6), (b)(7)(C) No
other relevant treatment records regarding MASSARO were found. Exhibit (1)
provides amplifying details.

4. US Army Criminal Investigation Division (USACID) opened an investigation


and conducted numerous investigative steps to include receipt of medical
records, open source material records review, background checks, and
facilitation of several interviews. Exhibit (2) contains the details of
USACID's investigation.

5. On 25Junl9 civilian (b)(6), (b)(7)(C) was interviewed and provided


details regarding his treatment of MASSARO. (b)(6), (b)(7)(C) denied any knowledge
of the alleged sexual assault, nor did he recall anyone meeting the
description provided by MASSARO. Exhibit (3) pertains.

6. On 11Ju119, contact with AFOSI and USACID did not reveal the exact
location of Camp LSA, therefore no crime scene examination could be
conducted. Exhibit (4) provides amplifying details.

7. Multiple attempts were conducted to interview civilian (b)(6), (b)(7)(C) who


was (b)(6), (b)(7)(C) supervising physician in Kuwait circa 2006. declined to
(b)(6), (b)(7)(C)
be interviewed via his attorney. Exhibits (5) and (6) pertain.

8. On 23Jull9, records received from Navy Personnel Command identified a


spreadsheet containing social security numbers purportedly belonging to
individual service members assigned to UIC EMF Kuwait CP DET, 40250 circa
July 2006. Exhibit (7) provides amplifying details.

9. A follow-up with Navy Personnel Command further identified all female


Corpsmen assigned to UIC 40250 circa July 2006, Exhibit (8) pertains.

at his office located in the (b)(6), (b)(7)(C) Kelsey-Seybold
Clinic Berthelsen Campus located at 2727 W. Holcombe Blvd, Houston, TX
regarding his knowledge of the possible sexual assault of Ashley MASSARO,
CIV in Kuwait in 2006. The interview was audio recorded. A copy of the audio
recording was electronically transferred to DVD format and placed in the
NCIS Resident Unit Corpus Christi Evidence Storage Facility under log #
035-19. A copy of the audio recorded interview is attached as Enclosure (A).

2. The below is intended as a summary and is not all inclusive of the


interview. At the near completion of interview, interview was interrupted by
a nurse who asked (b)(6), (b)(7)(C) medical questions about an unrelated patient who
was being seen at the Kelsey-Seybold Clinic. RA suspended the recording as
to not collect personal medical data from an unrelated party.

3. (b)(6), (b)(7)(C) stated that someone from the Air Force called him a month
earlier and asked him some questions regarding MASSARO. (b)(6), (b)(7)(C) could not
recall who called him.

4. (b)(6), (b)(7)(C) stated he was assigned to a 'tent city' one mile away from Camp
Ali A1 Salem, Kuwait as a Physician Assistant and was deployed for
approximately six months in 2006. (b)(6), (b)(7)(C) stated the facility was
essentially a double wide trailer that had two urgent care bays, two exam
rooms, a small waiting area, a bathroom, some offices and a pharmacy.
also stated that there was a separate area for the Army Medics.

stated the urgent care bays were open and had no door, but could
be closed with a curtain. (b)(6), (b)(7)(C) drew a sketch of the facility and marked
where he treated MASSARO with a X-ME, Enclosure (B) pertains. (b)(6), (b)(7)(C)
stated the exam rooms had doors with locks on them.

5. (b)(6), (b)(7)(C) stated the standard dress for all facility staff was fatigues.
(b)(6), (b)(7)(C) stated the USN personnel wore desert fatigues, but the Corpsmen
mostly wore the desert fatigue pants and a brown tee-shirt. (b)(6), (b)(7)(C)
recalled the US Army medics wore green fatigues. (b)(6), (b)(7)(C) stated he would
have been wearing the desert camo fatigue pants, but could not recall if he
wore the desert camo fatigue top, or the brown tee-shirt.

