MEMORANDUM

TO : ALL ELECTED AND QUALIFIED MEMBERS OF THE 11TH


SANGGUNIANG BAYAN, SECRETARY TO THE SANGGUNIAN AND
LEGISLATIVE STAFF.

SUBJECT : RE-ITERATING FOR THE MEMBERS OF THE SANGGUNAING


BAYAN TO FOLLOW THE INTERNAL RULES OF PROCEDURES OF
THE 11TH SANGGUNIANG BAYAN.

The undersigned wishes to re-iterate that the members shall follow the internal rules and
procedures of the 11th Sangguniang Bayan. As reference, every member has been given a copy of
the approved Internal Rules and Procedures.

PURSUE THE LEGISLATIVE PROCESS

Rule X of the IRP describes the Legislative Process that the members of the 11th
Sanggunian have to follow.

1. All Proposed Legislative Measures (PROPOSED ORDINANCE AND


RESOLUTIONS) shall be in writing and signed by the author/authors and to be
submitted to the Secretary to the Sanggunian before it can be included in the
Order of Business. (Section 1 (b)of the IRP)

The Sanggunian members shall file their propose legislative measures in


writing and shall be submitted to the Secretary to the Sanggunian on or before 12
noon of Friday of every week to be considered on the Order of Business under
First Reading. Any propose measures submitted after the required time and day
shall be considered on the Order of Business of the Next Regular Session.

The proposed measure shall contain an assigned member, a title or


caption, an enacting or ordaining clause, and the date of its proposed effectivity. In
addition, every proposed ordinance/resolution shall be accompanied by a brief
explanatory note containing the justification for its approval. If the proposed
measure failed to follow the required format and contents, it shall not be
considered in the Order of Business.

The Secretary to the Sanggunian is directed to cause the printing of the


Order of Business after 12 noon of every Friday.
2. ADHERE TO THE THREE (3) READING PRINCIPLES AS MANDATED BY
OUR IRP and RA 7160. (SECTION 3. of the IRP)

There is nothing in the Republic Act 7160 that states that the Certification
of Urgency shall cause the Legislative Body to by-pass the three reading
principle. In fact, DILG Opinion No. 52, s. 2019 opined that three readings could
be done by the sangguniang in just one session to facilitate immediate deliberation
and passage of legislative measures.

It is clear to follow the three-reading principle but not to by-pass it.

PREPARATION AND SUBMISSION OF COMMITTEE REPORTS.

Rule XIV, Section 1 of the IRP directs every committee to submit its report in
writing to the Sanggunian, thru the Secretary. It is clear that the chairperson or any of
the members of the Committee shall prepare the committee report.

After the committee has rendered its report and is recommending favourably the
enactment of a proposed ordinance or a passage of a resolution it has “reported out”,
a copy of the proposed ordinance shall be furnished the Committee on Rules which
shall calendar it for second reading.

The Secretary is directed to provide administrative/clerical assistance to the


Committees by encoding the draft committee reports.

APPROVAL OF LEGISLATIVE MEASURES

The approval of Legislative measures is during the Second or Third Reading.


Motion for the approval of Legislative measure during the first reading is deemed out
of order.
