General instructions

• Your typed tutorial must be submitted on ClickUP between 07h30 on Monday, 04 March 2024
and 07h30 on Friday, 08 March 2024. Please remember to submit a plagiarism declaration
with your tutorial answer;
• Indicate your name, surname, and student number at the top left-hand side of the page;
• You must use footnotes to reference relevant sources;
• Please use the Integrated Planning Framework (HOTS framework) to plan your answer.

• Also, when drafting your final answer for submission via Turn-It-In use paragraphs to structure
your answer and leave one line open between the paragraphs for summative feedback;
• You are strongly advised to consult a dictionary (either in hard copy or through the OR Tambo
Law library databases, but not Google) to look up words that you do not know. You will be
required to submit a list of these words with their meaning at the end of the semester in the
final tutorial;
• The purpose of this tutorial submission is to improve your written communication and critical
literacy skills as an applied competence as articulated in the CHE Qualifications Standard for
the LLB on page 10;
• 10% of the tutorial submissions will be selected at random for assessment during each tutorial
cycle.

Tutorial information
Tanya is a new mom. She breastfeeds her baby and have struggled with an oversupply of breastmilk.
Recently she started running low on cash and is now considering to sell her excess breastmilk on
Facebook Marketplace after seeing the following add:

Advise Tanya whether she can legally sell her breastmilk by explaining to her whether breastmilk
qualify as a thing in South African law. In your answer, consider all the definitional components of a
thing and relevant legislation.
