II Series of 2021 EX AN ORDER RECONSTITUTING THE COMMITTEE OF ANTI-RED TAPE (CART) TO ABSORB THE REGULATORY REFORM TEAM OF THE MUNICIPALITY OF PALANAN, ISABELA, AND FOR OTHER PURPOSES WHEREAS, Executive Order No. 2020-02 dated February 06, 2020 created the Regulatory Reform Team of this Municipality pursuant to Republic Act. No.11032, otherwise known as the “Fase of Doing Business and Ffficient Government Service Delivery Act of 2018"; WHEREAS, the Anti- Red Tape Authority issued Memorandum Circular No. 2020-07, Series pf 2020, which mandated the creation of a Committee on Anti-Red Tape (CART) in local government units and other government offices which members are institutionally tasked to identify, develop, implement, and review policies and monitor processes; WHEREAS, in view of the similarities in the functions of the RRT and the CART, it is deemed imperative to reorganize the CART to absorb the RRT in order to harmonize the said teams and to avoid redundancy of their functions; NOW THEREFORE, I, ELIZABETH B. OCHOA, Municipal Mayor of Palanan, Isabela by virtue of the powers vested in me by law, do hereby order the following: SECTION 1. ABSORPTION. The Regulatory Reform Team (RRT) is hereby absorbed by the Committee of Anti-Red Tape (CART). The functions of the RRT shall likewise be absorbed by the CART. SECTION 2. COMPOSITION. FUNCTIONS. The CART shall perform the following functions as provided in the ARTA MC 2020-07: The CART shall ensure that the Municipal Government of Palanan shall comply with the requirement of RA No. 11032, its IRR and subsequent issuances by the Authority, as may be applicable. These requirements pertain to the conduct of the following: ‘a. Conduct of compliance cost analysis, time and motion studies, evaluation and improvement of all the agency’s services, and reengineering the same; b. Subject to the Guidelines/ National Policy on Regulatory Management System to be issued by the Authority: b.1. Notify the Authority of every formulation, modification, and repeal of regulations, ordinances or related issuances; b.2. Conduct post-implementation assessment and review of existing regulations, ordinances or other related issuances, undertake Regulatory Impact Assessment (RIA); 215 EXECUTIVE ORDER NO. 11, SERIES OF 2021, “AN ORDER RECONSTITUTING THE COMMITTEE OF ANTLRED TAPE (CART) TO ABSORB THE REGULATORY REFORM TEAM OF THE MUNICIPALITY OF PALANAN, ISABELA, AND FOR OTHER PURPOSES” b.3. Prepare a Preliminary Impact Assessment (PIA) whenever there is an intent to formulate, modify, or repeal a regulation and submit to the Authority; b.4. Produce a Regulatory Impact Statement (RIS) upon completion of each RIA and submit to the Authority for review and assessment} b.5. Refer the Authority's policy option recommendations to the appropriate decision maker within the agency; b.6. Submit an inventory and electronic copies of all existing (both in- effect and repealed) regulations and issuances to populate the Philippine Business Regulation Information System (PBRIS); c. Ensure effective knowledge transfer, or information dissemination among office employees on ARTA-related trainings, briefings, or such related matters obtained by office staff within sixty (60) days from the end of the training; d. Register new regulations and issuances to the following, if applicable, within fifteen (15) days from issuance: i. UP Office of National Administrative Register (UP ONAR), and ii, Official Gazette for publication e. Set-up the most current and updated service standards and indicate in the Citizen's Charter in accordance to the prescribed template issued by the Authority, and submit the same to the Authority to populate the Anti-Red Tape Electronic Management Information System (ARTEMIS); f. Monitor and periodically review the office or agency's Citizen’s Charter, specifically: procedures/ steps, time, documentary requirements, and fees; g. Ensure that an updated Citizen's Charter, should there be any change, is posted not later than March 31st of each year; hh. Ensure the compliance of the agency on the zero-contact policy in accordance with the law; i. Ensure the compliance of the agency's external and internal services with the prescribed processing time as mandated by RA No. 11032 or the agency's mandate under special law; j. Develop and foster a client feedback mechanism and client satisfaction measurement; k, Report to the