Instructions- You may choose any one of the topics given below

1. “Enforcement of contracts contingent on an event happening –Contingent contracts to


do or not to do anything if an uncertain future event happens, cannot be enforced by law
unless and until that event has happened. If the event becomes impossible, such contracts
become void.” Discuss the statement with case examples and relevant provisions
of the Contract Act 1872

2. Explain the concept of force majeure and its significance in commercial contracts.
Analyze the different ways in which force majeure clauses can be drafted and
their impact on the parties involved.

3. Compare and contrast the legal concepts of force majeure and frustration.
Analyse the similarities and differences between these two doctrines, and explain
when each may be applicable.

4. Discuss the role of the doctrine of frustration in relation to COVID-19 pandemic


related disruptions in commercial contracts. Analyse the extent to which the
pandemic has impacted the operation and application of the doctrine of
frustration.
SUBMISSION GUIDELINES:
The assignment must be computer composed in A4 Paper.
The assignment needs to be emailed ( khaledhc@gmail.com) to the faculty a week
before the final exams.
The assignment carries fifteen (15) marks.
The Word Limit is 1500-2000. Footnotes and bibliography will not be counted towards
the word limit.
Use appropriate referencing (whether they be websites, textbooks, articles or anything
else) in footnotes or in endnotes.
Plagiarism will be heavily penalised.
