PRESIDENTIAL DECREE NO. 1586


June 11, 1978

ESTABLISHING AN ENVIRONMENTAL IMPACT STATEMENT SYSTEM, INCLUDING OTHER ENVIRONMENTAL


MANAGEMENT RELATED MEASURES AND FOR OTHER PURPOSES

Whereas: To achieve effective environmental protection, we need a system that balances socio-economic activities with environmental quality.
Whereas: Environmental Impact Statements and Assessments must align with the goals of the National Environmental Protection Program,
integrating all regulatory and procedural requirements accordingly.

Addtl note: As per P.D. 1586, everyone must obtain an Environmental Compliance Certificate (ECC) before starting any environmentally critical
project or operating in an environmentally critical area.

Sec. 1 Policy State aims to achieve a balanced approach between socio-economic growth and environmental protection.

Environmental Impact The EIS System is created based on the requirement in Presidential Decree No. 1151 for all government
Sec. 2 Statement (EIS) agencies, government-owned corporations, and private entities to submit an environmental impact statement
System for projects significantly affecting the environment.

The Minister of Human Settlements or their representative can choose lead agencies for projects under
Sec. 3 Determination of Lead Presidential Decree No. 1151.
Agency - These agencies will create environmental impact statements for critical projects. The National
Environmental Protection Council for reviews & evaluates all statements.

President - with advice from National Environmental Protection Council (NEPC), can label projects or areas
as Environmentally Critical. (No one can start or run such projects without first securing Environmental

Presidential
- Can also reorganize government offices to manage these projects better.
Proclamation of
Environmentally Critical Ministry of Human Settlements shall:
Areas & Projects (a) plan land or water use for critical projects or areas,
(b) set environmental quality standards,
(c) create programs to protect against disasters like earthquakes and floods, and
(d) carry out other tasks assigned by the President.

Sec. 5 Environmentally Non- Non-critical Projects don't need to submit an EIS unless requested by the NEPC (can ask non-critical projects
Critical Projects to add extra environmental safeguards if needed).

Sec. 6 Secretariat NEPC can set up a Secretariat to manage the EIS system and assess statements.

Sec. 7 Management & The Ministry of Human Settlements can support & fund gov. offices under its supervision as required, using
Financial Assistance existing funds/additional budget.

Sec. 8 Rules & Regulations NEPC will make rules for this Decree, possibly involving the National Pollution Control Commission as per
its responsibilities under P.D. No. 984.

Sec. 9 Penalty for Violation Violators of this Decree, its certificates, or Council rules can lose their certificate or be fined up to P50,000.00
per violation, at the Council's discretion.

Penalties from Sec. 9 and those imposed by the National Pollution Control Commission (NPCC) as authorized
Sec. 10 Environmental in P.D. 984 will fund an Environment Revolving Fund, exempt from certain laws.
Revolving Fund - Fund will support the NEPC & NPCC in enforcing this Decree.
- Ministry of Human Settlements will create rules for using the fund, subject to the President's approval.

The Inter-Agency Advisory Council of the NPCC is abolished, and its duties and powers are given to the
Sec. 11 Repealing Clause NEPC.
(Any conflicting laws or regulations are changed accordingly).

Sec. 12 Effectivity Clause This Decree shall take effect immediately. Done in the City of Manila, June 11, 1978.

relation to the proposed project.
Environmental Compliance Certificate: Refers to the document issued by the government agency concerned certifying that the project
under consideration will not bring about an unacceptable environmental impact and that the proponent has complied with the requirements
of the environmental
impact statement system.