7. (b)(6), (b)(7)(C) recalled the day MASSARO was treated was a Sunday, and he was
off duty, but was called in when he was alerted there was an issue with a
civilian. (b)(6), (b)(7)(C) stated the facility was not heavily trafficked on the
weekends, but he believes that there would have been 2-4 Army medics on duty
and a few USN Corpsmen would be present. (b)(6), (b)(7)(C) stated that on an average
Sunday, there would be between 5-10 people on duty in the facility.
(b)(6), (b)(7)(C) stated that occasionally, when it was slow, some people would come
visit their friends who were on duty in the facility. (b)(6), (b)(7)(C) did not
recall seeing any old quilts or blankets in the facility, but stated that
sometimes the facility personnel or their friends would bring in their
personal items during down times.

8. (b)(6), (b)(7)(C) stated he was not sure how long MASSARO was there before he
arrived at the facility. (b)(6), (b)(7)(C) recalled that when he first saw MASSARO
she was in her street clothes in the exam room. (b)(6), (b)(7)(C) did not recall
meeting MASSARO in the urgent care bay or in the waiting area. (b)(6), (b)(7)(C)
could not recall specifically what MASSARO was wearing but may have been
wearing a muscle shirt. (b)(6), (b)(7)(C) recalled MASSARO's hair was done up like
she was just finished performing, and she had a flower in her hair and may
have had some coloring in her hair. (b)(6), (b)(7)(C) stated he recalled MASSARO
complained of abdominal and pelvic pain.

9. (b)(6), (b)(7)(C) recalled that MASSARO was accompanied by a male civilian that
he did not recognize, but he recalled someone in the clinic saying it was
(b)(6), (b)(7)(C) stated (b)(6), (b)(7)(C) seemed to be acting skittish
and strange. (b)(6), (b)(7)(C) described (b)(6), (b)(7)(C) as a male, in his
(b)(6), (b)(7)(C)
thirties, (b)(6), (b)(7)(C) hair, perhaps had a mustache, and was well built. (b)(6), (b)(7)(C)
stated that when he first saw MASSARO he believed she was drowsy but she was
not falling asleep during conversation or slurring her words. (b)(6), (b)(7)(C)
recalled someone else working in the facility may have said that 'she was
high' but (b)(6), (b)(7)(C) was uncertain. (b)(6), (b)(7)(C) stated he had little experience
with people on drugs or alcohol so he was not sure.

10. (b)(6), (b)(7)(C) stated he did not see MASSARO with an IV at any time when she
was in the facility. (b)(6), (b)(7)(C) stated it was customary for the physicians to
see the patient before an IV was administered. (b)(6), (b)(7)(C) stated it was
possible that one of the medics or Corpsmen gave her an IV at some point, as
that was common in Kuwait due to the heat, but he did not witness it.
(b)(6), (b)(7)(C) stated a USN Corpsmen checked MASSARO's basic vital signs and
medical data before he came in the exam room, and that was routine.

11. (b)(6), (b)(7)(C) stated when he entered the exam room, MASSARO was there and
alone. (b)(6), (b)(7)(C) stated he conducted a preliminary meeting with MASSARO in
the exam room and asked her questions regarding her medical issues.
(b)(6), (b)(7)(C) could not recall if the female Corpsman was in the room with her
at that time. (b)(6), (b)(7)(C) stated it would be atypical for a Corpsman to be in
the room for the medical question portion of the exam. (b)(6), (b)(7)(C) stated
MASSARO was talking, moving and seemed lucid at this time and was dressed in

exam briefly so that MASSARO could respond. (b)(6), (b)(7)(C) stated that MASSARO
responded and said that everything was fine and she was having an exam done.
(b)(6), (b)(7)(C) stated that MASSARO seemed nonchalant when she said everything was
fine and the manager stopped banging on the door and did not knock again.

14. (b)(6), (b)(7)(C) did not recall the name of the female Corpsman, but recalled
that she was (b)(6), (b)(7)(C) may have said she was from Florida, and said
she had a young daughter. (b)(6), (b)(7)(C) did not recall the names of any other
USN or USA personnel assigned to the clinic. (b)(6), (b)(7)(C) stated he thought
that many but not all of the Corpsmen came from Naval Hospital Pensacola.
(b)(6), (b)(7)(C) stated he thought that there were only two female Corpsmen at the
facility while he was there.

