Mindful of this fact, on behalf of the State of Ukraine I have the honour to declare that in conformity with Article 12, paragraph 3, of the Rome Statute of the International Criminal Court Ukraine accepts the jurisdiction of the Court for the purpose of identifying, prosecuting and judging the perpetrators and accomplices of acts committed in the territory of Ukraine since 20 February 2014. This Declaration is made for an indefinite duration and wil! enter into force upon its signature. As a consequence, Ukraine will cooperate with the Court without delay or exception, in conformity with Chapter IX of the Rome Statute. To endorse the Declaration of the Verkhovna Rada of Ukraine “On the recognition of the jurisdiction of the International Criminal Court by Ukraine over crimes against humanity and war crimes committed by senior officials of the Russian Federation and leaders of terrorist organizations “DNR” and “LNR”, which led to extremely grave consequences and mass murder of Ukrainian nationals” (attached). 2. That the Cabinet of Ministers of Ukraine and the Office of the Prosecutor General of Ukraine gather necessary materials and proper evidence base to address to the International Criminal Court in accordance with Article 12, paragraph 3, of the Rome Statute of the International Criminal Court in respect of crimes against humanity and war crimes committed by senior officials of the Russian Federation and leaders of terrorist organizations “DNR” and “LNR”, which led to extremely grave consequences and mass murder of Ukrainian nationals. 3. Groysman Kyiv 4 February 2015 No 145-VIIIDECLARATION OF THE VERKHOVNA RADA OF UKRAINE On the recognition of the jurisdiction of the International Criminal Court by Ukraine over crimes against humanity and war crimes committed by senior officials of the Russian Federation and leaders of terrorist organizations “DNR” and “LNR”, which led to extremely grave consequences and mass murder of Ukrainian nationals On behalf of the Ukrainian nation, the Verkhovna Rada of Ukraine as the exclusive legislative body of Ukraine recognizes the jurisdiction of the International Criminal Court for the purpose of bringing senior officials of the Russian Federation and leaders of terrorist organizations “DNR” and “LNR’, to be determined by the Prosecutor of the International Criminal Court, to criminal liability in the International Criminal Court in respect of crimes against humanity and war crimes, stipulated in Article 7 and Article 8 of the Rome Statute of the International Criminal Court, committed on the territory of Ukraine starting from 20 February 2014 and to the present time. Starting from 20 February 2014 there is an ongoing Russian Federation’s and Russia supported militant-terrorists’ armed aggression against Ukraine, during which a part of the territory of an independent and sovereign state of Ukraine — the Autonomous Republic of Crimea and the city of Sevastopol — was annexed, parts of Donetsk and Luhansk regions of Ukraine were occupied, thousands of Ukrainian nationals, including children, were killed, thousands of people were injured, the infrastructure of the whole region was destroyed and hundreds of thousands of people were forced to flee from their homes. Recent blatant act of violence by the military forces of the Russian Federation and the Russian Federation supported militant-terrorists was the shelling from multiple launch rocket systems “Grad” of civilians in residential areas of the Mariupol city in South Eastern Ukraine on 24 January 2015, which Killed more than 30 civilians, including 2 children, and injured over 100 people. The Russian Federation continues to supply mercenaries and weapons, with which militants kill Ukrainian nationals. During this undeclared war a number of Ukrainian nationals are illegally held captive in the territory of the Russian Federation. Taking into account that the mentioned actions contain elements of serious and grave crimes against humanity and war crimes which fall within the jurisdiction of the International Criminal Court, the Verkhovna Rada of Ukraine by this Declaration: recognizes under Article 11, paragraph 2, and Article 12, paragraphs 2 and 3, of the Rome Statute the jurisdiction of the International Criminal Court in respect of crimes against humanity and war crimes committed by senior officials of the Russian Federation and leaders of terrorist organizations “DNR” and “LNR”, which led to extremely grave consequences and mass murder of Ukrainian nationals starting from 20 February 2014 and to the present time.
