This Assignment Agreement (the „Agreement”) dated this ________29th March__ day of
____2021______________,
between:
Kratos Consulting (the “Employer”)
and:
_WYCLIFFE OUCHO_______________________________________________ (the “Part
Time Employee”).

BACKGROUND

WHEREAS, Employer wishes to retain the part time employee for certain work-related
services,
WHEREAS, the part time employee wishes to render such services to Employer.
NOW, therefore, in consideration of the promises and covenants contained herein, as well as
other good and valuable consideration (the receipt and sufficiency of which is hereby
acknowledged), the Parties do hereby agree as follows:

1. TYPE OF EMPLOYMENT
The part time employee will be employed on the following basis:
part-time position.

2. POSITION
Employer will employ the part time employee in the following position: Mystery Motorist
("Position").
The part time employee will be responsible for the following duties:
Primary Responsibilities:
Mystery Motorist will be required to;
 Driving into petrol stations in order to evaluate the overall refueling experience while
remaining discreet and “pretending” to be a regular customer.
 Finding a specific product is available or purchasing any product to properly check
service provision and customer service; either, fuel, lubricant, gas, car wash, wheel
alignment, Air pressure, etc etc;
 Taking notes during the visit that will be later used for writing a report;
 Filling in an online questionnaire that will be later used for data analytics and reports
 Taking photos where detailed proof is required, discretely.
 May use their own money to make list of approved purchases but all purchases have to
be within what is in the agreed allowance ( to be reimbursed once all the required duties
are completed);
 Using caution and restraint when making purchases or refueling so as to not go over the
mileage budget established by Kratos Consulting
 Keeping ALL the receipts as this are used as evidence of visit to premises required
 Ffollowing the specific refueling instructions from Kratos Consulting
 Interacting as regular customers with employees (e.g. customer service attendants, tyre
experts, lubricant personnel and Managers) of the establishment they’re assigned to
visit: And Never disclosing by either body language, or speech, or writing that
they are the mystery motorist
 Asking questions about a product or service like a regular customer would;

 Evaluating the level of customer service provided by the station employee(s), as well as
their selling abilities; and especially upselling, cross selling and any extra mile service
provided.
 Making observations about the employees’ behaviour and answers, in some cases
(where name badges are provided), even learn their names and being able to describe
them. {From their hair to the type of shoes worn}.
 Filling out an online questionnaire and writing and emailing any additional summary
report about the visit (s) and the service received, including all the details about their
refueling experience:
 Filing or sending their finished reports via email daily, along with the receipt of the
purchase.
 waiting for the employer’s final confirmation on the completion of the assignment before
getting out of assigned area especially if online survey questionnaire has not been
successfully transmitted.
The Employer may change these duties and responsibilities during the course of the part time
employee’s employment after consultation with the part time employee.
3. PROBATIONARY PERIOD
The part time employee will be subject to a probationary period of 2 petrol station visits. During
this probationary period, Employer may terminate the employment relationship at any time, for
any reason, in Employer's sole and exclusive discretion, with or without notice.
4. COMPENSATION
In consideration for the part time employee's performance of the part time employee's Duties in
accordance with this Agreement, the Employer agrees to pay the part time employee the
following compensation ("the Compensation").
1. Mileage allowance (Subject to tabulation of Mileage Sheet) of Kshs 40/- per kilometer
covered.
2. One off Airtime allowance & Mobile Data Allowance of Kshs 1,000/-
3. Daily Allowance (Maximum of assigned days) of Kshs 4,000/-
4. Daily Meal Allowance (Maximum of assigned days) of kshs 2,000/-

The Compensation above will be paid upon completion of the assignment except for the
Airtime that will be credited directly to your mobile number. (Mileage allowance can be claimed
daily at the close of the day) once daily assignment is completed).
The Compensation will be paid by direct deposit into the part time employee's nominated bank
account or by way of cheque deposit or M-pesa credit.

5. SCHEDULE & LOCATION

Daily Tasks:
 (Morning video chat on) Planning for the day’s assigned visits.
 (Morning video Chat on) Detailed route map of the places to be visited and what to
cover.
 Visiting different stations like a regular motorist
 Purchasing a specific product or type of
 product within the compensation limits.
 Evaluating and documenting their refueling experience via a shared link.
 Writing and filing reports on the overall shopping experience and emailing to
(surveys@kratosc.com).
 Sharing photos taken for the day to email ( survey@kratosc.com) indicate on each
image the name of the specific establishment
 Sharing mileage claim form of the trips to stations completed and successfully
submitted for the day to ( Surveys@kratosc.com). Indicate your name and Area being
covered.

The part time employee is expected to work at the following location:

6. TERM OF AGREEMENT
The starting date for the employment is _____________________________ ("Starting Date").
The part time employee will be expected to begin work on the Starting Date. This Agreement
shall continue in full effect until terminated by either of the parties as outlined below. This
Agreement will automatically renew for the same duration as established in the initial term (i.e.
the same number of days, months or years as established in the initial term) and will continue
to renew until either party provides notice, in writing, of its intention to cease automatic
renewals, at which point, this Agreement will terminate prior to the following renewal date.

7. TERMINATION
Employer may terminate this Agreement at any time, with or without notice, for any reason or
no reason at all. Employer does not need cause to terminate the part time employee's
employment.
The part time employee may terminate this Agreement at any time, by giving the employer not
less than 5 days written notice. Oral notice shall not suffice.

8. RETURN OF EMPLOYER PROPERTY

9. INTELLECTUAL PROPERTY
The part time employee hereby covenants and agrees not to release or otherwise disclose any
Trade Secret Information, as hereinafter defined, that the part time employee may have
received in the course of the assignment. Trade Secret Information includes, but is not limited
to, any formula, process, method, pattern, design, or other information that is not known or
reasonably ascertainable by the public, consumers, or competitors through which, and
because of such secrecy, an economic or commercial advantage can be achieved.

10. GOVERNING LAW

11. SEVERABILITY
This Agreement shall remain in effect in the event a section or provision is unenforceable or
invalid. All remaining sections and provisions shall be deemed legally binding unless a court
rules that any such provision or section is invalid or unenforceable, thus, limiting the effect of
another provision or section. In such case, the affected provision or section shall be enforced
as so limited.

12. WAIVER
None of the terms of this Agreement shall be deemed to have been waived by any act or
acquiescence of either Party. Only an additional written agreement can constitute waiver of
any of the terms of this Agreement between the Parties. No waiver of any term or provision of
this Agreement shall constitute a waiver of any other term or provision or of the same provision
on a future date. Failure of either Party to enforce any term of this Agreement shall not
constitute waiver of such term or any other term.

13. MODIFICATION OF AGREEMENT

IN WITNESS OF THIS AGREEMENT the parties have executed this Agreement in duplicate
on the date set out at the head of the Agreement.