15. (b)(6), (b)(7)(C) stated he did not recall anyone saying it was their birthday
the day MASSARO was treated or having a birthday at the time of the exam.
(b)(6), (b)(7)(C) did not recall anyone wearing an orange shirt or cargo shorts the
day of MASSARO's treatment. (b)(6), (b)(7)(C) suggested that if anyone was in the
clinic wearing cargo shorts they were either not assigned there, or they

command 'fun' tee-shirt at some point and they were either yellow or orange,
but did not recall anyone wearing it the day of MASSARO's exam.

(b)(6), (b)(7)(C) US ARMY Criminal Investigation Command
(CID), Camp Buehring,
Kuwait, regarding lead tasking to conduct a crime scene at the medical
treatment area at the Camp Life Support Area (LSA), Kuwait. (b)(6), (b)(7)(C)stated
the LSA was not present at his location, and suggested RA contact an agent
with AF Office of Special Investigations (AFOSI) elsewhere in Kuwait. He
believed the LSA in question was located at either Ali A1 Salem which is an
installation under the jurisdiction of AFOSI.

2. SA (b)(6), (b)(7)(C) AFOSI, A1 Jaber, was contacted by RA to request contact


information of an AFOSI agent covering Ali A1 Salem.(b)(6), (b)(7)(C) opined SA(b)(6), (b)(7)(C)
(b)(6), (b)(7)(C) AFOSI, Ali A1 Salem had the best understanding of this
investigation, and would be most likely to provide whereabouts of the LSA.

3. On 16JUL19, RA contacted (b)(6), (b)(7)(C)who was confident the LSA captioned in


this investigation was not located at Ali A1 Salem. AFOSI agents conducted
their own research and were able to retrieve medical records. (b)(6), (b)(7)(C)noted
the acronym for the location of services on the medical record was "CP APOD
TMC." (b)(6), (b)(7)(C)deduced that to be Camp Patriot, Aerial Port of Demarcation,
Troop Medical Clinic. Camp Patriot is a separate location approximately a
one and a half hour drive to the south on the east coast of Kuwait. He
stated the medical facility also could possibly be located in Kuwait
City.

4. RA was unable to find the location of the LSA; therefore, no crime scene
was conducted.

1. Pursuant to the captioned investigation, on 08JUL19, Special Agent (SA)


(b)(6), (b)(7)(C) attempted to telephonically contact (b)(6), (b)(7)(C)
(b)(6), (b)(7)(C) but found the number disconnected. Also, on
08JUL19, SA(b)(6), (b)(7)(C) emailed (b)(6), (b)(7)(C) On 09JUL19,
after an internet search to determine a working phone number, SA(b)(6), (b)(7)(C) left
a message with a receptionist at (b)(6), (b)(7)(C) place of employment. As
background, (b)(6), (b)(7)(C) served in Kuwait in 2006 as the Officer in Charge (QIC)
of the clinic where Ashley MASSARO, CIV (MASSARO) received treatment. While
receiving treatment, MASSARO alleged she received a drug (which induced
paralysis) and then an unknown doctor raped and sodomized her.

2. On 10JUL19, this case transferred to SA(b)(6), (b)(7)(C)Reporting Agent (RA). RA


received a call from (b)(6), (b)(7)(C) who provided he did not want to be
interviewed and Naval Criminal Investigative Service (NCIS) would have to
subpoena him. RA explained to (b)(6), (b)(7)(C)he was not a suspect and NCIS wanted
to interview him due to his position(b)(6), (b)(7)(C)
of the clinic where the incident
allegedly occurred. (b)(6), (b)(7)(C)stated he would have his lawyer contact RA on
Tuesday, 16JUL19.

3. On 17JUL19, RA contacted (b)(6), (b)(7)(C)to discuss scheduling an interview. (b)(6), (b)(7)(C)


refused and said his lawyer would contact RA, despite efforts to
(b)(6), (b)(7)(C)
explain the importance of (b)(6), (b)(7)(C) cooperation. On 18JUL19, RA contacted
(b)(6), (b)(7)(C) attorney, (b)(6), (b)(7)(C) CIV at (b)(6), (b)(7)(C) and left a
message. (b)(6), (b)(7)(C) returned RA's call; (b)(6), (b)(7)(C)refused to coordinate an
interview. However, (b)(6), (b)(7)(C)agreed to facilitate presenting a list of
questions in an effort to elicit pertinent information relevant to the
investigation.

