Dear Sir,
RE: COMPLAINT FOR BREACH OF CONTRACT BY EXCEL INSURANCE (U) LTD.
(Under Section 12(1)(j) and (k) of the Insurance Act)
I am writing to bring to your attention a matter regarding the failure of Excel Insurance (U) Ltd
to compensate four workers who were injured in an accident that occurred on the 15 th day of
January 2024.
Zampo Engineering and Contractors Ltd is a registered company dealing in designing, update
and construction located in Kampala herein referred to as the insured took Contractors All Risks
Insurance Policy from Excel Insurance (U) Ltd.
The insurance covers workers’ on site, machinery, site and fire. On the 15 th day of January 2024,
an accident took place at the site where four workers namely, Bwiso James aged 25 years broke
his arm, Jingo Geoffrey aged 18 years, lost his teeth, Agnes Mbata aged 35 years, deformed her
face, Mary Ita aged 30 years lost her 3 fingers and the accident was caused by one of the Trucks,
Registration Number UAB 867A, a Hino “Maguru kumi” which was being driven by Mr. Mushi
Bubii, one of the Company drivers.
On the 20th day of January 2024, the managing director of Zampo Engineering and Contractors
Ltd, Mbampata Cleophas wrote to Excel Insurance Company asking them to process
compensation of the bills in the hospital that had accumulated to UGX 24.5 Million but Mr.
Zalwango James declined.
As the insurance Regulatory Authority overseeing insurance practice in Uganda, I urge you to
investigate this matter thoroughly and ensure that Excel Insurance (U) Ltd fulfils its
responsibilities by providing the compensation rightfully owed to the injured workers.