Authority not later than the last working day of January of each year the results of the Client Satisfaction Survey for each service based on the guidelines to be issued by the Authority; | Establish and manage a public assistance complaints desk or ARTA Helpdesk to effectively receive complaints, feedback and monitor customer satisfaction via hotline numbers, short message service (SMS), information and communication technology, or other mechanisms where clients may adequately express their complaints, comments, or suggestions. The CART must ensure that complaints forwarded by the Presidential Complaints Center, Civil Service Commission's Contact Center ng Bayan, and Complaints Action Center of the Authority are acknowledged, received, responded to and/or acted upon within the designated period by the intended recipient within their agency; 315 EXECUTIVE ORDER NO. 44, SERIES OF 2024, “AN ORDER RECONSTITUTING THE COMMITTEE OF ANTLRED TAPE (CART) TO ABSORB THE REGULATORY REFORM TEAM OF THE MUNICIPALITY OF PALANAN, ISABELA, AND FOR OTHER PURPOSES” m. Serve as overall coordinating body for the establishment of Electronic Business One Stop Shop (e-BOSS) in compliance with the mandate under RA No. 11032, its IRR, and other issuances by the Authority. The CART must facilitate and assist various departments and offices involved during the development and implementation of e-BOSS, including logistical and personnel requirements, security of the system, development of a communication plan, implementation of contingency measures, and protection of data and information, as applicable; n. Coordinate with the agency's communications/ public relations office the dissemination of ARTA Information, Education, and Communication materials for public consumption; and ©. Perform such other functions, duties and responsibilities under RA No. 11032 (amending RA No. 9485), its IRR and other issuances issued by the Authority. In addition, the CART shall perform the following functions of the Regulatory Reform Team as provided in the JMC 2019-01: 1. Take stock of all existing local ordinances and issuances made by the municipality solely or jointly made with other LGU’s or National Government. Agencies; 2. Conduct public dialogues with stakeholders such as NGA’s CSOs, and the private sector to identify burdensome regulations and determine priority ordinances and issuances of review/assessment; 3. Review/Assess prioritized local ordinances, issuances, and resolutions, it any is redundant, outdated, or unnecessary, using the prescribed “Four- Way Test"; 4, Recommended Policy options that may be adopted by the municipality; 5. Draft policies based on the result of assessment; 6. Accomplish the Regulatory Reform Technical Report (RRTR); 7. Create a Monitoring and Evaluation System; 8. Create and/or update the database system and the municipal website to Include all local ordinances, issuances and resolutions with their corresponding amendments, as well as update Citizen’s Charter to be business-friendly and accessible, with all services offered classified as Simple, Complex, and Highly Technical; 9. Establish regulatory management procedures and Methodologies in the modification, adoption, implementation, and evaluation of existing local ordinances, issuances and, resolutions of the municipality; 10.Conduct studies/reviews in the promotion of efficient government services and ease of doing business; 11.Conduct quarterly meeting and as the need arises, with proper documentation; 4is EXECUTIVE ORDER NO. 14, SERIES OF 2024, “AN ORDER RECONSTITUTING THE COMMITTEE OF ANTLRED TAPE (CART) TO ABSORB THE REGULATORY REFORM TEAM OF THE MUNICIPALITY OF PALANAN, ISABELA, AND FOR OTHER PURPOSES 12.Ensure regular and timely submissions to the DILG and ARTA; and 13.Perform other functions as may be necessary in the performance of the Task Force’s mandate. SECTION 5. SECRETARIAT. There shall be a CART/ RRT Secretariat who shall assist the Committee in the performance of its duties and functions: Head Secretariat: MS. NELIA A. Funding for the operations of the Committee on Anti- Red Tape (CART) shall be sourced from the funds of the MOOE of the Office of the Municipal Mayor. SECTION 7. REPEALING CLAUSE. All issuances, orders, rules and regulations, or parts thereof that are inconsistent with any provision of this Order are hereby repealed or modified accordingly. SECTION 8. EFFECTIVITY.