4. On 17JUL19, RA contacted case agent to update him on the case and discuss
a questionnaire. Case agent provided RA with questions on 18JUL19. On

CHASE LA, NEW ORLEANS from 29DEC03 through 01JAN07 and it is suspected he
was TAD to Kuwait in July 2006 but that information could not be confirmed

requested more specific information in terms of the Unit
Identification Code (UIC) the requested data was being sought for.

4. On 23JUL19, the Case Agent advised subsequent research revealed the

the Federal Health Care Center, Naval Station Great Lakes. (b)(6), (b)(7)(C) stated
she had no knowledge of the Naval Clinic aboard Camp Life Support Area,
Kuwait. (b)(6), (b)(7)(C) said she was in Kuwait assigned to the EMF Kuwait, Camp
Pendleton Attachment from 19FEB06 to 19AUG06. (b)(6), (b)(7)(C) said after arriving
in Kuwait she was processed in country at the main hospital located at Camp
Arifjan. While there, she was assigned to Camp As Sayliyah's (UIC 40250)and
transported to Qatar. After her six-month tour was completed, she was
processed out through Camp Arifjan. (b)(6), (b)(7)(C) said Qatar was a 2-3 hours
away from Kuwait and had no knowledge of the events that took place there.

1. This reactive investigation pertains to suspected violations of Article
120 (Sexual Assault) of the Uniform Code of Military Justice (UCMJ) or Title
18 U.S.C. 2242 (Sexual Abuse). On 24Mayl9, the Air Force Office of Special
Investigations (AFOSI) initiated an investigation into this allegation.
Additionally, Army CID has conducted investigative activity pertaining to
this investigation. However, on 28Junl9, NCIS assumed primary investigative
authority.

2. Per Reference (A), on 17Junl9, INV (b)(6), (b)(7)(C) Chief, Cold Case Team,
AFOSI, provided NCIS with information regarding a possible sexual assault
that allegedly took place at a Naval Clinic aboard Camp Life Support Area
(LSA), Kuwait. The incident allegedly occurred in 2006, and involved
deceased World Wrestling Entertainment (WWE) personality Ashley MASSARO,
CIV. As background, in an affidavit signed prior to her death pertaining to
her lawsuit against the WWE, MASSARO claimed that, while on an armed forces
entertainment tour to Kuwait in 2007, she was taken to a medical facility to
be treated for dehydration and/or (b)(6), (b)(7)(C) In the affidavit, MASSARO
alleged, while she was in the clinic, an unidentified male, identified by
her as a "US Army Doctor," wearing an orange shirt and cargo shorts gave her
a drug which induced paralysis, and then proceeded to rape and sodomize her,
while an unidentified woman in fatigues guarded the door.

3. AFOSI investigative efforts revealed MASSARO was treated at the Camp LSA

1. This reactive investigation pertains to suspected violations of Article
120 (Sexual Assault) of the Uniform Code of Military Justice (UCMJ) or Title
18 U.S.C. 2242 (Sexual Abuse). On 24Mayl9, the Air Force Office of Special
Investigations (AFOSI) initiated an investigation into this allegation.
Additionally, Army CID has conducted investigative activity pertaining to
this investigation. However, on 28Junl9, NCIS assumed primary investigative
authority.

2. Per Reference (A), on 17Junl9, INV (b)(6), (b)(7)(C) Chief, Cold Case Team,
AFOSI, provided NCIS with information regarding a possible sexual assault
that allegedly took place at a Naval Clinic aboard Camp Life Support Area
(LSA), Kuwait. The incident allegedly occurred in 2006, and involved
deceased World Wrestling Entertainment (WWE) personality Ashley MASSARO,
CIV. As background, in an affidavit signed prior to her death pertaining to
her lawsuit against the WWE, MASSARO claimed that, while on an armed forces
entertainment tour to Kuwait in 2007, she was taken to a medical facility to
be treated for dehydration and/or (b)(6), (b)(7)(C) In the affidavit, MASSARO
alleged, while she was in the clinic, an unidentified male, identified by
her as a "US Army Doctor," wearing an orange shirt and cargo shorts gave her
a drug which induced paralysis, and then proceeded to rape and sodomize her,
while an unidentified woman in fatigues guarded the door.

3. AFOSI investigative efforts revealed MASSARO was treated at the Camp LSA
