This letter of Contract is between Artistic Directors of Falcarragh Winter Jazz Festival, Conor
and Micheal Murray, of Falcarragh, County Donegal, and Mike Nielsen, musician, in respect of
the performance and production of Live-streamed Video Broadcasts on Wednesday 2nd December
at the Shamrock Lodge, Mainstreet Falcarragh, as part of Falcarragh Winter Jazz Online Series
2020, funded by the Donegal County Council.

Under the current Level 5 Guidelines, the production of television and radio programmes,
video, sound, digital or other electronic content and the broadcast or publication of the
same to the public or a portion of the public’ is classed as an Essential Service.

Level 5 restrictions in operation for all counties from midnight

The Government has announced a move, for the whole of the country, to Level 5 of the
Resilience and Recovery Plan with effect from midnight on Wednesday 21st October for a
proposed period of 6 weeks to be reviewed after 4 weeks. Level 5 states that workplace
attendance is for ‘essential workers only’. The Government has stated that manufacturing,
construction, schools and childcare are all essential services. In addition, there is an
updated list of essential services that includes the following note on 'information and
communications' which we believe is relevant to our ( theatre and performing arts) sector:
"the production of television and radio programmes, video, sound, digital or other electronic content
and the broadcast or publication of the same to the public or a portion of the public."

Essential Services / Information and Communications

9. The following services relating to information and communications:
(a) the production and publication of newspapers, journals and periodicals and the
distribution of those publications, whether in hardcopy or digital format;
(b)the production of television and radio programmes, video, sound, digital or other
electronic content and the broadcast or publication of the same to the public or a portion
of the public;
(c) the provision of services necessary to deliver and support wired telecommunication
activities and satellite telecommunication activities and other communications activities
(including internet and cloud providers);
(d) the provision of data centre services and related services.
